I've got to leave in 15 minutes to go take my Dad for his colonoscopy. He's had colon cancer once; and we're hoping it's not back again. Keep your fingers crossed. Not sure what time I will get back; but hopefully between 9-10. Take good notes please.

So far Albee has had the fired lady, snitch, DR.s Rumack and Spiro on the stand. I give the snitch top spot for honesty, unsat for not being able to be understood well, and dead even with all the others for zero to negative worth to the defense. How can

I doubt this trial will go on much longer after that mess yesterday. How does the defense recover from this? I bet Albee and team Jensen gave the doctor an earful:s1gyahoo::sad0119:.:( I wonder if Albee was aware of this doctor not being able to withstand the questioning of the pros.:0009: His whole demeanor changed as soon as ""Mr. Jamblois"" asked the first question. :hifive: I think the doctor had too much lunch .:happy0158:

Hi Gram,I certainly agree to that! I was beginning to think this judge was a pushover for Albee!
I just hope he will continue to take charge. I wish he would jump Albee about talking over him.

My guess is that the juryroom is one wall away and that they can hear raised voices but prolly not the words.

My guess is that they sit there, annoyed that they are once again cooling their heels (because that's what juries do and how they feel) and they know they cannot know what is going on, but they know something is going on, and when they hear that they are arguing, they know it's heated but they can't speculate, can't discuss it. They prolly giggled, laughed nervously and shrugged. And they are thinking "This has gotta be over soon. Give us the case already!!!"

Yes, I can hear it, but it will be disingenuous at best. He was so obviously trying to discount his earnings. He's testified 100 times and he doesn't know this will be asked? I hope the Judge gives it to him.

One may never know but it makes me wonder if Albee told him to mislead (**cough**lie**cough**) or did the doctor do this on his own just knowing that the jury's jaws would drop to the floor knowing how much he really makes for his testimony.

Not to mention I am sure he gets paid his bigger portion after testimony.

Truthfully, after all the trials I have watched, this one has been the most exciting. I love the arguements they've had.

Well someone said in I think week 3 that I had picked a good trial for my first to watch in its entirety but it just keeps getting better and better as the weeks go on. Kind of bums me out that after this trial none will give me that special feeling inside...:girl_haha:

Sure it is, and the Judge ordered him to fax them to Jambois, I think that is correct and that is how Jam knew.:basic45:

I think they both thought Jambois would just accept the info given. You could tell he was perplexed after Jambois started in on the *I didn't ask the last amount you were paid, I asked for the total amount paid*.

Albee should have *gently reminded* him of the amount in re-direct. Then it would have been a much smaller issue. I think Jambois could call him back to the stand to *clarify* the issue, correct?

Honestly, to me the amount is pretty low. I've seen a lot more be paid to experts.

I would be scared if I were him but the judge was clear when he said he wanted him on a plane NOW. I am sure he will subpena him or court order or something, he didn't sound like he was messing around.

The snitch added zero in my eyes. IIRC Thompson said he only pushed/shoved MJ. All the other snitches said he punched/hit/slapped him. Albee has nothing. I honestly thought he had a little something with the doc that was on yesterday until Jambois chewed him up and spit him out. So Albee has had nothing but :faintTHUD:

They always bill something...cause how bad would that look if they are on the case for years, but don't bill at all. It's like the ones that observe autopsies but don't take notes (in public) because they become discovery. They write a one paragraph summary of their work to turn over. Yeah right.

Well someone said in I think week 3 that I had picked a good trial for my first to watch in its entirety but it just keeps getting better and better as the weeks go on. Kind of bums me out that after this trial none will give me that special feeling inside...:girl_haha:


Men keep killing their wives and girlfriends..but this new trend (Bobby Cutts, the Marine dude, MJensen) of blaming the DEAD woman is kind of new.

I bet there are many more good trials in your future.

I think he will be there. He might otherwise face contempt charges, and I wouldn't want to be him facing a *mad* judge with contempt. Judge might give him the max.

Does anybody remember the amounts Rumack reported and what was actually billed?

Was it $7100 reported/testified to, and 17000+ that was actually billed?

If so, I'm wondering if Rumack will say he mistated the amounts believing he said 17k.

I was wondering what Albee's office was anticipating going down yesterday because I had noticed the partner, Stephen Glynn, sitting in the rows behind Albee, and saw Albee go sit down and talk with him while other testimony was going on. I believe they knew their butts were going to be in trouble. Did you notice that when Jambois brought up that it was Tuesday and the Rumack billing records were due, it was Stephen Glynn that spoke up to address the this and thats. I think that's because he is a more senior lawyer and they believed the judge would be more inclined to accept what they had to say if it came from Glynn. Wrongo Bongo!

They keep showing Cutts with his crocodile tears, I never saw any tears running down his face.they are on verdict watch so if they come in with a verdict thts all that will be on TTV. they are saying he should not have taken the stand because he has a track record of violents.I think he strangled her.

Well someone said in I think week 3 that I had picked a good trial for my first to watch in its entirety but it just keeps getting better and better as the weeks go on. Kind of bums me out that after this trial none will give me that special feeling inside...:girl_haha:There is always that certain catch in every trial that keeps you going, it's a drug, and I'm addicted.

He can't because they have copies of the cleared check from 2003 and 2004 totalling 10,000 by itself and then another 7,100 in 2007 IIRC. So not only did he invoice it but he cashed the checks...OOPS :022:

Katy and Cavi, I *think* the state produced actual checks (or copies thereof) that had been cut for/cashed by the doctor, showing what he'd been paid before he testified (they weren't billing statements, but actual payments). The amounts he had already been paid were far in excess of what he testified he'd either billed or would be billing. But I'm not certain I got it right -- I wasn't real sure what was going on at first and didn't pay as close attention as I now wish I had.

There is something hinky about it all for the judge to have been so incredibly pissed about it. For the judge to court order the guy to get on a plane and get back in the courtroom pronto, he must feel there is not a plausible, innocent, excusable explanation for the discrepancies.

You know, the judge also got really peeved during the other doctor's testimony yesterday, especially with his lecturing the DA, giving sermons, making personal opinion comments, etc. I wonder if the judge was just completely fed up with defense tactics in general and blew his stack over that as much as Dr. R's billing/payment discrepancies.

is very poor for the defense. His demeanor is hard, his face is cruel.
I don't think Albee is a people person to pick him.

People in general do not like shrinks (especially males). This Spiro comes over
very hard, and dogmatic. I don't think the jury will like him at all. NOPE.

Irregardless of the content he may wish to convey...he is not a likeable person or compassionate. No wonder he hires out to trials.

Don't forget in the Andrea Yates trial, the appeal reversed the verdict based on a lie given by a shrink witness who said he provided scripts to the TV show Law and Order. So he won the jury over with fake celebrity! I think this goes both ways.

Albee the Alienator... that should be his title.

For trials like Mack and Cutts, I only have a fleeting interest - but I find the Jensen case riveting. I want to see every detail of it I can - right through to the end.

Judge thinks this is bigger than this case; this is HUGE for the whole system when you pay a guy for his testimony and he LIES about it.

"motive to lie, bias...this is saturated with it. To have a person come in here, say the most bizarre things and then lie about how much he was paid for it..." says the judge.

Apparently the judge thinks the "Julie killed herself, if you don't believe me just ask me" testimony from the defense witnesses is bizarre. HEEEEEEEEEE!

Oh, now Albee says the pros. clients were lying too and they should be slapped as well.

So be it. The jury needs to know your paid experts are bigger liars than the snitches the pros. put on the stand.

Yes, the jury has every right to know. It is standard questioning for expert witnesses. Albee knows it and his experts know it. On the surface, it looks as though they tried to conceal.

Albee's argument about 2002-2003 payments being too far in the past is nothing more than a bunch of baloney. If Albee is that bad at doing his job as a defense attorney, then so be it. It is not the responsibility of the judge to make it right for him.

you know these symptoms that Lisa just listed, asking Dr. Austin, her opinion....they can be organic not just psychological.

The family doctor testified and showed on screen that JJ's blood work
showed increased MCV...this is a sign of B12 deficiency which gives the same symptoms as depression. And HE chose not to follow that warning sign with further testing. Many doctors have no clue how insidious and dangerous B12
deficiency really is. I personally think JJ had organic reasons to feel sick, as well as feeling trapped and abused. She could have had that fixed and perhaps found the energy to cope more effectively!.

I don't think we can eliminate organic causes here. I see the family doctor as
very poor in treating Julie.
