Suiting up, getting ready to walk my dog in Central Park as the sun comes up, so I expect to find some others here when I return!
This morning I was thinking how weak the defense looks and the effect that has on the jury. Mmmm. Not good.
And I am also really really looking forward to Jambois' CA which I expect will be passionate and full of detail and fury!!
I cannot wait. I am so sure of this conviction. What can Albee do with his detestable client and a mountain of evidence against him?

Morning Kella and everyone :mornincoffee: They were just showing Wis.weather very cold but they didn't say anything about snow so I am sure there will be court today.Now On the other hand we are are going to get 6 to 8 inches starting at 7 tonight and into tomorrow grrrrrrr.
MY feelings about the trial so far, Albee hasn't shown me anything to make me think his defendant is NG, if anything he looks more guilty than ever

I want to repeat something I wrote near the end of yesterday's thread. It was my reaction to the testimony of Klug's disgruntled employee.
I understand that she said that Ed Klug informed them of JJ's death by saying "JJ committed suicide."
I am astonished by this. Since the line that Mark Jensen was trying to sell in the immediate aftermath of Julie's death (which would include the time of Klug's "statement") was that she died of a "drug interaction" (witness the piece of paper he was showing ppl at her wake) and the suicide theory was not developed for MONTHS, how on earth could Ed Klug have said "Julie Jensen committed suicide."
It's ridiculous and I am sure that the jury received it with total skepticism and will reject it totally.
And how does that affect the rest of the defense? It's weak, to start, and if Albee is willing to put on someone with an agenda so obviously fabricating, what does that say about the rest? When I say it's NG, I don't mean "not guilty."
And speaking of having an agenda and a willingness to lie, there's Mark's sister.
This, folks, is a ship that is taking on water and listing badly.

Kella I said yesterday the sister wouldn't look at her brother when Jambois was asking her questions about what kind of father Mark was and she acted like she was on meds. Someone told me Jean said she won't look at her brother also.To me that is a sign she is Lying.

Yes his sister was lying, everytime she answered a question, she looked down into her lap. She reminded me so much of how Pie testified in the PS trial!

Defense attorney Craig Albee’s opening statement, of course, portrayed Julie Jensen as a wife who suffered from depression and was suicidal. To his credit, though, Albee’s opening statement was slightly more visually-stimulating. Albee had poster boards of notes and statements, and a beaker of a greenish liquid we think we ethylene glycol. All of it made for what our photographer Sean Krajacic described as a “compelling” opening statement.
Brought that snippet over from the link thread. This is how the KN reporter described the OS by Albee (I missed the beg. of the trial, came in during Klug's testimony.)
If this photog was correct and Albee was indeed "compelling" (no surprise he had a board of statements) then I think the reality of the evidence presented by the defense is all the weaker and anticlimatic.
I've been saying for a long while that I was convinced that MJ would absolutely not testify. But I think there is a chance of it now. A slight chance, but maybe a Hail Mary. Albee may be reassessing the state of his case and concluding that the only chance MJ has for even a hung jury is to testify and reach that one lunatic on the jury who would be sympathetic to this killer.
It's true that he is typical of the kind of defendant who ordinarily would be a candidate to take the stand: no criminal record to bring up, well-educated. But he does have baggage.
It will be so interesting if Albee takes the chance and puts him on to try to humanize him.

Good Morning fellow posters, I'm not sure if Elkhorn is expecting more snow today but we are suppose to get 3 to 5 more inches. Right now our total is 68 inches and we don't have much room to put another snowfalls worth. I truthfully think we will fly thru the defenses withnesses and before you know it CA time.

Wow Kella! You are so right! I knew I didn't believe her but that was just because of the way she came across. But now you bring up such a good point! Makes me sure she was sought out and coached as to what to say. Grr. and the defense complains about the snitches...geesh.

I am trying to think of a good defense witness. Considering believability, knowledge, demeanor, presence of mind, likeability, and no bias, no one comes to mind. My best guess is Albee is going for the ''Mack'' defense- incompetent defense counsel, and
doing a masterful job of it!

JMO, Albee is doing a "great job" with no evidence to work with. He is like a bird, puffing up his feathers to make himself look bigger to defend his client. He doesn't have the claws (evidence) to defend MJ so it looks like he is trying, almost too hard!!

I don't think there are degrees of perjury, VR, but honestly it is a crime which is rarely prosecuted.

I'm not sure it's more incompetent defense counsel and it is incompetent judge defense. As much as I dislike Albee; you can't say he hasn't fought for his client. But then again, it does show incompetence putting on the defense witnesses he has so far. But, I'm thinking that's all he's got. I don't think he could have just got up there and said the defense rests after the state was finished with their case.

I enjoyed reading your thoughts this morning. I was wondering if you caught the question by Jambois to the sister about the fact the entire family lied on the stand for the father. IF MJ takes the stand, I am thinking that will come out to show the deceptive character of MJ. Who knows if Albee will go for it. If he does, it outta be good!

It's not so cold this morning here but we did get an inch or two if snow over night. The roads are extra slippery this morning since the freash snow has covered the icy roads.
I hope they start on time. We have alot of car accedents in the area this monring.
We are expecting about another 4 inchs today near the lake.

I think perjury can carry a penalty that ranges from nothing all the way up to some jail time, but as Kella said, it's rarely pursued. Usually, the remedy is for opposing counsel to impeach the witness, show they've been caught in a lie, and that is good enough.
Sometimes an attorney might ask the judge to strike the entire testimony of a witness who has been proven to have lied in the courtroom (especially an expert witness). But impeaching a witness, exposing them as a liar, and then hammering that point home to the jury in closing is the way I've most often seen it handled.

Hey Kella, I wanted to comment on something from yesterday but it is closed. The talk yesterday in the thread of Marks dad having pages and pages of violations and how the family has such a criminal history is what we were trying to clear up. There were people quoting criminal activity that was for a Daniel Jensen who was born in 1996 etc, addresses and birth dates show it isn't him. We, well at least I wasn't talking about anything Jambois said. Just trying to stop the other rumors that were taking off like wildfire.

Geesh, sorry, don't know the exact date of birth of the guy it was just the point that it wasn't Jensens father they were talking about. It was a different Daniel Jensen. Sorry I brought it up. I wasn't trying to argue with you just trying to explain.

Now that I'm home and watching TruTV they are showing testimony from yesterday and he's just a ballin his eyes out...funny thing, I can see clearly that his face is dry as a bone. Not ONE tear. Very bad acting job buddy.

I noticed that yesterday. Appeared to be sobbing, grabbing for klenex and sniffling; but yet not one single tear. Ya know; most men pretty much make me ill. well..except for my brothers.

I wish I had seen her testifying on cross. I read that she looked down a lot and it's also been noted that she doesn't make eye-contact with her brother which is very odd and hard to read.
And there's also the matter of her statement that Mark killed Julie which she recanted. Why? Did Dan and Flo and Mark come down on her?
That assumes it was family pressure. OTOH maybe she is just as sociopathic as her parents and brother?
I dunno. They are quite a bunch.

Yes, Jensen is a pretty common name. So the only thing on the rap sheet for old man Jensen is the burglary charge? And he was convicted? And the entire family stood up and lied about an alibi for him?
I woke up thinking about Perry Tarica. I feel even worse now that I heard the sister say Julie thought she was in love with him. I'm sure the only reason she stayed in her loveless marriage is because she couldn't bear the thought of sharing custody of her children. I also thought, by the time PT got the call from the detective, the police had already contacted his workplace and gone over his calls placed from the office? I think by this point, he knew that he was suspect of harrassing phone calls at least, if not the suspect for the pornographic phone calls. And his letter to Julie was simply to set that record straight, and let her know that he still cared about her. I think it would be a natural reaction for an innocent person to be upset about being questioned about it. I can also understand that he'd say he'd had no contact with her (as in phone calls, or person to person meeting). It may have been misleading to the police to not have mentioned the recent letter, but in his mind, I'm sure he was simply denying the phone call and porn allegations.... because he'd had no such contacts with her. He'd respected her wishes to be left alone.
go figure... he writes ONE letter in all that time... and gets busted for it. And the letter came years after the affair had ended right? Gotta go look that up. I know they gave the date of the letter. It was postmarked January 6, 1992. David was born Jan 1990, and he was about 8 months old when JJ and PT had their weekend together. So one letter, over a year later, to set the record straight because he was being accused of harrassing her?
In any case, did the letter enter into evidence? I know they wouldn't let it be read during his testimony, but the jury will get to see the letter he wrote, right?
It is sad that she died thinking he was the stalker.... when he was the guy who cared most about her.

I can't tell if Laura feels family obligation or if she is just the same as the rest of the clan. I really can't tell. The only thing I can tell is that she doesn't come across well at all. She is hiding lots.

I missed a lot of yesterdays and had to read up but I didn't see anything that caught my eye that would make me say hmmm that makes a solid point. I actually am disappointed. And even then, might not be able to go into it unless the defense calls the doctor or the defendant testifies. I believe there are pretty strict rules under which that kind of evaluation or testimony would come in.
ETA: On second thought, I suppose it might be possible to bring on a dr. to testify as to psychosexual issues and porn in general, but I still don't think that would be allowed.

Julie was not even close to being depressed. I speak from experience. I think she was scared more than anything; 1) that Mark was trying to kill her, and 2) fear of losing her children. Her active live, volunteering at school, book club, etc., shows she was not depressed.

I hate to say this, but this fellow is typical of Psychiatrists..They have a tendency to look at the worst case scenerio, by symptomology..as they are usually called in because the target person is " Way Out There"..and these specialists tend to interpret them to the highest degree of "Psycopathology"!
I think, Jambois can give this expert a whole lot of "Hypothetical Situations", without naming names, that will be good to expose Mark's devient characteristics..Sure hope he does..as I think Mark, had BIGGER ISSUES..than Julie.
Mood Disorder..Yiks...Julie came by this because of real events..not imagined events!..Psychiatricaly speaking, "Situational Depression" is treatable..as Depression with deep rooted psychopatholgy..is a diferent ballgame!

Julie was not even close to being depressed. I speak from experience. I think she was scared more than anything; 1) that Mark was trying to kill her, and 2) fear of losing her children. Her active live, volunteering at school, book club, etc., shows she was not depressed.
ITA!!! I can't imagine how frustrating this must be for Julie's brothers to have to sit through and listen to.

I might not either, in that type of setting. When it's used as it is here, though, the expert has been hired to see if he can find what the defense wants him to find. That influences how he looks at the evidence, IMO. Not that he'd lie, necessarily, but that he'd do his best to make things fit the defense theory.
You can't dissect psychological issues postmortem like you can physical issues. There's no tumor, no disease process that you can point at and scientifically say that, without a doubt, it contributed to death. Unless there's a long, detailed history from medical sources (such as psychiatric treatment, inpatient stays, etc.), then it's all too subjective, even for an objective evaluator, IMO.

I'll agree with this statement:
She was enormously upset before her death.
That fits with testimony from the Wojt's, Det. Ratz, and Theresa DeFazio. She was enormously upset because she was fearing for her life.
Sexuality...Mark says she lost all interest in sexuality? I think MJ is hardly the one to set the meter for sexuality norms. AND he even said HE declined her advances, per his emails to Kelly.
Change in appetite... that is because she was afraid to eat at home!!! Fear of being poisoned can be a delusion in a depressed person. here we go.
I think the defense is going to sink here. If the jury is already leaning toward guilt, the jury will just sit and hear this testimony the way we are... and pick it apart, one by one.
Husband said there had been many sleepless nights on Dec 2, yet Julie never mentioned it on Dec 1.

I'll get back on topic, but I just couldn't figure out how you had butterflies this early in the year if we don't have them in Texas yet (as far south as you can go...) That explains it...

This is such a flashback to how Lana Clarkson was disparaged in the Spector trial. It's still a little too fresh (and disgusting) to me. I too feel that I don't want to give him my full attention because I know what he's going to say and what his bottom line is going to be. It's just as implausible in this case as it was in Lana's.
You know, it seems if he wanted to give a truly objective opinion about Julie's state of mind, he would NOT use her accused murderer as a source of information. In fact, looks like he would totally discount anything Mark or his family (who have reason to lie to protect him) had to say about Julie and go with totally objective evidence instead. But that wouldn't do the trick, would it?

Yeah, agreed. Still, it is a good thing in less problematic deaths than Julie's was. Just the crime scene, the body positioning and inconsistent statements from Mark, the high-five, the neighbors talking about how Mark acted the day she passed all fit more of the murder scenario than suicide to me.
And this doc didn't talk to neighbors etc... all he had was Mark and Mark's family. The fibbers for Dad and high fiving Dad who was glad Julie was out of picture IMO. He needed more info before he came to court to testify.
I'd think her convo with Doc 2 days before she died is very telling, that she was concerned for herself. Not that she was contemplating suicide.

Did you hear that? He spoke to David and he said that his mother had problems with him hanging with friends!! How many friends was a EIGHT-year-old hanging with!! This man is a farce!! Get him off the stand!!
Oddly his friends included Jensen family children ... I wonder if she did think about what SIL etc were saying in front of her children when she wasn't around.

You are so right. Developmentally, this is something we might hear about in a child in the 12-16yo range.

I agree with you. That isn't the way the defense is painting it, but I believe it is the way the jury will receive it.
i am a little worried about the men on this jury after this test.

He is using suggestive personal words to influence the jury while giving his opinion, "This poor woman...didn't want to deal with the stigma of mental illness..." bla bla bla:parting:

Where is the evidence that she turned down the job at the school??? I have heard that only from defense witnesses.
What we have heard is that Mr Mangi was calling to offer her the job and was told she was asleep for a long time. She died not knowing she had gotten the job.
So what is this carp??

Wonder if the doc asked David what he thought of his father refusing to take his mother to the hospital & then his mother was dead later that day?
