I hope today is the day! JUSTICE FOR JULIE!
The clock is around 14 hours 7 minutes.
The jury is being thorough and they are talking. That they went late said "progress" to me rather than "deadlock." Had they been at loggerheads they might have quit and gone home to regroup and start fresh today. That they instead continued lends credence to the hope that they thought they were relatively close.
I can't wait to see the smirk wiped off Jensen's ugly puss.

Just reading through the thread that went on without me last night and I read so much anxiety and even despair.
Given recent mistrials for obviously guilty defendants, I understand the anxiety as we worry about the possible wingnut who might hold out and cause a hung jury. I have long acknowledged that is possible.
But peeps have been talking about an acquittal! And I just have to try to talk them down off the ceiling and reiterate my utter conviction -- ahem -- that that is just NOT GOING TO HAPPEN.
The worst that could happen here is a mistrial, Mark would remain in custody and then there would be a retrial. No trips home to celebrate in the driveway with Kelly humping his leg. He is not Phil Spector.
And we do not know what they are talking about back there. But you have to know that there are not TWELVE wingnuts ignoring this Everest of evidence! One or two, perhaps. Not all of them.
And where is the evidence to support the LUDICROUS defense of Suicide and Frame Up? Any scrap came out of the mouth of a Jensen or a paid Jensen hack.
EVERYTHING else points to Murder and Cover Up and Mark as the perp.
Yesterday I was trying to create a list of all the facts that have NO innocent explanation. The defense cannot get around these:
Mark did not call 911 despite her condition, despite the doctor, his son, his coworker's advice.
How can that be consistent with anything but GUILT?
Mark called the doctor 11 days after JJ died (and his PC was seized) to say "J asked for the nicotrol."
Why would an innocent man do that?? He would not.
Julie was DYING on Thursday morning. We know that b/c she DIED! And yet the defense wants the jury to believe she crawled out of bed to double delete the incriminating internet searches with which she was using to frame her innocent hubby.
Only one person had a motive to double delete those searches. Mark.
I could go on. Everywhere you turn, there is INCRIMINATING EVIDENCE. It is everywhere including from the mouths of defense witnesses.
What the jury requested last night from Dr Borman's notes was his instruction to Mark to take Julie to the ER if she deteriorated. Did he? No.
And let's not forget. SHE DID NOT SMOTHER HERSELF.
His guilt is so plain to us. It will be to the jury. I feel more confident than I did during the very nerve-wracking Scott Peterson deliberations where we didn't have a camera in the courtroom. And there were juror substitutions, and let's not forget Justin Wingnut to make everyone crazy. And yet they saw reason. And it wasn't that hard for them once they got rid of the JD/MD.
Take heart. Have faith. The jury is prolly more like us than not. And you can be sure that there are at least --- AT LEAST -- 8 or 9 of us on that panel judging a very guilty and DETESTABLE man. They will remind the minority that they are to search for the TRUTH not a doubt.
And we KNOW the truth. Soon will come the reckoning.

I've only been following this trial through your threads here, but IMO I don't see how anyone with common sense could find him anything but guilty.

Of course you are right, roamer. There is nothing to point to innocence, just smoke and mirrors to try to obscure the incriminating evidence.
With such a long trial and so much media attention about one of the biggest decisions in one's life a person is forced to make-- we cannot begrudge them the time to do it right and to their satisfaction. To know in their hearts they deliberated fully and fairly.
We forget because we have been deliberating now for 7 weeks, since the beginning. They were not given that luxury. They have only had 14 hours to talk about it.
Yes, we are concerned about mistrial. But do you think these regular folks in dairyland, salt of the earth types, are gonna go for "Julie killed herself and set Mark up" piffle? No way!

Anybody know when they will start this morning. I collasped last night before they did. I'm with you, Kella. It's only day 1. How many days was the Michael Peterson jury out? They had a lot of piffle to work through (although I couldn't see it), but they came back with the right and just verdict.

I am struck by something Jambois wisely told the jury-- in order to believe the defense they would have to believe that Julie was not only depressed enough to commit suicide, she was VINDICTIVE enough to frame her innocent husband and orphaned her young sons.
That is just not believable. There is no evidence to support that at all.

Also had never seen this done with jurors, this totally confuses me, what is the point in having alternates the whole time, only to release them when deliberations start?
I'm still saying they will come back with a Guilty.

Must have been a serious Defense Attorney lobby in WI to get that law passed. It makes no sense to release the alternates...but most defense attorneys don't make sense either.
Maybe they slept on a verdict last night. I still think they are close because of the late hour. If you had a deep valley to overcome, why would you stay and fight until 11 at night when you know you can just start again the next morning?

Had a great time they are 3 and 5, was so cold here they couldn't go outside, so we stayed in. To say the least they have lots of energy.
Heard bits and pieces of Albee, glad I didn't have to suffer like the rest of you did.

I remember when my niece and nephew were those ages, and yep...energy to spare. They grow so fast! My nephew's a freshman in college this year.
I'm ready for a verdict. I have no doubt that when we do, it will be guilty.

Iffy, if I read the thread late last night, the judge decided NOT to release the alternates. He read the statute (which needs changing tout suite! What a stupid law!) and was threatening to let them go but changed his mind. Yeah. Judge Seesaw. Go figure.
Your posts this morning are very sensible, as always. Everybody calm down. It's not a long time, not really. Not when you compare it to the deliberating time we have had.

Can't believe I'm gonna get to be here this a.m. when this starts again. I was supposed to be at dr. office but his office called at 8 this morn to say he's sick and so we have to reschedule. Honestly, folks I didn't pray for him to be sick. Really I dint!
Now I just have to wonder how much more will we see the fireworks fly in that courtroom today. Trying to figure this Albee out. Wouldn't common sense tell ya that disrespect doesn't get ya very far. I've just never seen anything like him.

Boy, Albee really brought out the pizzy puppet last night, didn't he? He and Judge shouting at each other. Mark may be smirking but Craig has the better grip on reality and he knows the only hope he has is his beloved mistrial.
The most pro-defense THs yesterday were not sanguine about Marky's hopes. That MJ is still yukking it up shows that the delusional one is and always was HIM.

I went over to IS this morning just to peek around. Their poll reflects about 90% G.
And I read a couple of posts from one of the DFs claiming that part of the "exonerating evidence" is that the incriminating internet activity of Dec 2 and 3 "was not deleted" but left to be found.
And that evidence of asphyxia was never found in the autopsy.
What contortions the DFs have to do to dredge up "facts" that exonerate their skeevy little freakish hero.
And forgive me for patting myself on the back, but I am very proud of having named the formerly "NGs" with their true and just moniker: DEFENSE FANS. The term has stuck and I am delighted. Even they have embraced it which is pretty funny, actually. Shows how deluded they are not to understand the siteeation.
Let's get goin' already! I want a verdict this morning!!!

Boy are they not paying attention!! The quick pull up on 3rd was deleted! After all those arguments over who was at computer that morning how could anyone say differently? And the evidence of smothering is in the bruising behind the neck from the pressure place on it. (Forget the name the doc called what was bruised) and the bruising on the ribs!

When a verdict of guilty is reached by these twelve jurors and no substitutions are needed, then there will be no grounds of appeal on the alternates.
I am wondering if maybe Judge Schroeder has consulted some colleagues. I can't imagine any of the judges like the stupid statute which ties their hands vis a vis the alternates.
He has few choices:
follow the letter of the statute and release the alternates and risk a mistrial
keep the alternates for use if any of the original jurors drop out and in the event of conviction, risk reversal on appeal
He may have decided not to tempt fate on the former and go with the latter, knowing that his decision will be reviewed and that it will prevent a mistrial for now, anyway.
And it may be that he and his fellow judges want a case to test this statute. An appeals court could look at the judge's situation and agree with his decision to keep the alternates and not guarantee a mistrial, forcing this idiotic law to be struck down.
I don't know. Just speculating.

Good question. IIRC It took this long to gather evidence to charge MJ in 2002 then again in 2004. It took a long time to get the toxicology reports and get the letter admitted into evidence. Also they didnt have a definative COD. When Dillard came fwd the case (getting cold). Ed Klug didnt come fwd until 2004 also. Then MJ was arrested again and did not make bail this time. I may have the dates wrong but I am close. Someone please ring in here .......... I am sure I forgot lots of stuff but here is some... :waitasec:

Your question isn't stupid. They suspected Mark had killed her but didn't have enough good evidence to go to jury. After Klug came forward the ball began to roll, then after they arrested him the inmates strengthened Klugs statements.

Morning all It was a long night and the alternates were not dismissed. the way I understood it was if the judge put a time limit on the jurors and made them stop at a certain time he would have to dismiss the alternates but if the jurors said they want to quit for the night then the judge can keep the alternates and have them come back also. I hope that makes sence Albee tried to fight the judge all night he wanted the judge to give the jurors a time limit and that is when the Judge lost it with Albee and told him I am not going to have a mistrial.There fore 19 jurors will be back this morning. now I have to go feed Cody and let him out. bbl:love0085:

But the short version is that Julie was murdered in Dec. 1998. Mark was not arrested until 2002. In the years since, until last summer, he was free on bail.
Murder defendants out on bail have one goal: delay, delay, delay.
Many rulings had to be made. Court dates were set and changed. The trial did not happen--- quite a coincidence --- until Mark's butt was behind bars and delays no longer suited him.

Ed Klug came forward in 2007....Mark has been in custody since last August.
The battle over admitting the letter went all the way to the Supreme Court.
There were significant Albee delays during the period while Mark was out on bail.

mainly due to the litigation required to get Julie's letter in to evidence. They took the fight to the WI supreme court, I believe. It was hearsay, but the court ruled that if the *accuser* (Julie, in her letter) wasn't around to be confronted because of the actions of the accused, it could be introduced.

Yep. All 19 come back this morning and the alternates were admonished with same restrictions as the seated 12 were.
I wonder if any of the 19 took the motel/hotel gift. And will come to court wearing same clothes as last nite. Can hear it now, call home. Hon, I need you to drop off my clothes at a Hotel Jury Stay because I couldn't drive last nite. Bring undies!! :girl_haha:

What a day we had yesterday!
I really understand why the judge is so concerned about something happening to one of the jurors. It has been apparent for a while now, that he thinks that Mark is guilty plus he knows a lot more than we do. If the Jensens' were willing to pay to have Klug "sat on", they are capable of doing about anything.
I do NOT trust Dan Jensen. I'm not so sure about Kelly at this point, but I wouldn't put it past her. She and Mark are some kind of sick and twisted soulmates. I do not believe that Albee would be involved directly, but I'm sure...for a price...he would defend them with all his heart.
I feel like $hit and I look like $hit. My eyes are still crossed. I doubt there is enough coffee in the house to fix this mess. But I am off to check anyway.

Yep. All 19 come back this morning and the alternates were admonished with same restrictions as the seated 12 were.
I wonder if any of the 19 took the motel/hotel gift. And will come to court wearing same clothes as last nite. Can hear it now, call home. Hon, I need you to drop off my clothes at a Hotel Jury Stay because I couldn't drive last nite. Bring undies!! :girl_haha:

Just reading through the thread that went on without me last night and I read so much anxiety and even despair.
Given recent mistrials for obviously guilty defendants, I understand the anxiety as we worry about the possible wingnut who might hold out and cause a hung jury. I have long acknowledged that is possible.
But peeps have been talking about an acquittal! And I just have to try to talk them down off the ceiling and reiterate my utter conviction -- ahem -- that that is just NOT GOING TO HAPPEN.
The worst that could happen here is a mistrial, Mark would remain in custody and then there would be a retrial. No trips home to celebrate in the driveway with Kelly humping his leg. He is not Phil Spector.
And we do not know what they are talking about back there. But you have to know that there are not TWELVE wingnuts ignoring this Everest of evidence! One or two, perhaps. Not all of them.
And where is the evidence to support the LUDICROUS defense of Suicide and Frame Up? Any scrap came out of the mouth of a Jensen or a paid Jensen hack.
EVERYTHING else points to Murder and Cover Up and Mark as the perp.
Yesterday I was trying to create a list of all the facts that have NO innocent explanation. The defense cannot get around these:
Mark did not call 911 despite her condition, despite the doctor, his son, his coworker's advice.
How can that be consistent with anything but GUILT?
Mark called the doctor 11 days after JJ died (and his PC was seized) to say "J asked for the nicotrol."
Why would an innocent man do that?? He would not.
Julie was DYING on Thursday morning. We know that b/c she DIED! And yet the defense wants the jury to believe she crawled out of bed to double delete the incriminating internet searches with which she was using to frame her innocent hubby.
Only one person had a motive to double delete those searches. Mark.
I could go on. Everywhere you turn, there is INCRIMINATING EVIDENCE. It is everywhere including from the mouths of defense witnesses.
What the jury requested last night from Dr Borman's notes was his instruction to Mark to take Julie to the ER if she deteriorated. Did he? No.
And let's not forget. SHE DID NOT SMOTHER HERSELF.
His guilt is so plain to us. It will be to the jury. I feel more confident than I did during the very nerve-wracking Scott Peterson deliberations where we didn't have a camera in the courtroom. And there were juror substitutions, and let's not forget Justin Wingnut to make everyone crazy. And yet they saw reason. And it wasn't that hard for them once they got rid of the JD/MD.
Take heart. Have faith. The jury is prolly more like us than not. And you can be sure that there are at least --- AT LEAST -- 8 or 9 of us on that panel judging a very guilty and DETESTABLE man. They will remind the minority that they are to search for the TRUTH not a doubt.
And we KNOW the truth. Soon will come the reckoning.

I am struck by something Jambois wisely told the jury-- in order to believe the defense they would have to believe that Julie was not only depressed enough to commit suicide, she was VINDICTIVE enough to frame her innocent husband and orphaned her young sons.
That is just not believable. There is no evidence to support that at all.
True, and that SO MANY people would have to be lying in this case for Mark's defense to be true.

I think we have a holdout and that is why all the evidence is being called for. The stoic he's guilty ones is trying to drum some sense into that person or plural version. Iffy, if I read the thread late last night, the judge decided NOT to release the alternates. He read the statute (which needs changing tout suite! What a stupid law!) and was threatening to let them go but changed his mind. Yeah. Judge Seesaw. Go figure.
Your posts this morning are very sensible, as always. Everybody calm down. It's not a long time, not really. Not when you compare it to the deliberating time we have had.
Yeah I DO NOT understand what happened with that. He said over and over that he is bound by the statute to dismiss them unless the attorneys stipulated (which I never heard them do) and then he kept them. It must have something to do with if he forced them to stop deliberating and go home for the day then he has to dismiss them, if they stop on their own then the alternates stay. That is the best I can come up with. Maybe we will get some clarification.

That is a good question, I think it is a combination of alot of things. There are many trials that take a while from the time of the crime until the court date. One big thing was that they had to take the issue of Julies letter to the Supreme Court which took some time. This is a complicated case and they have really made sure they have their ducks in a row.

Your question isn't stupid. They suspected Mark had killed her but didn't have enough good evidence to go to jury. After Klug came forward the ball began to roll, then after they arrested him the inmates strengthened Klugs statements.
Actually they arrested him in 2002, he was released on bond and then Klug didn't come forward until July 2007. IIRC

Good question. IIRC It took this long to gather evidence to charge MJ in 2002 then again in 2004. It took a long time to get the toxicology reports and get the letter admitted into evidence. Also they didnt have a definative COD. When Dillard came fwd the case (getting cold). Ed Klug didnt come fwd until 2004 also. Then MJ was arrested again and did not make bail this time. I may have the dates wrong but I am close. Someone please ring in here .......... I am sure I forgot lots of stuff but here is some... :waitasec:

We were worried about Mikey's jury, too, though Kindee. It was so clear to us. They came back with the right verdict. I think these folks are more like the Durham jury than Spector's. I didn't follow the Orange trial.

Morning all It was a long night and the alternates were not dismissed. the way I understood it was if the judge put a time limit on the jurors and made them stop at a certain time he would have to dismiss the alternates but if the jurors said they want to quit for the night then the judge can keep the alternates and have them come back also. I hope that makes sence Albee tried to fight the judge all night he wanted the judge to give the jurors a time limit and that is when the Judge lost it with Albee and told him I am not going to have a mistrial.There fore 19 jurors will be back this morning. now I have to go feed Cody and let him out. bbl:love0085:

Well, since I haven't heard trutv ppl talk about it, I looked up the law on alternate jurors in Wisconsin and here's what I found:
Alternate jurors dismissed or retained
Before deliberations begin, alternate jurors are either removed and asked to remain in the event of the illness of a deliberating juror, or alternatively, they are dismissed from the jury. If the alternate jurors are dismissed, and one of the final twelve jurors becomes ill, is involved in a car accident, or cannot attend deliberations for some other reason, a mistrial is declared. A court can dismiss some or all of the alternate jurors.
Now who can disect what this means?

It was the plot to "sit on" Klug that ended up in bond being revoked for Mark.
And a new judge took over the case and relooked at everything and raised his bond. I think the new judge helped a little too.

I agree. I'm concerned with what the jury has requested simply because of what it is, it's like they are trying to prove their point to a holdout.
Like the Docs note in her records that they said wasn't discernible and wanted to know if he could be asked about it.

Yep. All 19 come back this morning and the alternates were admonished with same restrictions as the seated 12 were.
I wonder if any of the 19 took the motel/hotel gift. And will come to court wearing same clothes as last nite. Can hear it now, call home. Hon, I need you to drop off my clothes at a Hotel Jury Stay because I couldn't drive last nite. Bring undies!! :girl_haha:

Real Life calls me today requiring two forays out into the world. One midday for about a half hour.
The second midafternoon for about an hour and a half. With my luck, that's when the verdict will come in.

I think I'm still in :shock: this morning and getting quite emotional. 14 hours of deliberations. Think about it. In a normal trial; that would be 2 days of deliberations already; if not more. No doubt in my mind there is a hold-out engineer!!!!
My only hope is that they reached a decision late last night and went home to sleep on it. If, when they get there, and start asking for more evidence; I think we are going to see a hung jury.:mad:

I went over to IS this morning just to peek around. Their poll reflects about 90% G.
And I read a couple of posts from one of the DFs claiming that part of the "exonerating evidence" is that the incriminating internet activity of Dec 2 and 3 "was not deleted" but left to be found.
And that evidence of asphyxia was never found in the autopsy.
What contortions the DFs have to do to dredge up "facts" that exonerate their skeevy little freakish hero.
And forgive me for patting myself on the back, but I am very proud of having named the formerly "NGs" with their true and just moniker: DEFENSE FANS. The term has stuck and I am delighted. Even they have embraced it which is pretty funny, actually. Shows how deluded they are not to understand the siteeation.
Let's get goin' already! I want a verdict this morning!!!

I know. I don't understand it. He'd have bigger chance of having to defend even more evidence if it's a mistrial. State knows his case now. And they could battle harder, have more brought in to disprove his allegations.

Feeling the pull of Real Life here. I am recognizing how sucked in I get, how invested and emotional, how much I obsess over just verdicts and every little scrap of evidence...What suffers is everyday stuff. So many things that don't get done. So many times I hate leaving the puter b/c of this dang trial!
So I don't want to know about Shawna Nelson. I don't plan on following that trial. I am going to go with a bit of freedom from courtwatching. Another trial will come along down the road that sucks me back in.

I had strong feelings of her innocence also. But, I wasn't a 100% sure of it. I woulda been a holdout on that jury. I want to watch trial 2.

So Dillard came forward before Klug? I thought it was vice-versa.
No Klug came forward in July 07 then Jensen went to jail in August 07 and then while in jail he ran his mouth to Dillard.

Mornin Corn - ITA. It's totally name calling. We are either guilty or not guilty. I remember how torn I was on the McCowen case. I was a not guilty on that case. IIRC, the board was split 50% on that trial.

We have 30 minutes until jury arrives. I think they go directly to begin deliberating once all 12 are in the room, and not come into courtroom. But, Albee will have something in his agenda to put Judge on bench so we will hear what everyone is doing. :67302:

He refused to dismiss any of them. They are all being held in a separate room while the jury deliberates. The alternates will also be back this morning. Judge said he was not going to take a chance with a Mistrial if one of the jurors fell ill; etc.

Yes there is a big difference between a not guilty or a fence sitter and the defense fans. Like that lisa no matter what is proven as fact she will turn it around to fit her agenda or whatever.

i was in the MM trial. but that was before i found the boards. my daughter and i watched the trial on spring break and we both we're DF and fense sitting right to the end.

Oh my gosh. Lisa just said there's lots of testimony they haven't been able to show because of how late the court has gone each day. Hmmm...are you sure about that? Don't think it has anything to do with the fact that the THs constantly interrupt and the network stops airing things at 3 in the afternoon EST. How stupid do they think we are?

My sister lives in the area and is an administrator within the school district there, and these kids were HS students. Apparently they figured it out when neighbors complained about cars speeding up and down the street...because the motherless house had become a 'party house'. I think the story was that a girl was upset with her mom over something and decided she wanted her dead. I can't remember for sure, but I think it was the friends who carried out the deed.

Did anyone ever figure out the alternate thing. If the judge sent the jurors home the alternates would have to be excused but since he let them stop when they wanted to stop the alternates stay? :confused:
I posted the law a few pages back and asked for any input, but I don't think I saw any. Pgs are moving fast again though, so I need to go back and check. I think there's a difference in releasing them because the day is over and dismissing them because their service is no longer needed. I believe the judge's biggest frustration is that Albee won't agree on a number of alternates to keep so the judge is left to decide to keep all or none. I'm just trying to think this through. Really wish Jean C would explain it on tv.

Corny, I see you have confused NG and DF.
Non DFs may land on either side of the fence or even sit on it.
A DF never sees or acknowledges one incriminating scrap of evidence against the defendants.
There is a big difference.I haven't confused what you mean at all...I'm not stupid...I know exactly what you mean and I don't agree with it.....I think if anyone is going to be labeled it should be G or NG...and not for all trials-just the one going on now.......some of the people you say are DF's during this trial may NOT be in another trial...same as you say you'd never be. I just don't like labels.

That's why I don't really like calling names cause someday I mite be what I'm calling them today....and us calling names makes us no better than they are......I prefer NG's and G's.
I totally agree with you but is it possible that there are G's NG"s and DF's A defense fan I interpreted was someone who will always say NG no matter what the facts are, just for the sake of being a DF. Just my take on it.

A DF is oogle and lisam and ryban et alia and remember that woman during PS who went challenged about evidence would say "asked and answered!"?? THOSE are DFs!!
DFs are not interested in the truth or in debate or in the evidence. They are there to cheer on the defendant and maybe stir up some trouble.
I don't believe mitch, that you were ever a DF in any trial. An NG? Yes. But not a DF.

That's the one. I'm not sure what the status is on that.
The last I heard was last month when the Judge met and questioned all the jurors over all the racist activity etc that went on during deliberations. Defense was asking for a new trial. I haven't heard if Judge has made a decision yet or not.

Mornin Corn - ITA. It's totally name calling. We are either guilty or not guilty. I remember how torn I was on the McCowen case. I was a not guilty on that case. IIRC, the board was split 50% on that trial.I was and will always believe Guilty in that one cause of the sperm left behind...but that doesn't mean I'd call you a name or you me..would you? LMAO

I can't remember his name at the moment; but a college student, killed a young lady in her room. He is caught on video tape. His DNA is there and confesses on video tape to a sexual act on the victim; and we all know DNA convicts; and what happens; it's a hung jury by one single woman who just happens to be an engineer.
I mean it literally blows your mind. Ya know what I'm saying? I'm not expressing myself well this morning; I don;t think.
