Good morning all, I could barely sleep with anticipation for today.
Hi Kell:basic45:
Same here!!! I was so jacked up last night I couldn't fall asleep and I've been up since 4 AM. Went back and read some of the final posts when Jammy was done and I teared up all over again. He was just amazing. If we don't get a guilty verdict out of that closing; then what the heck does it take these days.
KellBell

I just checked to see if the last video of Jam was up because at the end I had taken my laptop to the kitchen and started dinner so I wasn't glued to it and wanted to see the very end again. Hopefully it will be up later. Gotta go run my daughter to school. I will be back in 30 minutes.

Good morning all you early posters and later ones too!! It's possible I won't be here most of the day but I hope I can at least be here when the verdict comes in!! Actually, I am hoping I won't have to be away at all, but real life calls sometimes.

Good morning!
I know it was a long trial but the choice for the jury is a simple and stark one. And Mr Jambois laid it out for them yesterday: it's either murder and cover up or a suicide and frame up.
I will post more of my notes.

Good morning! Now starts the tortured hours of waiting and hoping that justice is done in this case. Jambois couldn't have been more clear on the evidence. It's there to convict, imho.

I agree! I posted after Jambois finished his closing arguments that it was good but anti-climatic but after his rebuttal it felt complete. He gave it that last little uhmf that it needed to deliver the passion and emotion that it deserved. I thought Albee's closing was flat and non-effective. I hope the jury doesn't deliberate for days. I might have an anxiety attack if they do. Either that or my spring cleaning will be done in a flash.

Good morning Kella, are you paying close attention to the murder in your area, the psychiatrist? I was reading to try to find out if he confessed fully or if he plans to plead guilty. I am just thinking a full trial would be horrific for the family. I fear he may plead insanity. It seems he was institutionalized for most of his adult life, he might be able to get away with an insanity plea. That is scary.

Why do we stand up when you enter and leave the courtroom? It's b/c you are ministers of justice. You are the finders of fact. And the evidence was presented to you as public officers.
KLB's testimony is the stuff that people gossip about. But we did not elicit this testimony to embarrass her or humiliate her or to make you think she is a bad person.
There were reasons why that testimony was elicited. First, what is the likelihood of having that convo about all her past lovers in great detail would not be remembered? And how likely would it occur two years into a relationship rather than near the beginning?
KLB was not telling you the truth. She wanted to minimize when sex began with MJ. At the forfeiture hearing she testified there was one sexual encounter in Oct or Nov. Then when reminded of the penalties for perjury she changes her testimony and says that if you count oral sex there were a number of encounters before that.
After the break he resumed with the reasons for the excruciating detail in the KLB testimony. Her bias. She was trying to get her lies to match MJ's lies to Ratz (no sex before JJ died). Only after she was reminded and she consulted with her atty -- just as it happened in the earlier hearing, it happened here that she changed her story and suddenly the convo could have taken place in 1998.
The embarrassing details of the convo were only brought up AFTER she lied and then when she was told that the date of the convo was a "material fact" is when she conceded the earlier time.
Kelly Jensen was untruthful. Who tipped her off?> You heard the defendant with your own ears in that recorded phone call. "That convo didn't happen in 1998." Trying to get their stories straight. And why? WHO WAS USING THE INTERNET 16 OCT 1998?
It's important to the defense that you not think of the Mercury Fulminate search (10:15? 18?) was by MJ. And "cross wiring pool pum" causing it to blow up. And the nicotine site at 10:36. At 10:46 the office list at Stifel, search for the branch listing search. 10:47 Ron Wruck. 10:49 directory-- John Joseph 10:53 Colorado Springs office John T Jock Joseph.
That's why we went through the list of KLB's lovers. In the fall of 98, the manager's meeting in St Louis, KLB and JJJ.
Weird preoccupation of MJ with penises and comparisons: size, length, girth, shape. Why? Because it revealed a bizarre preoccupation so you will have an insight into the porn stalking which began after JJ's brief affair with Perry Tarica and continued up to the KLB affair.
That last really interested me. Was there no more porn stalking once Mark hooked up with the company mattress? Did his obsessing over her supplant his need to punish Julie? And was it also that he was plotting his ultimate revenge??
Notes to be continued...

I was just thinking about Mark Jensen, Scott Peterson, Darren Mack and David Tarloff. Monsters come in all shapes, sizes and from all walks of life. It scares the hell out of me sometimes when I think that you just really don't know people and anyone you pass on the street or a neighbor or even a spouse has the potential to be a brutal murderer. Something sticks out in my mind about todays article on CNN.com about David Tarloff, a neighbor said something like, they never expected it, he was quiet. I hear that so much in murder cases. My mother always said "it's the quiet ones you have to watch out for" I always thought she was talking about men in relationship to sex but now I wonder...

I was paying attn only b/c it was so close to home and so horrific and scary to think this maniac was running around out there. So we are all grateful to NYPD for a quick resolution. I expect David Tarloff will be locked up for the rest of his life and it's sad that our system is such that someone has to do something so egregious before action is taken and it can't be prevented. I feel bad for his family.
I anticipate his CDA will go for insanity and there is evidence of mental problems in the past. All I care is that he's never out.
That is not the kind of trial that interests me, though. I will look to the outcome, but if NYS had cameras in the courtroom, it's not the kind of trial that I like. I like the domestic CE cases like Jensen and Peterson East and West. My cup of tea.
Strange tea.

I wondered why Jam didn't focus more on the fact that Mark had terrorized Julie for 7 years with the stalking and if he was capable of that then imagine what he was doing with making Julie think she was crazy about other things, like making her fear for her life by leaving scary list around, syringes, computer searches, threatening to take her children or worse, hurting them, God knows what else. I wouldn't put anything past him. The mental and psychological abuse he put her through was horrific. I would take a beating over that any day. Some people don't understand abuse if it isn't physical. They often go hand in hand but sometimes it is only mental and psychological. In my opinion, the mental is worse.

I totally understand and agree, I don't get into the other type as much either. A simple "crazy man" serial killer is far different from the every day joe turned murderer. I can't begin to wrap my mind around a serial killer who does it for sport but the husband, like Jensen and Peterson intrigue me and make me want to get inside their head and figure out what makes them tick.

Regardless of how I feel about his defendant, I feel Albee put up an excellent fight for his rights. And deservedly so, unfortunately. I have always had a hard time dealing with rights of killers vs rights of their victims. IMO Mark Jensen disregarded his victim's rights and should be thrown in jail and the key lost to his cell. It's easy to think the rights of the victim's families should supercede the rights of the murderer. But, how do we know for sure a defendant is really guilty unless we hear all the evidence against them or they openly say, I did it.
I do believe Albee had a good strong CA. He did ramble a bit there at the end and should have closed at least 15 minutes before he did but he could have caused a juror or two to think, that makes sense.
I just hope if he did, that those who are leaning toward defense aren't on the seated 12. I hope the jury goes into that room, discuss the whys of how they feel and come to an agreement of guilty as charged. Julie deserves justice and her family deserves closure.

I took this quiz on-line; where you went through about 3 pages of sex offenders. There were maybe 50 pictures in all. And you had to check a box under the pic if you thought they were a sex offender. While I didn't do to bad on the quiz; I was astounded at some of the pics I missed. Just looking at them; I would never have thought they were sex offenders. It was really an interesting quiz.

continuing with discussion of the porn stalking...
There was one photo with writing on it -- "Is his as big as mine?" Who else would pose such a question? Who else had the motive to do this?
"the illustrious Dr Spiro, offensive in bias and manner and arrogance..." (Sorry! I was so entranced by his characterization of Dr Spiro that I didn't write down the rest!! Oops!)
Dr Borman was a good source information...And talk about people being bought and paid for! Aaron Dillard at least admitted he was!
Dr Spiro -- this expert knew what tone of voice LK would have used had that convo taken place! This hired expert tells you what was goin on in Julie Jensen's mind. And the source of the information he based that opinion on is sitting right her. The man who murdered her!
He told you JJ "was delusional." Dr Denton was hired by the defense but had to concede the truth. He was deeply alarmed by the (OWN DRUG SUPPLY) list. JJ showed the list to Kosman and to LK. It's unfortunate she didn't show it to Dr Denton. And remember what LK said to JJ "You have no idea what he is capable of."
Remember the testimony of Ed Klug. I never heard of him until July 07. OBJECTION! EK told you he didn't come forward because he was so afraid of getting involved. MJ was his boss.
Ed Klug HAD NO MOTIVE TO MAKE HIS TESTIMONY UP. He told his wife of the convo with MJ at the time it was happening. And you had the testimony of Ron Wruck who saw EK the next morning, disheveled and EK said, I've been up all night with MJ talking about killing our wives.
Think of all the people who have to be lying for MJ to be innocent. Ed Klug, Joanne Klug, Ron Wruck, Stacy Bauer, Quin Yorton... And even Dawn Cooper corroborates the drinking and spouse bashing. MJ didn't tell EK what he did until after she left.
MJ loves to talk. He talked in the county jail. He talked to EK. He was drinking and thinking about JJ, because he had poisoned her. He was calling her, checking on her to see if she was dead yet.
And Joanne Klug has the better memory. Wives often do. But she was not drinking that night. Ed was. And what of EK's demeanor? Did he appear to be lying? He had a reason to be ashamed for having the convo and not coming forward but he had no reason to make it up.
EK's testimony was corroborated by unbiased witnesses. EK's testimony was a dagger to the heart of the defense's case.
While you are listening to Mr. Albee, a fine attorney, and you are thinking "this is ludicrous" -- remember: he is stuck with the story that JJ committed suicide and framed her husband.
Wait for the part where he explains where JJ's anger and vitriol is. Where is the evidence of such a devious nature?
What is her motive to leave her children motherless and fatherless?
Ask yourselves. Where is the sense?
To frame someone using a poison which causes a horrible slow death.
That isn't typically found at autopsy.
And erasing references to it in the computer.
Where is the capability to get up and go to the computer and look up "cyanosis" "tachycardia" and "coma"?? How did she get up out of bed on 3 December -- "Am I in a coma?" Who is looking up the symptoms and progression of the illness to see when she's is going to die? And who is erasing those searches to cover his tracks? The defendant.

I disagree, Tigress. I don't think he had a good strong CA. He rambled and rambled all over the place and any chance he had, imo, was destroyed by his verbal diarrhea and his mistatements of fact which offend juries.
His two big experts, Spiro and Rumack, were exposed as charlatans. To act like they were unbiased scientists was absurd. His one honest witness, Dr Denton, was turned around to the State's side when all the evidence not given to him was presented.
I don't think that Albee had a lot to work with but he blathered away any hope he had.

Believe it or not, I think it's good for an attorney to leave a few points out of the CA. For example, Mr Mangi's testimony. One or more of the proponents of guilt will raise that, and the flirting and fun at the Christmas party, as examples of MJ's callousness and uncaring. Jurors love to put the puzzle pieces together.
I was once on a jury for a case in which the defendant testified. I pointed out two things he said which were completely illogical to his defense and made no sense with the physical facts. At the start of delibs I was only one of two who thought he was guilty (5 NG and 5 undecided) but by the end, at the mistrial b/c of the stealth juror, we were 10 G and just the 2 NGs, one being the stealth and the other a wingnut who was listening to her. We could have had a verdict had the stealth juror not lied her way onto the jury.

Any defense attorney can only spin the evidence against their client. Really, all they are doing is making sure the State proves their case. I liked Albee and didn't have a problem with his actions in the courtroom. He was, after all, fighting for the rights his client deserves. It's what this country is built on. Our rights.
I never consider a defense attorney as anything but brave. Some, are lousy lawyers and don't fight a good battle for their clients. I've seen trials where i felt that. Some are better than that, others are superb. On a 1 - 10 level. I'd say Albee is a 7.
Albee's CA obviously worried Jambois or he wouldn't have given such a long rebuttal. He too, rambled some there at the end of his rebuttal, but not so much to lose my interest in what he was saying. I stayed alert to both lawyers.
However, I will say. May the State win this case.

my notes, as far as I went, of Craig Albee's CA.
If he spent, he said, 5 mins talking about each day of the trial, that would take up his entire 2 hrs. So he would hit only the highlights.
On Aug 14, 2007, Aaron Dillard arrived at the Kenosha County Jail. Albee goes to the easel and gets out his "liar convict conman" chart.
AD thought a lot of things were funny. Had no remorse. And he found his Get Out of Jail Free card when he met MJ. He knew who he was. He knew about Ed Klug. He read the EK TS.
Why be receptive to AD? Why come up with a new cause of death? Why was MJ charged if they didn't know it? Why did they change their theory?
The States' original EG theory collapsed. The second EG theory lacked scientific basis to exclude suicide. JJ was suffering from depression. And she had no reason not to seek help.
The prosecution's "gambit" at the 11th hour-- They ask how could AD concoct this story? Robert Jambois said in his OS- "I don't know." AD got Ratzburg's TS at the same time as EK's TS.

Actually David is 18 now and from what Pinky and I investigated the other day he may have his own apartment. MAY, not positive on that but there is a David Jensen that has an apartment in Plesant Prarie. He turned 18 last month.

Regardless of how I feel about his defendant, I feel Albee put up an excellent fight for his rights. And deservedly so, unfortunately.
<snip for space>
I agree with most of what you wrote. I think Albee did what he could and kept an eye on MJ's constitutional rights. I did not like some if not most of Albee's tactics but, again, I guess he really didn't have much to work with as far as defending his client.
I don't think Albee's CA was all that great. True, I think he may have made a point here or there to cause a juror to pause and hesitate but he focused too much on Dillard IMO. I think the jury may have walked away with the impression "is that all he's got?". But I guess we'll see. I don't think the verdict will come back as quick as most people here are hoping. I think it's going to be at least 3 days.

I feel so sorry for the boys. I think the younger boy is probably humiliated by his dad's obession with wieners. The 17 year old I'm sure is having a hard time, but I remember my son at 13 and how sensitive he was. MJ really makes me ill. This case has caused me lose sleep. I can't imagine being related to that monster, let alone having him for a dad.
I've been so upset the past few days. I'm absolutely terrified this man is going to get away with this. I don't know how to express how much this case has upset me. To my very core.
I see Julie's face and it breaks my heart that for the last 7 years of her life she tried so hard to be the best wife and mother she could be, to make amends for her mistake with Perry. And all along that creep was torturing her. The fact that she died not knowing that Perry really cared for her and that he would never have done such a horrible thing to her is just one more terrible fact in this case.

MJ told _____ (didn't catch the name) that JJ "didn't want help." You saw the Ratz interview. Ratz asked MJ to take -- p 125- a polygraph and MJ says "yeah." And he reads the times he's asked and agrees to a polygraph test. Several times he said yes to a polygraph.
11 Mar 2002 we have Dr Long's 3 pp report stating there was a "large amt" of EG in JJ's stomach. Days later MJ is charged.
There is "so much evidence" about JJ's depression and suicide.
There's an aha kind of moment based on Long's report. Defense experts point out it wasn't a large amt, it was a half teaspoon and that could be residual or leftover in a glass. There is "nothing that shows this is a homicide."
Aug 07 there are holes in the pros. case. What if defense experts hadn't been competent enough to discover Long's mistake? And then he mentions the many "wrongful convictions" that happen and innocent defendants are wrongfully convicted.
Dr Lavin was fired over a dispute in this case. OBJECTION. overruled. Dr Mainland didn't want the same thing to happen to her. There is not enough EG research. And Dr Mainland is biased.
In her testimony about the 3-5 hr half-life of EG and the extreme low amout of EG that is lethal that she used, she showed her bias.

So true, about killers. They walk invisibly among us.
We had an employee years back. A young man in his twenties. Pleasant, but not outgoing. Nice, sort of shy, but nice. No problems with attendance or his work.
He worked for us a couple of years, and then quit.
The next time I heard his name was on the television. He'd gone into a McDonalds in Beloit Wisconsin and shot and killed several people, then shot and killed himself.
I couldn't believe what I was hearing.
He was pleasant. Good worker. Pleasant.
And he was a killer.
I still reel from that.
There was no explanation as to "why."

"No reason to lower the bond" and yesterday he was talking about rescheduling any retrial that it would prolly be after the appellate courts settled the matter of the admissability of JJ's letter, and the dying declaration complicating matters.
Yesterday he was indeed trying to get the defense to go along with the keeping of the alternates.

Wisconsin posters--- perhaps contacting your state reps to change that statute is in order. I have never ever heard of any case where alternates are not held during delibs esp. in a long case where delibs might be protracted. That is sooooo stupid.
It is stupid..like the judge I am writting my representitive.....Defense is praying for a mistrial  :howdy:

I feel so bad for the alternates who get sent home. Can you imagine? I'd REALLLLY want to stick around to have my say in THIS one.
A few years ago as an alternate I sat through a malpractice hearing for a week. When this case went to the jury for deliberations I was sent back to work and had to provide at least two phone numbers where I could be contacted if something happened to one of the jurors and I needed to replace him/her. I found this experience to be annoying, frustrating and even somewhat stressful as I wanted my say in the outcome of this case, or at the very least to be there for the verdict, especially after sitting through the hearing for a week.
I didn't learn the verdict until months later when I ran into one of the jurors at a gas station and asked her about the outcome of the case. BTW-I wasn't happy with the verdict. :girl_sad:

First thing, the jury explodes with the relief of being released from the admonition of not talking!! Laughter is sometimes heard from the jury room. There first task is to select a foreperson.
Let's hope they choose wisely b/c that choice can affect the delibs if not the outcome.
They have gotten to know each other over 6 weeks -- and I just thought of LauraLee and her brother. Is he on the jury?? --- and they should know which personality is the one to be the foreperson.
The bad ones have been the big big big notetakers. The MD/JD on Peterson, the engineer on Spector. Both of those were like court reporters creating their own TSs. They were HORRIBLE forepersons!!
The best ones are the middle children. The negotiators, the facilitators who are good at talking to both sides and getting delibs on track. That's who is best picked.
Ooh, Marky looks happy. Does he think he's going home soon?

I'm hoping that WISN just keeps the clock up all day... and I will keep the volume up... and hopefully will hear if anything happens. Too bad we can't all register for text message alerts on the this!

ITA!
The jury is asking for a list of the evidence.
We can make a list of the facts for which there is no innocent explanation.
I'll start:
11 days after Julie's death and his computer was seized, MJ told Dr Borman that "Julie called for the Nicotrol."
Why would she double erase the computer searches if she is trying to frame Mark? on the day she can barely speak or walk?

Crud; I missed that too. They sure picked a forum fast; didn't they?
My guess is after spending 7 weeks together you can kind of "feel" who the leader will be.

The judge said there is another Judge coming into that courtroom. So, I'm thinking we have to rely on TTV or Wis. news site.

Another NO INNOCENT EXPLANATION FACT:
The incriminating searches were double deleted when JJ was laid up in bed and dying. MJ could have done it and had the motive. JJ could not have done it and had no motive.

Morning grammy- Yes, that was fast.
I wanted them to take a vote and have it be unanimous GUILTY in the first 5 minutes. Can you guess what the first word out of Albee's mouth would be?

Why don't they let us watch the next court case? :girl_haha: The clock's still up. :love0085:
They just need to turn the mics back on & let us watch while we're waiting on a verdict. :girl_haha:

Time to shower. I rolled out of bed and stumbled into the office--but I need a shower to wake up.
I trust the jury won't come back before I get back. lol.

You know, after looking at all of the pictures, there seemed to be many happy times and makes you wonder how a family with so many happy times goes so wrong. You see all of the smiles and it just doesn't make sense to me. life is strange I tell ya!!! JMO:1187603408.CR.Mothe
