Neil Entwistle Charged in Wife's, Daughter's Deaths

BOSTON — A man arrested in the Massachusetts shooting deaths of his wife and baby daughter appeared before a British court Thursday.
British authorities on Thursday arrested Neil Entwistle (http://javascript%3Cb%3E%3C/b%3E:siteSearch%28%27Neil%20Entwistle%27%29;), who had returned to his native England a day after the Jan. 20 killings.

Entwistle is currently in custody at a London police station and appeared in court shortly before 6 p.m. London time (1 p.m. EST). Before dealing with the charges at hand, a British judge must decide whether the suspect should be extradited to the United States to face two counts of murder and a weapons-related charge related to the case. Entwistle on Thursday said he would not consent to extradition.

Middlesex District Attorney Martha Coakley (http://javascript%3Cb%3E%3C/b%3E:siteSearch%28%27Martha%20Coakley%27%29;) said Thursday that prosecutors believe Entwistle may have backed out of a plan to commit suicide after killing his family in their Massachusetts home.

Investigators believe he used his father-in-law's handgun to shoot his wife and daughter on the morning of Jan. 20, Coakley said. She said he may have intended to kill himself as well, possibly because of financial difficulties as his Internet business ventures failed, but he didn't follow through.

he next morning, Entwistle bought a one-way ticket and got on a flight to London. Before leaving, he returned the .22-caliber handgun to his father-in-law's home in Carver, Coakley said. The arrest warrant was issued Wednesday, a day after prosecutors received forensic results indicating the gun used in the killing was from a collection owned by the father-in-law.

"We have forensic information that links it both to him and to Rachel, and we know Rachel had not used that gun," Coakley said.

Neil Entwistle, also 27, was arrested Thursday at a subway station on a provisional extradition warrant issued the night before, London's Metropolitan Police said.

During the five-minute long court appearance at Bow Street Magistrates Court (http://javascript%3Cb%3E%3C/b%3E:siteSearch%28%27%20Bow%20Street%20Magistrates %20Court%27%29;) Thursday, Neil Entwistle, who was dressed casually in sports clothes, remained calm and confirmed his name, address of his parents in Worsop, England, and date of birth. Two lawyers — one representing the United States and the other Neil Entwistle, were also present.

When asked by the British magistrate if he understood the nature of the allegations against him, the suspect said: "I do."
The extradition issue was not settled Thursday; the judge said he will keep Neil Entwistle in custory until Friday and that he will not grant bail at this stage. The suspect is allowed to change his stance on extradition and agree to it.

During the extradition hearings, the judge will look at evidence and decide whether Entwistle should be sent back to the United States for prosecution. But law clerks stressed that since this is Entwistle's first court appearance, no formal decision will be taken. The judge likely will hear the arguments for extradition, then will ponder the issue and make a ruling in a few days.

A spokesman for his wife's family declined to immediately comment on the arrest.

Massachusetts authorities flew to London late last month to interview Neil Entwistle at the U.S. Embassy, but officials didn't say whether he answered any questions. He was considered "a person of interest" at the time, not officially a suspect, and had been staying at his family home in Worksop, in central England.

Police were first called to the Entwistles' Hopkinton home on Jan. 21 but didn't see anything wrong, authorities said. Coakley said that friends of the couple had showed up for a dinner party but no one answered the door, and that Rachel Entwistle's mother called police when she couldn't reach her daughter.

After a missing-person report was filed, police visited the home again, and during the second search, discovered the bodies amid piles of bedding. Rachel Entwistle had been shot in the head, Coakley said.

At the time of the killings, Neil Entwistle was nearing financial ruin, but he apparently hid the problems from his wife and family, Coakley said.

"The picture we had was of a young couple starting out with a healthy future," Coakley said. But in reality, she said, "he had no money and really had no assets."

Among his Web site ventures: Millionmaker.co.uk, which promised customers as much as $6,000 in monthly earnings; srpublications.co.uk, which offered a manual that it said would help men enlarge their penises; and srpublications, which offered software at reduced prices on eBay.

Relatives told investigators Neil Entwistle was looking for a technology job at the time. His wife had been a teacher but also was not working.
He had met his future wife in 1999 at the University of York, where she was spending a year studying abroad. They married in 2003 and stayed in England until last year. Their daughter was born in April.

The family moved to Massachusetts and had rented the Colonial-style home in Hopkinton less than two weeks before she and her daughter were killed.

BOSTON - Days before his wife and baby daughter were shot to death, Neil Entwistle searched the Internet for ways to kill people, authorities said.

He also looked for escort services and Web sites that offer help finding sexual partners, according to search warrant documents released Monday.

Entwistle, 27, was arrested in his native England last week and charged in the Jan. 20 slayings of his wife, Rachel, and their 9-month-old daughter, Lillian, at their home in the Boston suburb of Hopkinton.

U.S. marshals are expected to bring Entwistle back to Massachusetts this week. A spokesman for the office said Tuesday he had no information on the date or time.

The documents depict Neil Entwistle as a secretive man who was sinking deep into debt without telling his family. He had not worked since he and his wife moved to Massachusetts from England with their daughter about five months before the deaths. His wife, who had been a teacher, also was not working.

“It appears that Neil and Rachel Entwistle had accumulated a sizable amount of debt and may have been living well beyond their means,” State Trooper Michael Banks said in an affidavit.

Internet searches
A judge ordered the search warrant documents released at the request of news organizations, over the objections of the district attorney, who said the material could compromise her investigation.

A search of Entwistle’s computer revealed he searched the Internet for information about suicide, euthanasia and “killing people with a knife,” on Jan. 16 and 17, investigators said.

The same week, he obtained the names and addresses of various escort services. He also visited a Web site called “Adult Friend Finder,” which investigators said helps subscribers find sexual partners.

Entwistle is accused of using his father-in-law’s handgun to shoot Rachel in the head and Lillian in the abdomen. Authorities said he may have planned to commit suicide, but instead fled to his parents’ home in England.

Prosecutors said Monday they did not know if Entwistle had hired an attorney in Massachusetts. He may be assigned a lawyer if he declares himself indigent.

FRAMINGHAM, Massachusetts (CNN) -- A British man pleaded not guilty Thursday to charges he murdered his wife and baby daughter, and a Massachusetts judge ordered him held without bail.

Neil Entwistle, 27, did not speak during his five-minute appearance in Framingham District Court, entering a not guilty plea through his lawyer.
He stood rigid and expressionless in court, his dark eyes darting under his mother-in-law's relentless stare.

Entwistle is accused of fatally shooting wife Rachel, also 27, and their 9-month-old daughter, Lillian, on January 20 at their rented home in Hopkinton, a Boston suburb.

He flew to England on January 21, returning Wednesday in the custody of U.S. authorities.

Rachel Entwistle's mother and stepfather attended Thursday's hearing, their faces etched with sorrow as they watched from the front row of the gallery. Other relatives took up the first few rows, the women carrying bouquets of flowers. Defense attorney Elliot M. Weinstein waived a formal reading of the charges: two counts of first-degree murder, one count of illegal possession of a firearm and one count of illegal possession of ammunition.

Insults, taunts

Entwistle, shackled and wearing a bulletproof vest, kept his head bowed as officers led him into the Framingham District Court building shortly after noon.

His transport from the Hopkinton jail tied up traffic, and a woman shouted from a passing car, "Burn that baby killer," The Associated Press reported.
Later, as Entwistle was led into a van, other bystanders booed and taunted him. "Do you miss your daughter? You're a sick animal," one bystander shouted.

Entwistle returns to court March 15 for a probable cause hearing.
Outside the courthouse, a spokesman for Rachel Entwistle's family told reporters they were devastated.

"Seeing Neil Entwistle standing accused of this awful crime gives us little comfort and, in fact, only adds to our enormous pain and suffering," said Joseph Flaherty, reading a statement as Rachel Entwistle's mother and stepfather, Priscilla and Joseph Matterazzo, looked on.

He added that it was "unbearable" for the family to learn of Entwistle's betrayal and secret life.

"To think that someone we loved, trusted and opened our home to could do this to our daughter and granddaughter is beyond belief," the statement said.

"Neil betrayed our trust in so many different ways that it is almost impossible to describe," it continued. "We never suspected anything other than a loving father and husband."

Concern for fair trial

Weinstein, Entwistle's lawyer, said he did not want to contribute to the "publicity mill" he said makes it impossible for his client to receive a fair trial.

"I am certain that anybody watching this telecast or reading the reports of today's arraignment has already formed an opinion with respect to Mr. Entwistle's guilt, and that opinion is based on the reporting (and) absolutely no facts or evidence," he added.

Entwistle was arrested in London on February 9 and chose not to fight extradition.

If convicted of the murder charges, he could be sentenced to life in prison without parole. Massachusetts does not have the death penalty.

Money trouble

The Entwistle family was having financial difficulties, according to court records. Entwistle had not worked since September and the family was paying $2,700 a month for their home, said search warrant documents released Monday.

The documents revealed that Entwistle, just days before the slayings, looked at a Web site that described "how to kill people." He also searched the Web for escort services.

The documents revealed that Entwistle apparently kept the family's finances hidden from his wife and that her parents once believed he worked a "secret government job in England which he could not talk about." "I believe that there may be a financial motivation for this murder," Massachusetts State Police trooper Michael Banks wrote in an affidavit.

Computer activities

According to the documents, details of these activities were found on Entwistle's home computer:

On January 16, four days before the slayings, Entwistle visited Adult Friend Finder, a Web site that assists "subscribers in finding sexual partners through Internet chat rooms, personal advertisements and other services, and that Entwistle made attempts to contact persons on that site."

On that day and the next, Entwistle looked at an electronic document that "describes such things as how to kill people by various methods; and that Neil Entwistle actually typed in Internet searches regarding how to kill yourself, suicide, how to kill someone with a knife and euthanasia." and took down the names of several in the Boston and Worcester areas, including Eye Candy Entertainment, Exotic Express and Sweet Temptations. That same day he searched for maps to locate streets in the Worcester area.

The bodies of Entwistle's wife and daughter were found January 22 in the family home under bedcovers and pillows. They were so well-hidden, police initially didn't find them, the documents said.

By then, Entwistle had flown to England.

Father-in-law's gun

Middlesex District Attorney Martha Coakley said Entwistle allegedly killed his family with a .22-caliber handgun he took from the home of his father-in-law, Joseph Matterazzo, then secretly returned.

Police found keys to the in-laws' home inside Entwistle's locked car at Logan International Airport, Hopkinton police Sgt. Joseph Bennett wrote in an affidavit released last week.

Matterazzo said he last used his .22-caliber revolver and rifle when he went target shooting on January 21, a day after Rachel and Lillian were believed to have been killed, according to the search warrant documents.

Matterazzo said he had taken Entwistle target shooting with his .22-caliber weapons in the past and his son-in-law knew where he kept them locked, with the keys on the counter, according to the documents.

A forensic exam of the .22-caliber handgun allegedly revealed Entwistle's DNA on the grip of the firearm and DNA matching Rachel Entwistle on the muzzle, documents said.

Somebody hire a translator for the English press, preferably one with the basics of U.S. law.

A British reporter being told the rules for the June 2 start of the double-murder trial of Neil Entwistle failed to grasp you can’t talk to jurors until after the verdict. The press pack planning for the trial met Friday in Middlesex Superior Court in Woburn, where one fella showed his lack of finesse in the court system here in the former colonies.

“So,” the Brit asked, “we’ll be mingling with jurors in the corridors but we don’t approach them?”

“We’re on the honor system in America,” a reporter informed him.

It’s also called jury tampering and, if you do it, this long-delayed case will be delayed even longer — and you’ll be covering it from inside a jail. PREDICTION: Brace for a long haul — at least three weeks — and count on a few members of the English press stumbling along the way.
Here’s a few other observations out of the press/court planning session attended by 26 members of the TV and print media …


The court, which holds about 80 spectators, will be first-come, first-served. Spectators and press are to be treated equally. Problematic, but fair.
You can leave your seat to go to the bathroom, but you’ll lose it if you take too long. So, go quickly.

The day begins at 9 a.m. and ends at 4 or 4:30. As expected.
No cell phones will be allowed. “No disruptions,” the press was warned.
TruTV (http://www.trutv.com/) (formerly Court TV), will be the pool television camera. The Herald will among the print pool for photos.
TruTV is also asking the judge to allow for a “remote cam” that will face into the court. So you can see Neil’s expressions.
The press asked for room for eight satellite trucks. That’s a ton of interest!

Reporters fight summonses in Entwistle case

Two newspaper reporters summoned by a defense lawyer in the Neil Entwistle murder case have asked a judge to quash the summonses.

Neil Entwistle, 29, accused of killing his wife, Rachel, 27, and 9-month-old daughter Lillian Rose in Hopkinton two years ago, has summoned, through attorney Elliot Weinstein, the two reporters because they wrote a story about a confidential letter written by Entwistle to his lawyers.

Former Boston Herald reporter Michele McPhee, currently a talk show host at WTKK, and current Boston Herald reporter Laurel Sweet co-authored a story on Nov. 15, 2007, about the letter found in Entwistle's jail cell that hints at suicide.

Weinstein wants the pair to testify on May 30, the last day of pretrial motions before the scheduled start of the jury trial on June 2.

In a motion to quash the summonses, filed yesterday in Middlesex Superior Court, lawyers Elizabeth Ritvo and Benjamin McPhee, representing the Herald, Sweet and McPhee, argue that the information came from two confidential sources.

"The court should quash the summons to Ms. McPhee on the separate ground that the defendant impermissibly seek disclosure of Ms. McPhee's confidential sources," the complaint reads.

The complaint says the summonses threatens to undercut the First Amendment rights of the two reporters and hampers the ability of journalists to do their jobs.

"In order for reporters to function effectively, it is essential that they appear to those they interview and to their audiences as independent of the judicial process," the complaint reads.

Massachusetts is one of the few states that does not have a shield law protecting journalists and their sources.

Weinstein could not be reached for comment late yesterday, but in an article published on May 20 in Massachusetts Lawyers Weekly he's quoted as saying, "We are trying to discern how it (the letter) got into the public domain, and we are also trying to determine if anybody connected with the prosecution is responsible for that letter reaching what turned out to be a print story in the Boston Herald."

It is unclear when and if Judge Diane Kottmyer will decide on the motion. She was not in court yesterday.

Entwistle is accused of shooting his wife and daughter on Jan. 20, 2006, to hide a life of debt and online business scams. He is being held without bail at the Middlesex Jail in Cambridge.

If convicted of first-degree murder, he would be sentenced to life in prison without the chance of parole.

Jury selection begins Monday for the trial of Neil Entwistle, who’s accused of murdering his wife and baby.

Court officials are bracing for a barrage of media from both sides of the pond at the double-murder trial of Neil Entwistle - an international throng not seen since the decade-old case of former British au pair Louise Woodward.

Officials have already spelled out the rules of the Entwistle trial to about two dozen members of the media, including some of the British press, at Middlesex Superior Court in Woburn.

That’s where Entwistle, a 29-year-old native of England, will be tried for the 2006 slayings of his wife, Rachel, 27, and their 9-month-old daughter, Lillian, in their Hopkinton home.

Jury selection begins Monday and officials fear too much publicity beforehand could taint the jury pool. Photos and footage of Entwistle will be limited during jury selection.

“I think the judge would prefer that the defendant not be shown entering the courthouse in shackles,” said court spokeswoman Joan Kenney. “Those kinds of photographs don’t help when you’re trying to seat a jury.”
Kenney said the trial is attracting international media attention and is similar to the Woodward case, “in terms of interest.”

The Woodward case drew intense media coverage on both continents. In 1997, a jury convicted Woodward of second-degree murder in the shaking death of 8-month-old Matthew Eappen of Newton. Middlesex Superior Court Judge Hiller B. Zobel later reduced the conviction to involuntary manslaughter and Woodward was set free after 279 days in jail.

The former Court TV, now called truTV, plans to cover every day of the Entwistle trial.

“The story has already received national and international attention,” said Marlene Dann, truTV’s “In Session” executive vice president. “A family murder is a shocking tragedy that touches the lives of many people.”
Other media outlets that have expressed interest include BBC, Sky TV, NBC’s “Dateline,” CNN and ABC’s “20/20.”

Rattled neighbors of Neil Entwistle have entered into a pact to remain silent as the trial of the accused wife and baby killer invades their idylic enclave in the woods in Hopkinton, neighbors said.

Keeping mum with the press will be difficult to pull off, neighbors admitted to the Herald yesterday, but they worry that their children will again be exposed to the brutal details of the Jan. 20, 2006, murders of a neighborhood mom and her baby girl at 6 Cubs Path.

They’ll also need to make room for a busload of jurors who are expected to view the murder scene - a spacious two-story colonial on a quiet cul-de-sac surrounded by six other homes. Court officials say a motion has been filed to allow the jury to tour the house soon after a jury is chosen.
“It was overwhelming,” a 20-year-old neighbor said of the days and weeks following the murders of Rachel Entwistle, 27, and her baby girl, Lillian Rose, 9 months. This time, she added, everyone has agreed not to talk about the past - or at least try not to.

“All the satellite trucks and media made it difficult for the kids,” said a 42-year-old Cubs Path dad yesterday. “The school got involved. The kids were frightened.”

He said this time, when the case commences in Middlesex Superior Court in Woburn, everyone will be thinking of the new family that has moved into the former Entwistle home.

“It’s a relief there’s a family in the house now,” he added, asking to remain anonymous. “They are very nice people and have children.”
The new couple, who did not return calls to the Herald last night, paid $480,000 for the home the Entwistles rented at the time of the murders, according to real estate records. The house was first put up for sale at $550,000.

The October sale of the house may have been made easier, neighbors said, because another renter had moved into the house. The renter’s name has not been revealed.

“Nobody knew them,” the 42-year-old businessman said of the Entwistles. “They were only here for 10 days and then everything turned on its head.”

Neil Entwistle stands accused of shooting his wife and child with his father-in-law’s .22-caliber pistol. Rachel Entwistle was cradling Lillian in her arms when they died in the master bedroom.

Lawyers for a British man accused of killing his wife and daughter, Rachel, 27, and Lillian Rose, 9 months, more than two years ago dropped their efforts to have two journalists reveal anonymous sources they used in an article.

Elliot Weinstein, who represents Neil Entwistle, 29, said Wednesday he would drop the subpoena of Boston Herald reporter Laurel Sweet and former Herald reporter Michelle McPhee, because the information was no longer needed.

The pair had co-authored an article that ran in the Herald on Nov. 15, 2007, about a letter Entwistle wrote to his lawyers hinting at suicide that guards found in his jail cell.

Weinstein had issued subpoenas to both reporters so they would be compelled to reveal the source who gave them the letter.

Wednesday, Sweet and McPhee's lawyer, Elizabeth Ritvo, prepared to have the subpoenas quashed, but the hearing was not needed.

Prosecutor Daniel Bennett, who is assisting prosecutor Michael Fabbri in the case, said the letter was not going to be entered into evidence.

"Mr. Fabbri has already said he never saw the letter. I've never seen the letter and we don't plan on introducing the letter,'' Bennett said.

Weinstein said he issued the subpoenas because he thought prosecutors were going to try to use it during the murder trial, scheduled to start Monday in Superior Court.

"That changes the landscape,'' he said.

Middlesex Superior Court Judge Diane Kottmyer said the hearing was then "moot,'' and it was not heard.

Sweet referred all comments to Ritvo, while McPhee could not be reached for comment.

Entwistle is charged with shooting his wife and daughter on Jan. 20, 2006, in the 6 Cubs Path, Hopkinton, home they rented to hide a life of debt and online business scams.

Double-murder suspect Neil Entwistle was looking to sell his story to the “highest bidder” - and trying to hook up with an old girlfriend - when he was arrested in his native England about a month after the grisly slayings of his wife and baby girl in Hopkinton, according to shocking new court filings.

In motions filed this afternoon in Middlesex Superior Court in Woburn, the district attorney lays out the prosecution’s case against Entwistle, saying the 29-year-old computer engineer was obsessed with sex, money and violence. Prosecutors argue in the motions that Entwistle’s alleged “bad acts” took place before, during and after the Jan. 20, 2006, murders of his 27-year-old wife Rachel and 9-month-old baby girl Lillian Rose.

Jury selection is expected to begin Monday in the Entwistle murder case.

In motions filed at the close of court business today, prosecutors allege Entwistle was trolling for sex online in a desperate search for escorts from Worcester to Boston.

He was looking for hook-ups, prosecutors state, on Web sites such as blondebeautyescorts, halfpriceescorts and hotlocalescorts.

Entwistle, at the time of the murders, fled to his parents’ home in Worksop, England, and was arrested Feb. 8th 2006, on a London subway car. Prosecutors stated today that Entwistle “had on his person a complete page torn from a local tabloid containing hundreds of ads by women providing a variety of escort and sexual services.”

Records state Entwistle was also carrying hand-written notes “indicating he was intending to make contact with a former girlfriend” in London.

Another hand-written note indicated Entwistle wanted to “sell to the media exclusive rights to the full story to the highest bidder,” according to the court filings.

Neil was caught on the London underground (subway) — on Feb. 8, 2006 — with “handwritten” notes stating he was willing to sell “the exclusive rights to the full story” to the “highest bidder.”
He had another “handwritten” note “indicating he was seeking to make contact with a former girlfriend.”
Had a page torn out of a British tabloid on him with “hundreds of ads” for escorts and “sexual services,” the DA astates.

All three accusations above came after his wife and child were murdered in their Hopkinton home on Jan. 20, 2006. He had fled back to Britain — buying a one-way ticket and abandoning the family BMW and keys in the Logan Airport garage — and was on the run from cops and still reportedly trolling for sex and that elusive payday.

But that’s not all!

Today’s motions also allege …


Prior “bad acts” by the defendant include attempts to establish “sexual relationships” well before the murders.
Searching Google for “how to kill with a knife” and “knife in neck” and “knife in neck kill” and “quick suicide methods.”
He joined Adult Friend Finder in August of 2005 and then visited the sex-swinger site days before the murders, the DA states.
He was into online gambling, the DA adds.
Was overheard fighting with his wife over finances when they lived with her parents in Carver before moving to Hopkinton.
He failed to land a job at four different high-tech companies in Marlboro, Westboro, Boston and Nashua, N.H.

The DA goes on to list more allegations of Neil Entwistle’s lack of compassion and common sense — all showing, prosecutors argue, a “consciousness of guilt.”

Why run after discovering his wife and baby murdered?
Why fly to London with no luggage?

Why try to run off the London subway when caught after being told by a friend the police were after him?

All questions posed by the DA today. There’s more. The blog will be back at work soon after the doors open again in Middlesex Superior Court. Next week’s trial will be a legal prize fight and the prosecution just landed an early right cross even before the first round.

Judge denies request for dismissal by lawyers for Briton accused in family's deaths


WOBURN, Massachusetts (http://helpfindthemissing.org/forum/#): A judge has denied a motion to dismiss murder charges against a British man accused of killing his wife and infant daughter in their Massachusetts home.

Neil Entwistle's attorney, Elliot Weinstein, argued in Middlesex Superior Court on Friday that the case should be dismissed or the trial moved to another venue. The lawyer cited the widespread international news coverage since the deaths of Entwistle's 27-year-old wife, Rachel, and 9-month-old daughter, Lillian Rose, in January 2006.

But Judge Diane Kottmyer denied the motion and said jury selection would begin Monday.

The judge said she would rule later on whether prosecutors can introduce evidence about Entwistle visiting Web sites for escort services. Weinstein said there was "nothing but a loving relationship between Neil and Rachel Entwistle."

Judge denies Entwistle motion to move trial to Edgartown

A defense plea to move the double-murder trial of Neil Entwistle to Edgartown on Martha’s Vineyard was denied by a judge today.

The judge also refused to completely throw out the case, declaring jury selection will commence "as scheduled" on Monday.

In pushing to relocate to Edgartown, defense attorney Elliot Weinstein said the idyllic island town may be the only place left in Massachusetts where an impartial jury can be found.

“This case has consumed the interest of all media locally, nationally and internationally,” said Weinstein.

But even the flamboyant defense attorney admitted such a case has “never” been tossed due to media attention.

Judge Diane Kottmeyer refused to dismiss the case and said jury selection will begin in Middlesex Superior Court here in Woburn, but she added if a jury cannot be chosen she may reconsider the motion for a change of venue.

Assistant District Attorney Michael Fabbri argued “extensive publication is not enough” to move the case out of the county. He added he’s confident a jury can be chosen and those who cannot sit in judgement “weeded out.”

Fabbri added jurors will be able to suspend any past stories and come to a verdict against Entwistle who is accused of killing his wife, Rachel, 27, and baby girl, Lillian Rose, 9 months, in their Hopkinton home on Jan. 20, 2006.
Entwistle, now 29, smiled today as he entered court. He looked directly over at the bench filled with Rachel’s family members who looked back with grim faces.

Weinstein also attacked the prosecution’s “slant” saying any alleged Internet surfing of sex sites could also mean someone is trying to improve their sex life, not put it at risk.

In other decisions at today’s final pre-trial motions hearing, the judge ruled:

• She demanded a list of locations the jury will visit, including the murder scene at 6 Cubs Path in Hopkinton and the in-laws home in Carver.

• Rachel’s mother and father and her brother will be allowed to stay in the courtroom for the entire trial, except when others are testifying.

• A photo showing both Rachel and her baby girl before the murders will be allowed.


• Any word of a “third-party suspect” will be handled when and if it is brought up in court.

• The use of a life-sized child mannequin will not be allowed.

ON MONDAY the jury will be selected for the trial of Worksop man Neil Entwistle, who is accused of murdering his wife and baby daughter at their home in America.

The 29-year-old former Valley School pupil has been in jail in Massachussets awaiting trial for over two years.

The case has been massive news on both sides of the Atlantic, but will the son of a Bassetlaw councillor be able to get a fair trial?

One of the things that has been most apparent since the story first broke in January 2006 is the stark differences in not only the US judicial system and our judicial system, but also how the American and British media have handled the story.

Although the trial has yet to start a stream of sordid details about the case have already been leaked to the media.

Some of the media coverage on the other side of the Atlantic has been verging on the rabid and in some quarters there Entwistle has already been tried and found guilty.

Certain news websites are inviting readers to give their views on whether they think he is guilty or not guilty and it is quite clear that a lot of people have already made up their minds before the jury has even been sworn in.

To coincide with the trial a book about the case is being published this week distastefully entitled Heartless: To Have, To Hold, To Kill?

It would defy belief that any of the potential jurors have not been exposed to any of this sensational and biased news coverage.

In the UK such coverage before a trial would leave a newspaper wide open to being found to have committed Contempt of Court, but it appears the same rules do not apply in America.

All this must be of concern too to Neil's parents - Cliff and Yvonne. Cliff, a Bassetlaw Councillor, and Yvonne, a dinner lady at Norbridge Primary School, are well known in Worksop and one can not begin to imagine what they are going through at this time.

They have lost a dearly-loved daughter-in-law and granddaughter and their son is locked-up thousands of miles away accused of perpetrating the tragedy.

The grief and pressure they are enduring must be immense yet they have managed to keep a dignified silence throughout.

We can only hope for their sake, and for the sake of justice being done, that the jury who are selected today go into this trial with an open mind, and remain unswayed by anything they read or hear outside the courtroom.

The eyes of the world will be focused on Entwistle, 29, as he stands before a judge and jury accused of shooting wife Rachel, 27, and nine-month-old daughter Lillian at their home in Hopkinton, Massachusetts, in January 2006.

Entwistle, pictured, has always maintained his innocence and, when the trial begins on Monday, the defence's case will centre on Entwistle's claims to have found his wife and child dead.

More than 20 motions are expected to be argued today in Middlesex Superior Court in the case of a British man accused of murdering his wife and daughter in Hopkinton more than two years ago.

Today is the last day for motions to be heard in Neil Entwistle's murder case, which is scheduled to begin Monday in Woburn.

The 29-year-old man is accused of fatally shooting his wife, Rachel, 27, and his daughter, Lillian Rose, 9 months, on Jan. 20, 2006, in their rented 6 Cubs Path home.

In all, prosecutor Michael Fabbri and defense lawyers Elliot Weinstein and Stephanie Page have filed 23 motions and several affidavits.

The motions were not available yesterday because a judge was reviewing them, but several of the motions have to do with evidence.

Entwistle, through his attorney, is seeking to either have the case dismissed, and if not dismissed, then have the trial take place outside of Middlesex County.

The lawyers are also asking Judge Diane Kottmyer to exclude any post-arrest statements Entwistle made to authorities here and in England, where he was arrested.

Several of the Entwistle defense team's motions mention evidence not previously discussed. They are asking the judge to exclude evidence from a sexual assault evidence collection kit from the trial, as well as gunshot residue evidence found on a knife.

They also want Kottmyer to exclude evidence of an obscene phone call, which was not previously mentioned. The nature of the call was not available.

Weinstein is also asking the judge to exclude any attorney/client correspondence from being entered into evidence.

As far as the prosecution, they are asking Kottmyer to allow them to use a child-size mannequin to represent Lillian Rose's body, as well as a DVD recording of Entwistle's statements.

They also asked that the judge allow them to tell the jury about Entwistle flying to England his other actions after the murders as evidence of "his state of mind and consciousness of guilt," according to the motion. The complete motion was not available.

They also want to introduce information about acts before and after the murders as "evidence of his state of mind and motive for murders."

According to published reports, Entwistle had on him the name of an ex-girlfriend and notes indicating he was thinking about selling the story of the murder to a publisher when he was arrested in England.

Also, Fabbri has requested that Rachel Entwistle's mother, Priscilla Matterazzo, her stepfather, Joseph Matterazzo, her brother Jerome Souza and family friend Joanne Gately be exempt from the court's sequestration order. Witnesses are typically sequestered and not allowed to sit in the courtroom, indicating those four may testify during the trial.

The witness list has not been released, but the prosecution has indicated it plans on calling 50 to 60 witnesses.

It is unknown if the judge will rule on all the motions today, but the trial is scheduled to begin on Monday with jury selection in Middlesex Superior Court.

Jury selection is expected to last three to four days, followed by three to four weeks of testimony.

Entwistle is being held without bail at the Middlesex Jail. He is charged with two counts of first-degree murder, as well as gun charges. If convicted, he would be sentenced to life in prison without the possibility of parole.

WOBURN, Mass. — A judge refused Friday to dismiss murder charges or change the location of a trial for a British man accused of killing his wife and infant daughter, and delayed ruling on whether prosecutors can introduce evidence that Neil Entwistle trolled the Internet looking for sex.

Judge Diane Kottmyer rejected the defense claim that the intense media coverage of the case has made it impossible for Entwistle to find an impartial jury.

The judge also denied a request to move the trial to Edgartown on Martha's Vineyard after Entwistle's lawyer said it might be the only place in Massachusetts where the case has not received saturation media coverage. Kottmyer said jury selection will begin as scheduled Monday in Middlesex Superior Court.

Entwistle is charged with fatally shooting his wife, Rachel, 27, and daughter, Lillian Rose, 9 months, on Jan. 20, 2006. Their bodies were discovered curled up in bed together in their rented Hopkinton house two days later.

Kottmyer postponed a ruling on a request from prosecutors to show the jury Entwistle's computer history, which includes numerous visits to escort service Web sites and other sites that help people find sexual partners.

Weinstein said hearing about the Web sites could prejudice the jury against Entwistle because prosecutors plan to use his online history to argue he was motivated to kill his wife in part because he was unhappy with his sex life.

"The evidence in this case will show that there was nothing but a loving relationship between Neil and Rachel Entwistle," Weinstein said.

Assistant District Attorney Michael Fabbri said prosecutors want to tell the jury about Entwistle's computer history to "show what was going on in the mind of the defendant at or around the time of the crime."

Kottmyer said she will review earlier cases to decide whether the jury will hear about the sex sites.

According to a summary of the case filed in court by prosecutors, Entwistle's computer records showed he exchanged e-mails with a woman he met on a Web site called Adult Friend Finder. He told the woman he was in a relationship "but looking for a bit more fun in the bedroom" and "a very discrete relationship just for fun."

Prosecutors have said Entwistle was despondent because he was unemployed and deeply in debt. They have also said that he may have planned to kill himself after killing his wife and daughter.

Entwistle told police he returned home from doing errands to find his wife and daughter dead. He said he was so distraught upon finding their bodies that he contemplated suicide, but instead flew to England to be comforted by his parents.

WOBURN, Mass. (AP) — The young woman and her baby girl were snuggled together in bed, the infant nestled in her mother's arms, tucked under a thick comforter in the master bedroom of their home outside Boston.
Both had been shot.

The woman's husband and the baby's father, Neil Entwistle, a computer programmer from England, was gone.

Authorities say he fired two .22-caliber bullets into his wife, Rachel, and 9-month-old daughter, Lillian Rose, then fled to his family's home in Worksop, England, because he was despondent over mounting debt and dissatisfied with his sex life.

In the days before the killings, authorities say, he conducted online searches for information about murder and suicide.

Entwistle, 27, insists he loved his family and was so horrified at finding them slain that he returned to England to be with his parents. He said he didn't call for help because it was obvious they were dead.

On Monday, he faces trial on two counts of first-degree murder.

Entwistle's attorneys have proclaimed his innocence, but have not given any hint of their trial strategy. Attorney Elliot Weinstein has repeatedly said he is concerned that Entwistle cannot receive a fair trial because of the extensive media coverage. On Friday, the judge denied a request to move the trial.

Entwistle and Rachel Souza met in 1999 at Britain's University of York, where she was spending a year abroad. They married in 2003 and lived in England for two years before moving to Carver, Mass., a small town about 40 miles south of Boston, in summer 2005 to live with her mother and stepfather.

Her family told police they never saw any signs of trouble, except for one argument over money they overheard in the fall of 2005.

Entwistle told police his marriage was "perfect," they did not fight and never had any "cross words."

Prosecutors, however, said Entwistle was unable to find a job after the family moved to the United States, and charged large amounts on credit cards. He started a number of Internet businesses, including a Web site that promised customers as much as $6,000 in monthly earnings and another that offered a manual to help men enlarge their penises. All of them failed.

Entwistle also started expressing unhappiness about his sex life, investigators said.

Searches of his computer showed that, beginning in August 2005, he joined a Web site called "Adult Friend Finder." In the week before the killings, he allegedly visited Web sites called "blondebeautyescorts" and "naughtynightlifeescorts." After he'd returned to England, he tore a page from a London tabloid containing hundreds of ads from women "providing a variety of escort and sexual services," according to court documents filed by prosecutors.

Although financial pressures were mounting, the family had moved out of Rachel Entwhistle's mother's house into a $2,700-per-month rented house in Hopkinton, in Boston's southwest suburbs. Just 10 days later, Rachel and Lillian were dead.

Entwistle told state police that on the day of the killings he told his wife he had a job interview, but the interview did not work out so he went shopping for computer parts. Prosecutors said there was no job interview.

Entwistle said he discovered his wife and daughter dead when he returned home two hours later. He said he was so distraught that he got a knife from the kitchen to kill himself, but couldn't go through with it because he "knew it would hurt," according to prosecutors.

Prosecutors say that after his wife and child were shot, Entwistle drove 50 miles to his in-laws' house in Carver and returned a .22-caliber handgun he had taken earlier from his father-in-law's gun case. Entwistle's DNA was found on the grip of the gun and DNA matching Rachel was found on the muzzle, court documents say.

Authorities found Entwistle's car at Boston's Logan International Airport. Entwistle bought a one-way ticket to England and boarded the flight an hour later with no luggage.

Police found the bodies two days later after being called by concerned relatives.

Rachel Entwistle's mother, stepfather and brother plan to be in court every day, said Joseph Flaherty, a family spokesman.

"They go into the process with great faith that there will be justice for Rachel and Lillian," Flaherty said.

Opening Statements Set To Begin In Entwistle Trial

WOBURN (WBZ) ― Opening statements will be delivered Friday in the trial of Neil Entwistle, the British man charged with killing his wife and infant daughter in Hopkinton in 2006.

A jury of eight men and eight women was seated Thursday to hear the case, which has attracted international attention.

Entwistle is accused of shooting his 27-year-old wife, Rachel, and 9-month-old daughter, Lillian Rose, in their rented Hopkinton home in January 2006.

Prosecutors allege Entwistle killed them after sinking deeply into debt and becoming dissatisfied with his sex life.

It took four days to select the jury of 12, which includes four alternates. Many other potential jurors were dismissed after saying they had already formed an opinion about the case, leading Entwistle's attorney to question whether his client can get a fair trial.

Judge Diane Kottmyer turned down a defense request to have the jury visit the Hopkinton home during the trial.

Barred from jurors’ eyes, a pornographic photo purportedly of wife-and-baby killer Neil Entwistle obtained by the Herald appears to be another lie the brutal Brit spun to lure lovers on the Web.

Posted on the sex swinger site Adult Friend Finder, the snapshot shows a lanky man lounging on a white beach chair exhibiting himself, grotesquely endowed.

The full-frontal exposure, law enforcement officials charge, was posted by Entwistle on his profile page on the swinger site to attract extramarital bed buddies.
