CASSATT — A 13-year-old South Carolina boy has been charged with murder in the shooting death of his 10-year-old relative.

Kershaw County sheriff officials said today that Gaylord Roberts was fatally shot by the teenager, whose name hasn't been released.
The State newspaper of Columbia reports at least four children were at the home in Cassatt when the shooting happened around 12:30 p.m. Monday.
Authorities said 44-year-old Gary Roberts has been charged with unlawful neglect after leaving a gun at the house and the children unattended. He is being held at a Kershaw County jail. The 13-year-old is being held at a Department of Juvenile Justice facility in Columbia.
It's unclear if either has an attorney. A message for a sheriff's spokesman wasn't immediately returned today.

Even IF it was accidental, I'm glad they charged his father, too, for leaving the gun where he could get it.

S.C. Boy, 13, Pleads Guilty In Brother's Death

Posted: 11:21 am EDT May 21, 2009

COLUMBIA, S.C. -- A 13-year-old South Carolina boy charged in the shooting death of his 10-year-old brother in their Kershaw County home has admitted to the killing.

The State reported Thursday that the boy has pleaded guilty to voluntary manslaughter. The boy will be sentenced in about 45 days.

Authorities say the teen shot his 10-year-old Gayloyd Roberts after they argued over where to sit to watch a movie while out of school for a snow day in March. The boy's father, 44-year-old Gary Travis Roberts, is charged with illegal neglect of a child for having an unsecured, loaded gun in the home.

Prosecutors said last month that the teen wouldn't be tried as an adult

I will bet you a dollar to a donut that father would have sworn prior to the killing that his son would never touch that gun without permission......"my kid knows about guns, I made sure that he was taught gun safety, etc, etc, etc" Of course, he could have used a knife or a club...but he didn't...he went for the gun that he KNEW was there.
