They were nine years he didn't deserve.

I can't decide whether it was better or worse for their sons. They had their dad for nine years... but it was Mark Jensen.... and they had to go through this trial at an age that is probably more difficult for them.

Julie's mom and dad were gone. I'm sure one her brothers would have taken those boys in a flash.

They had a sidebar about some professional doc Albee wanted Dr Denton to read and reference. Looks like the judge allowed Albee to ask if he had ever read it but nothing else about it.

I tell ya, I think Cutts is guilty but I don't know if they proved premeditated murder. Anyone know what evidence they brought on that? I am betting on a lesser charge on that count. But I am a newbie so I probably am wrong.

Dr Denton said he has autopsies scheduled for tomorrow and I think the judge is trying to allow them to finish up with him today.

That's what I've always thought. I wish there was some way for Jambois to get into testimony something about whether the phone could be unplugged for the time Mark was gone. I know it's speculation but it makes more sense than some of the stuff Albee has brought up.

LOL If anyone just came in to this trial with Jambois cross or recross, they'd think State had called him as a witness. I sometimes find myself just watching and listening and forgetting to post comments on what I am hearing. I get enthralled with what's being said. :francis:

Albee just lied. Borman testified he was sure that Julie called in one of the nicotine meds, not sure on the other. I know that Albee is well aware of that. Albee is full of bull-dinky.

It is a teeny tiny point.

Dr. Denton said Julie's letter was contrived ~

Jambois was trying to show that the "list" might not have been that obvious to Julie... just 'odd'... because Julie said she didn't know what the list means. Since Mark smoked... 'nicotine' might not have jumped out at her as a way to kill someone.

This doctor thought the list was rather obvious... with items related to killing someone.

But... it is so weird... because it was MARK's list.. and if this doctor thought the list was an obvious list of items to be used to kill someone... you'd think he'd agree with a COD of homicide.

yes... then it got into even more little pieces of the significance.. Mark smoked..

Correct! Her husband's death was ruled heart disease maybe? To get the double indemnity insurance payment she needed his cause of death to be an accident or something.....don't remember exactly what. So she killed someone else so her husband's case could be re-opened & she could get more insurance money.

Most experts are hired to deliver for the side that hired them; but in actuallity; they are there to tell the truth; no matter which side it favors. I think this guy gave his testimony based on his truth of the evidence he was giving; even though it favored the defense. Though on cross; he finds out he wasn't given all of the information he needed to make an informed opinion. I sure don't think it's his fault if his career is sunk.Just wanted to address this a little, agree with you - I think the expert did mostly the right thing.

In the ideal world, experts are not about bias, nor being paid for filtered testimony. They testify as to how their knowledge applies to the facts. The attorneys select the experts whose knowledge applies to their theory of the case. So, in a case where the question is, suicide by EG or murder, an EG expert would be called to testify how compatible with EG the death is - as a neutral scientist, called by the defense because his knowledge and expertise relates to the point they want to make. Of course, the expert may look at the evidence the defense sends them, and disagree with the defense - in which case they would be unlikely to call him - just pay for the time spent, and go your separate ways.

My point here is that it is not the expert's job to go hunting for more evidence, for the facts of the case. They take what is sent to them, and render their expert opinion on the info provided. They're not experts in Internet searching, nor should they look at media reports - they need to try to only form an opinion based on the source materials, not reports.

When the expert testifies, it is the job of the opposing attorney to add missing information, correct any misinformation that the expert may be basing their opinion on. To me - he did a fair job there. He said, when asked, by either attorney, what his opinion would be, based on a particular set of facts. Naturally that opinion varies based on the set of facts. He did go a bit too far on the letter and such - but mostly he stuck to his job, which is a simple matter of giving an expert opinion based on a set of data.


Of course, in the real world, some are always willing to corrupt their ethics for money, and a defense attorney with no good case is going to look for these people to testify, look to people who have done so in other cases - if you are a corrupt expert, you know that when someone contracts with you to look at their evidence, if your opinion is that they're guilty - that's it - no more money for you! Oddly enough, it's always pretty obvious in their testimony because their opinion does not vary with different facts, hypothetical or not - they've lost their objectivity and become an advocate - which means they are no longer of any use (in scientific terms) as an expert. But I think this was an honest expert - he got info, testified as to what conclusions he'd reach based on that info.





By the way - a request - I read on this case, but cannot watch it. If anyone can take pity on me, and provide a bit more info about the funny remarks everyone laughs at, the testimony - I'd loooove it.

It is a teeny tiny point.

Dr. Denton said Julie's letter was contrived ~

Jambois was trying to show that the "list" might not have been that obvious to Julie... just 'odd'... because Julie said she didn't know what the list means. Since Mark smoked... 'nicotine' might not have jumped out at her as a way to kill someone.

This doctor thought the list was rather obvious... with items related to killing someone.

But... it is so weird... because it was MARK's list.. and if this doctor thought the list was an obvious list of items to be used to kill someone... you'd think he'd agree with a COD of homicide.

yes... then it got into even more little pieces of the significance.. Mark smoked..


I can't remember what was on the list. Anyone remember?

The only instance I know about for sure from today when they all broke out laughing, was right after the last break.

Before that...Out of the jury's sight, Albee was arguing that Denton couldn't read the other doctor's notes, because even that doctor couldn't read his own notes. (forgot the other doctor's name, sorry) But the Judge said, 'who knows, show me doctor stuff, I probably couldn't read a word, but IF you (Albee) gave me pages of your legal scribble, I could probably figure most of it out.'

Well, when the jury came back in and Denton was being questioned by Jambois, he was reading all of the other doctor's notes. Jambois asked him how he could do that, and he said that he took a class.

The judge erupted in laughter and the others followed.

It's been 25 years since the 1982 Tylenol murders in the Chicago suburbs.
The Janus family (3 died) lived on the next block from us, in Arlington Heights, Illinois.

That was the beginning of a horribly frightening time, as you can imagine.
It was from our local grocery store, Jewel Foods, that they found more tainted Tylenol.

It was in September when it happened, and all us parents were terrified of Halloween--as in, would anyone spike our children's candy or worse?
It was the first of many Halloweens that parents accompanied their kids, no matter the age, on their Trick or Treat night--and NO opening or eating of the candy until we got it home and dumped it on the kitchen and went through all of it. Anything unsealed got thrown out.

No cyanide or other poisons were found in Arlington Heights, but there were apples with razor blades found in several kids bags.

My daughter was 7 that year. Her dad and I covered her that Halloween like white on rice.

And it's a Cold Case, these murders. No one has been charged in what would be 7 murders that day in Arlington Heights and a neighboring town.

That awful day in September 1982 marked the beginning of the 'end of the innocence' for a lot of people everywhere, young and old alike.

And the killer might still be out on the streets walking free, and doing who-knows-what to innocent people anywhere.

This is one Cold Case I'd really like to see solved.

So do you think by his statement "I took a class", he was simply saying it was in a different language that was maybe familiar to drs but not lothers? And if so were the other drs who were claiming their handwriting was so bad just lying saying they couldn't read it to avoid answering questions by the pros? I have to say, I found it very odd during testimony by the other drs that they would say they couldn't read their own handwriting when the pros. was asking questions, but could spew off all sorts of answers when the def. was asking questions.

I'm not sure. I thought laziness/possible deception on the Defense Drs. in the beginning, but I just tried to read a grocery list for my poor husband, and until I need whatever is on that list, needless to say, we ain't getting it. :D

I got bumped off the mediafile around 4:15 (trial time) and had to fly out the door in a whirlwind to pick up my daughter who I thought my son was picking up. Thinking court was done when I returned 40 min. later I waited to try to get back to read what I'd missed. Well, I couldn't get the msg. board to load, so I thought for kicks I'd tried to load the mediafile. Immediately Jambois voice came on so I thought, we'll gee aren't I lucky, the feed must have stuck and now I'll hear what I missed. About that time the judge told the dr. he could step down and told the jury they'd earned their $20 for the day. Oh well.

I am a bit confused why the jury wanted to replace a juror with an alternate and the judge said during deliberations, a juror can't be replaced. :shock:

I tried to search for an answer, looks like there have been some problems about the alternate jurors/court cases/deliberations and all, but nothing I could find which explained it. o well, I do believe I heard, the alternates were being dismissed tho. You're soooo right! Jambois showed his passion for this case today. He also showed how knowledgeable he was on all the key facts, technical data, etc. I've never seen a cross like that! He kept firing away point after point! Jambois is my hero!!!

Rumack was rather arrogant too though. I'm thinking after seeing what that expert got away with on Monday that Rumack will be quite testy himself on Thursday. Will he just have to answer to the Judge about false/misleading testimony, or will Jambois have to question him again. Inquiring minds want to know.

I'm wondering about that too. I guess we'll just have to wait & see.:z0tdntknw: I would guess all he can be questioned on is the billing question & since he lied, he'd better be contrite. I'm not expecting him to be accomodating but we can hope!:shock:

just getting back to the board after "family time". going back to read some pages but if anybody is still around what is the next trial were going to. i was hoping Eintwistle, but i think gram told me it's not a go until june 3rd. anybody know the next one up.

Thanks! I fell in love with this little fella as soon as I saw him. I'm a dog person so it fits me. I think corny's is a little better though......drumming those paws is the best ever!:girl_haha:

I have some kind of vague memory of "character" witnesses for Mark. I don't know when Dr Airplane is scheduled to show up. Personally, I hope he had to fly in tonight at the highest fare possible, pay an over-priced rate for a hotel room & has caviar for breakfast! I'd like to see as much of ma & pa's $$$$ spent as possible! That means less left for the appeal.

Can't hang around but I wonder what happened to corny, she wasn't around long after lunch. Always miss her wit when she doesn't post for a little while.

As far as witnesses, the only one I remember Albee talking about is the other character witness against Dillard. Guess we'll see in another 8 hrs. or so. Sure hope there's no connection problems tomorrow. I got cheated out a little at the end today.

i don't know if he is first up, but he will be back on the stand tomorrow. i don't know that albee said who else he was calling. i guess though that we are sure that MJ is not going to take the stand.

IMO big mistake.

So she killed someone else so her husband's case could be re-opened & she could get more insurance money.

His death was ruled natural (emphysema) and wouldn't double her pay out. She tampered with more Excedrin and killed Sue Snow, a total stranger, then alerted LE and gave them TWO bottles of tainted capsules which she said she bought in TWO DIFFERENT STORES.

LE thought the odds that she would buy TWO of the FIVE tainted bottles in Seattle area to be incredibly long and began to look at her.

Stella still claims to be "innocent."
