Well.... I would agree there was no fire in Jambois delivery, but I think he hit all the main points. I don't see that there was any need for him to be all riled up. Now, depending upon what Mr. Albee has to say, we might see a different Jambois after that!

Things that jumped out at me--
Starting with "Mark is being good to me"
explaining why she didn't tell Borman, why she felt the way she did.
THE POST-IT NOTE DISAPPEARED!!!
If JJ hadn't photographed the LIST it would never have been seen.

Why did Mark lie about his whereabouts bet. noon and 3??
When he lied to Ratzburg about KLB and the affair, he was lying about his MOTIVE. JJ was already dead. No need to "save" his relationship with her. Really good point.
I loved when he compared Dr Spiro unfavorably to the snitches!
And Rumack to Aaron Dillard!!
And speaking of Dr Spiro and "People being bought and paid for-- at least AD
admitted" he was.
Ed Klug had no motive to make this story up. All the ppl who would have to be lying for MJ to be telling the truth.

My DSL has been going in and out all day. Frustrating to say the least.
I think Jambois stressed some really great points but he wasn't real passionate. Same tone throughout. IMO
But, I doubt if Albee makes me want to :1187603408.CR.Mothe either when he gives his CA.
Joolz did some marvelous synops of the closing if you read them, you can catch up on anything you missed.

I know I am in the minority here, but I wasn't all that impressed with Jambois closing...hopefully, he will finish up with a bang this afternoon.
Of course, the evidence speaks for itself...imo. MJ is so guilty.

hey did everybody already know this? i got it from cat toy:
On Friday I heard the TH on cnn say that KJ had "turned states evidence" against MJ; I had not heard that or realized that before. But; I do believe that LB was the TH who said it....and that makes sense why she has not been in the courtroom to support her "hubby" at all; especially today when she should have or could have been............but alas she isn't. So; I believe that LB has it right in that she had turned states evidence. She doesnt support her hubby at all at far as I can see.

she didn't turn...they subpoenaed her,she took the 5th,they gave her immunity,she testified...that happened in the prelim and in this one......the pros knew it was going to happen this way....evidentally the TH wasn't "up" on what had/has happened in this trial.

I think she told them about all the sex stuff after she was assured she wouldn't be charged with accessory after the fact. Like, his wanting the list of all the men she'd slept with, that they'd had an affair in the office (not sexual IHO) Although I consider oral sexual. I can't remember what else they got from her but it has to be more.

I think if she had gotten on the stand and took the 5th it would have shown guilt more than NG for Mark and her too.
But I don't know if the Judge would have allowed the jury to know she took 5th... So that was probably a factor in State agreeing to it... they needed her to say in jury presence what she did about the list etc...

Joolz--- with utmost respect, I am going to try to supplement your excellent summaries with my notes.
Joolz:
Starts with saying that when Julie died she felt she didn’t have to choose from option A – Mark was trying to kill her and option B – that Mark was trying to make her seem crazy and lose her children, because Mark was being kind and loving to her, as she told the neighbor in her phone call. I guess he is trying to cover why Julie would not have called for help if she thought she was poisoned.
"Mark was being good to me." All she wanted in this world. And he mentions the sedatives. WHERE WERE THEY FOUND? In the place where only one person had control of it. In the kitchen, the last place this loving mother would leave these meds. Now you know why would talk about poisons but not send the letter to LE. Not tell Borman. She knew he would refer her to a psychiatrist and call LE. The Post It Note-- OWN DRUG SUPPLY LIST--- Def's own witness Dr Denton was concerned by this list. Ominous. Wasn't sufficient for Kosman. Too bad JJ didn't show it to Dr Denton.
Brings up some of the things Julie did thinking her husband was trying to kill her in the weeks before her death – taking photos of the day planner, writing the letter, etc…
Brings up that a doctor testified that Julie was delusional and angry. Says that there has been no evidence that Julie was angry… that there was plenty of evidence that she was frightened, but not angry.
Brings up the defense suicide theory. Says that the defense is not just saying she committed suicide but that she was angry enough to try and frame her husband for her murder. He says the notion is utterly ridiculous – says there has been no evidence to support the defense theory that she framed her husband for murder.
Reminds them of CA's opening statement. Julie was "delusional" and "angry" You didn't hear that in testimony.
Brings up all the drugs in addition to the EG. Says that the EG wasn’t enough. Asks “who was it that called the doctor saying Julie couldn’t sleep and gets the prescription for Ambien?”. Brings up that Dr Borman did not have notes of Julie having a sleep disorder – that the sleep disorder didn’t even come up until Mark called the doctor the next day. Says that Mark used the Ambien to make Julie more malleable and susceptible to administer dose after dose of EG.
If only she had told Dr Borman of her suspicions. Dr B told you he would never have given MJ the Rx for Ambien
Asks jurors to consider their own experiences with alcohol, how it affects them, how long it affects them and that they should consider their experiences when weighing the evidence of the affects of EG.
Brings up the Ambien again – insinuates it’s ridiculous that Mark went out to get Ambien for his wife who was already sleeping at home. Brings up the theory that Mark drugged her to get her to ingest the EG again.

I have 7 brothers (one passed at age 47 from Scleroderma) and 2 sisters. It was really sad. I didn't realize until today that my brother's best friend had died on my brother's birthday. My brother gave the eulogy and my heart broke for him. His friend died at age 48 so it was a reminder of my own brother's death. Thanks for asking. I'm a bit down this afternoon.

Hmmm, If this had happened I think that the prosecution would have been able to put KJ back on stand or would have had more rebuttal evidence they didn't have before? Wouldn't we have heard that? :0009:
I really dont understand WHY she isnt there to support her LOVING husband.. DOESNT LQQK GOOD for MJ! Maybe because of the media, maybe they are following or harrasing her? Jambois is going to do the rebuttal as well....THIS trial is his project. He waited a LONG time for this to come to fruition....Ms Gabrielle didn't play a big roll in this trial.
Jambois came back from the roads & transportation just for the murder trial. He may have taken a pay cut, too! LOL!!
Ms G was there b/c they required one person currently working in the DA's office to sit in second chair.

I think if she had gotten on the stand and took the 5th it would have shown guilt more than NG for Mark and her too.
But I don't know if the Judge would have allowed the jury to know she took 5th... So that was probably a factor in State agreeing to it... they needed her to say in jury presence what she did about the list etc...she took the 5th out of the jury's presence.

Joolz part 2 with my notes.
Brings up that Mark looked up the affects of EG on the internet as she lay dying. Insinuates that it is ridiculous to think that Julie Jensen herself went to look up the affects of EG poisoning – even says “Gee, should I get up out of my coma to look up why I might be in a coma?”.
Leads into internet usage evidence. Mentions a search for cruises after an email discussion with KJ. Mentions that there is no evidence the computer was used while Mark was at work. Mentions that someone went in and erased all the internet history during the hours Julie lay dying… again mentions that it’s unreasonable to think that Julie got up out of her comatose, cyanotic (sp?) state to erase the internet history.
Jambois puts up an email convo between MJ and KLB on the overhead. Matches the email times to searches on the internet for Winstar Cruises.
Jambois puts up another email convo between MJ and KLB where they discuss the Jan 1st deadline of whether to put a deposit on the cruise. Shows where KLB asked MJ if he’s got it “all figured out” and Mark replied “I think so…”… something about needing to work out the details. Shows where KLB prodded for the details and Mark’s reply was evasive. All this to show that there was a deadline/agreement between them of Jan 1st to decide what to do (go on the cruise?).
He quotes MJ: "Details are just noise in the bigger picture." and Jambois refers to "what passes for wit in this relationship" while going through their emails at this time (16 Oct) and puts them into the context of the internet searches the night before for botulism, pipe bombs, nictoine, and the stifel employee list.
Was there any evidence MJ was looking for a good divorce attorney? No. You saw searches for poisons and botulism.
He never expected a jury to see these searches! He 'd covered his tracks. "Bag hands" --- Mercury fulminate search. "shells" -- shotgun shells. Defazio--- JJ had seen him and that would help in her "looking crazy." And Terri Patentay (phonetic) WHO IS TERRI PATENTAY? HE DID NOT ELABORATE.
The list is gone!
Jambois then puts up some internet searches done shortly thereafter – searches for “underground” stuff, most of which Jambois thinks Mark was not interested in. Says Mark keeps looking and looking until he finds what he was looking for – just after midnight – things about poisoning, pipe bombs, botulism, etc… Points out the next thing Mark goes to is the employee list for the company he was working for. Asks the jury what a person who wanted to end his marriage should be looking for – divorce lawyers, division of property, etc… but what does Mark search for instead? Poisons, drugs, botulism, pipe bombs. Points out that Mark expected no jury would ever see this – that before he turned the computer over to the police he not only deleted but double-deleted the internet history.

she didn't turn...they subpoenaed her,she took the 5th,they gave her immunity,she testified...that happened in the prelim and in this one......the pros knew it was going to happen this way....evidentally the TH wasn't "up" on what had/has happened in this trial.

I have 7 brothers (one passed at age 47 from Scleroderma) and 2 sisters. It was really sad. I didn't realize until today that my brother's best friend had died on my brother's birthday. My brother gave the eulogy and my heart broke for him. His friend died at age 48 so it was a reminder of my own brother's death. Thanks for asking. I'm a bit down this afternoon.

Lie detector results are not admissable I know. But, can Jambois come back and say, Mark never came in for a test in his rebuttal? I hope so because jury needs that cleared, Albee did good with that and reading how many times Mark agreed to do it.

Albee starts by thanking the jury for their patience and attention. Says him and Mr. Jensen really appreciate it.
Begins the CA by bringing up Aaron Dillard. Brings up that Dillard was facing a lot of jail time for his offenses. Goes to the flip chart and shows the Liar, Thief, etc… page. Says AD thought it was pretty funny – says AD thinks a lot of things are funny. Brings up the poor Lithuanians AD conned. Says that AD saw a get out of jail card with MJ and proceeded to formulate the best con of his life – said he recognized MJ from the news, knew of Ed Klug, etc… He portrays MJ as innocently/naively telling AD his story about Ed Klug and mistakes the prosecution was making – such as using Benedryl when the Benedryl in the house was capsules. Says that AD is a known con-man and asks the jury why the prosecution would rely on AD’s story? Why now after all these years?
Asks why did the state change it’s theory and relied on AD? Albee puts up a list on the overhead projector. Number 1: the states original EG theory collapsed when the defense showed Dr. Long’s report was based on a faulty premise; Number 2: that the second EG theory collapsed when they couldn’t prove multiple doses – could not disprove suicide; (missed 3 and 4).
Albee tells the jury should not be fooled by AD’s testimony in this case.
Brings up that Officer Reilly saw Mark Jensen at the scene and he was crying, upset. Reilly had asked MJ if Julie had been sick. MJ tells the officer that he was concerned about her not feeling well, that she was taking too many aspirin, etc… Albee says there was a worry on that first day, the day of her death, that this was suicide. Says the police had suspicions about the letter, about MJ’s worry for his wife, that Julie had told Mark that she did want help (medical).
Brings up the Ratzburg interview. Says the jury saw portions of it, saw Mark deny he killed his wife. Brings up Ratz asking MJ to take a polygraph. Points out that Mark said he was willing when Ratz asked him. Says that after Ratz asked if Mark had hurt her ribs Mark says no and he didn’t want a polygraph to show differently. Jumps by saying that nothing much happens after that – not until 2002.
Albee says in 2002 is when MJ is charged with homicide based on the large concentration of EG in JJ’s stomach. Points out that the large amount was only ½ teaspoon, not a stomach full. Says the state moved forward based on a large amount and it wasn’t until several years later that it was proved it was not.
Albee talks to holes in the state’s case where they cannot disprove suicide. Brings up that Dr. Lavin – the original ME – was fired over this case. Jambois objects that there is no testimony to that. The judge says he remembers something about it and overrules. Albee continues and says that Mainland was brought in knowing Lavin was fired and didn’t want to make the same mistakes Lavin did.
Moves on to Dr. Mainland. Insinuates that Dr Mainland did not want to concede to anything that would help the defense. Says Dr. Mainland had all the data but chose to highlight those things that support the prosecution (e.g. not acknowledging or wanting to acknowledge outlying numbers of EG half-life.

I found the answer:
Mark Jensen might have agreed in his videotaped interview with police to take a polygraph test.
But that test never happened.
And jurors won’t be allowed to know that, Judge Bruce E. Schroeder said.
Polygraph evidence is not allowed in Wisconsin, as Schroeder informed jurors this afternoon.
Prosecutor Robert Jambois agreed that jurors should know that. But he also wanted them to know that, even though Mark Jensen agreed to take a lie detector test, no test was ever arranged; Mark’s lawyer made sure of that.

He never took it. They didn't allow this to come out in testimony, but ya know... if Albee brings it in suggesting his offer to take one shows his innocence, I think it only fair that Jambois should be able to simply state he never took it by advice of his attorney.
