Witnesses for the Defense

1. Barry Rumack - Physician (MD) Licensed in CO, WI (not current) CA - Clinical proffessor of pediatrics. Rocky mountain poison center.Degree- Univ chicago, Degree- University of Wisconsin, Intership in Colorado - pediatric, 2 yr fellowship with national institure of heath in Bethesda MD , drugs, metaboliznm of drugs and other chemicals.Henry Matthew in Ediborough Scottland, toxocology, has largest poison unit there. Was sponsered to go there and study. Is a medical toxocologist who looks at patients who have been poisoned. Initially trained in pediatrics but most patients he saw were adults. Began treating poisoned patients in Edinborough and then in 74 started with University of Colorodo in Denver area.

Was made Founding Director in 74 of Rocky Mountain Poison center. 74-92 was full time, still teaches there and participates in conferences.

Board Certified in Pediatrics and Medical toxicology and is a special employee of the FDA.

Developed the anticdote for Acetaminaphin poisoning.

Testified that he looked at the evidence in the case, the police reports, lab results, toxocology reports, autopsy reports, crime scene photos etc. Found a descrepency in the statements of large amounts of EG in the stomach contents. Said that the calculation to determine the total amount should have been there. Not just the concentration. Said any reasonable competent toxocologist would have calculated the total amount, not the concentration. Would consider that error misleading.

2. Paul DeFazio - Therapist who saw Julie in 1990. Recommended that she try Prozac. Testified that she had situational depression.

3. Pastor Ekler - Pastor at St. Pauls Lutheran Church until 1995. Testified that the Griffins were dysfunctional. Testified that Mark was acting normal at the wake.

4. Albee's employee testifying that she sent the transcript to Mark in jail.

5. Laura Koster - Mark's sister - Testified that Julie got upset about her son smearing feces on the bathroom wall while Julie was babysitting. Testified that Julie had told her that there was mental illness in her family. Testified that Julie showed her a pic of Marks dayplanner and a syringe. Said she thought that it was strange that Julie took the time to show her and ask her what she thought of it. Said a couple of weeks before JJ died she told her she thought MJ was trying to kill her. She said she didn't think it was important, didn't find it pertenent to tell the police about this after Julie died.

6. Dr. Boreman- Julie's Family Practitioner - Testified that he thought JJ could have had mild depression. Said he gave her paxil samples to try on 12-1-99. Said Mark came to the office on 12-2-99 and said Julie couldn't sleep and he had looked on the internet about Paxil and thought she was having a reaction. Asked for something to help JJ sleep. He prescribed her 10 mg of Ambien, one a day at bedtime. Didn't know until he was on the stand that 3 were missing from prescription instead of 1. Didn't know Julie had died until Saturday, no one called him, no one questioned him. He thought that was odd. Went to the wake and Mark accused him of giving Julie meds that caused her to die of a drug interaction.

7. Joan Wise - Worked for Secure Insurance - Worked with Ed Klug for 10 years. Worked with him at Robert Baird for 7 years. She was Klug's assistant. Oct 1998 opened a Stifel Nickolas office in Kimberly (Subburb of Appleton) with Klug and Wruck. Testified that Klug told the staff that Mark's wife had commited suicide. Testified that you can't believe a word Ed Klug says. Said that Ed Klug fired her and she was resentful.
8. Debra SpearsTegel - Ex girlfriend of Arrron Dillard. Said when she met him he introduced himself as Kyle Resnick. Said she started borrowing money to Arron and it wasn't panning out so she went into his wallet and found out his real name, ran a check on him and found out he wasn't such a good person. Tried to stay friends with him after that to try to get some of her money back.

9. Mark Hunter - Lt. with Plesant Prarie Police dept. for 23 years. Lt since 1999. Knew Julie Jensen, 1991 or 1992 had been called to JJ residence for hang up calls. Dealt with her on the phone and in person. 1991 JJ wanted trace on phone, doesn't know if that happened. 1992 JJ said she thought calls were coming from Illinois, said was going out of town and wanted extra patrol. Said she thought it was PT, told him of the affair and that she broke it off and worked things out with her husband. Offered to call PT which he did. Called him 1-8-92. Report that garage had been (8/1991)broken into. 1/8/92 Called PT worked at Dean Whittier in Illinois, Julie gave him the # to call him so he called and asked for PT told them who he was and where he worked and JJ had called him and said she is getting hang up calls and told PT that if he had been doing this to stop. PT said how dare you call and harrass me. PT told him of the affair said he respected her wishes not to call or contact her and said he hadn't called or contacted her and was upset that the officer was calling and accusing him. Officer said he wasn't accusing him. PT denied calling or having contact with her. Julie had gone out of town 1/10/92-1/12/92 (which is why she asked for extra patrol at her house) said when she returned Jill Griffin had told her that she had received a letter for JJ in care of her from PT, Christmas card and rambling letter wishing her well, cartoon clippings and articles. JJ was upset about letter. Saw post card was 1-6 and he had talked to PT on 1-8 so he was concerned that PT had not told him that he had sent the letter when he was on the phone with him.

10. Brian Quintana - Jailhouse snitch that testified that Thompson bullied Jensen in jail. Said Thompson was yelling at Jensen. Said he forced him to give him his food.

11. Brad Montgomery - Special agent with the Wisconscin Department of Justice - Computer Forensics. Testified that Rhonda Mitchell is a forensic analyst. Testified that he got a phone call from Rhonda asking for a definition for 3rd party cookies. Said she was on the witness stand and was in the process of her testimony. Said he didn't know if Rhonda knew what a 3rd party cookie was or not. Provided Rhonda with an answer. Watched some of Rhonda's testimony. Didn't hear any of her testimony about a 3rd party cookie. He did see the recross where Albee asked if she knew what a 3rd party cookie. Said he was concerned that he had witnessed Rhonda lie on the stand. Went to his supervisor which is also Rhonda's supervisor, she wasn't in, sat on it overnight and in the morning sent an email to his supervisor saying he needed to talk to her. Sent her a memo in the morning and told her what happened.

12. Dr. Spiros- Psychiatrist - Forensic Psychology, - Read over the facts in the case. Testified that he thought Julie was suffering from a major mood disorder, was severly depressed and that she commited suicide. On cross, witness refused to answer or comment on several things. Judge called him incompetent.



13. Ms. Cooper - Direct - Was a sales assistant to a broker at Stifel Nickolas - Testified that she knew Klug. Came to help Klug open his office twice. Said she met Mark the weekend of the blueprint conference in St. Louis. Went to the Marriot in St. Louis about 9 or 10 to go to the bar and meet some Stifel Nickolas employees. Was in the bar talking with people she knew. Said that several hundred people were there in the bar at the beginning of the night. Said Mark, Ed and Kelly were there. She stayed until 2 am when they closed. Most people had left the bar at the end of the night leaving 25-50 people there. Mark and Ed were still there. After bar closed they went to the lobby (Mark, Ed, maybe Ron Wruk and others) people had taken her keys, she was really drunk so they wanted her to sober up. Kelly LaBonte had taken her keys. Kelly had already left. Kelly gave the keys to Mark. 3 of them were talking, Mark, Ed and herself for at least an hour. Discussed buisness, the firm, personal things, her divorce, she was upset that evening. Doesn't recall anything other than that. Didn't talk about Mark or Ed's marriage only talked about her. Mr. Klug left at one point to talk to his wife, then returned. She eventually drove home around 3- 3:30. Didn't hear Mark say anything about harming his wife, didn't hear him saying anything about the internet. Said she would have remembered if he did. Kelly and her are very good friends. She said if she would have heard that she would have been concerned for Kelly. Said she didn't know that Mark and Kelly were having an affair. Said her and Kelly were friends outside of work also. Had been friends at that point for several months. The day Mark was charged she had a conversation with Klug (she was working somewhere else in Rockford) Klug called and asked if she had talked to Kelly,she said no, had she heard the news, she said no, was a brief conversation, she got off the phone to call and talk to Kelly to see if she was ok. That was all that was discussed between her and Klug about Mark. Klug knew how to get ahold of her because he had her cell # and they talked periodically about business. Never during any of those calls did Klug mention anything about Mark harming his wife. Said the DA contacted her, they asked her if she had been present at the bar in St. Louis. She said yes. They asked if she recalled a conversation, she said no. They narrowed it down to asking her if she had heard the comment made about Mark harming his wife. She said she wasn't present for that conversation. Last time she spoke with Kelly was Fall 2002 or 2003.

Cross - Left hotel 3-3:30 but isn't positive. Had been drinking, enough that they took her keys. Doesn't know what time that was maybe around midnight. Kelly took her keys Kelly was about to leave between 12 or 1. Had one or two more drinks after that. Was emotional that night about the break up of her marriage. Was venting to anyone that would listen. Mark, Kelly, a couple of other people. Jambois asked if he could inquire into the complaints she had about her exhusband. She said yes, she went into her complaints about him, stubborn, not communicative, liked to push her buttons. The people there were also relaying their problems with their spouses. going back and forth encouraging each other and complaining to each other, empathizing with each other. Doesn't remember what they were discussing exactly at the time she left. Could have been less of more than an hour after the bar closed at 2. Klug walked her to the door, Mark and Klug were still there and she doesn't know what they talked about after that. Socialized with Kelly often, once with Kelly and her husband. Went to dinner with them at Joe's Crab Shack once. When Cooper met Kelly she was seeing someone (Mark Grieman) and had gotten engaged and then married. Cooper didn't know Mark Jensen and Kelly were romantic until Jan or February of 1999.

ReDirect - Said she left the bar between 3- 3:30 Didn't discuss Klugs relationship with his secretary, doesn't recall Klugs wife being jealous. During conversation only general grievences about their relationships were made,, nothing specific. Wasn't so intoxicated that she wouldn't have remembered Mark saying that if he had. Didn't black out. In re to DA questioning, Initially she was asked if she was present during conversation. nothing specific. Then after she kept asking them to be more specific they said , we understand you were present during a conversation where Mark talked about harming his wife. She said yes that is what they asked and she said no.
