2. Witness Hammond was on the stand as is ballistic expert. He stated that shells found at seen were shot from a Glock.
3. Fred Brown is on the stand has worked for Ford dealerships in the fleet dept. for 14yrs.
He states that a truck viewed by an ATM vid matches the Nelson truck. Confirmed itwas 2001 F250SD XLT 4X4 gas engine.

4th witness was Jonathan Trahan, works for the Evens PD drug task force. Was present with KN at the task force office when the dispatch was aired about a shooting at the credit union. After SN name was aired, KN and KH left in KN's duty Jeep. Trahan stayed at the office.
It was Trahan that later searched KN's duty jeep and found a Glock 22 and rifle.
Witness dismissed and now on morning break.

The prosecutor probably thought the defense would have some questions to ask of the witnesses. They didn't do much cross today, at least that I was able to see.

5. Steve Nelson[no relation to KN] works for Greeley PD for 30 yrs. Received weapons retrieved from KN duty jeep, a Glock handgun with holster and a AR-15 rifle in gun case.
Steve Nelson then secured both weapons in the safe at the task force.
6. Mathew Walsh, Greeley investigator 10 yrs. received Glock gun from Steve Nelson and entered gun into police evidence.
7. Ms Martinez, I think, could not hear her name clearly worked with SN as a dispatcher.
Both had discussions about the affair between IG and SN. At one point, SN stated that she would go to gun range and pretend that the target she was shooting was HG.

FORT COLLINS – A bullet and two shell casings found at the Heather Garraus shooting scene could have come from different guns, according to a firearms expert who testified Wednesday at the Shawna Nelson murder trial.

A conclusive answer as to how that could be has not yet been provided to jurors through any witness.

Alan Hammond, a firearms analyst for the Aurora Police Department assigned to the Colorado Bureau of Investigation, firmly concluded that the two .40-caliber shell casings recovered in the Greeley credit union parking lot where Garraus was killed had been fired from a Glock 22 handgun owned by Shawna Nelson’s husband Ken. At that time he was a deputy with the Weld County Sheriff’s Department.

Hammond also testified that the bullet recovered at the shooting scene was consistent with having been fired by a Glock – but not necessarily Ken Nelson’s Glock. In fact, Hammond said, it could have been fired by two other brands of handgun.

Asked if he could tie the fatal bullet in evidence to Ken Nelson’s handgun, Hammond said, “No I cannot. It’s the proper caliber, but that’s all I can say.”

Hammond did, however, express zero doubt that the casings had – at some point in time but not necessarily the night of the murder – been fired from Ken Nelson’s Glock 22.

This leaves open a scenario, yet to be nailed down by the prosecution case, that the casings found near Garraus’s body had been fired at a different time and place, then left at the crime scene as a diversion.

No one has alleged that Ken Nelson, now living in Walla Walla, Wash., had a direct role in the execution-style shooting of Heather Garraus, who was gunned down upon leaving work the evening of Jan. 23, 2007. Prosecutors allege she died at the hands of a disguised Shawna Nelson, 36, who faces life in prison with no chance of parole if convicted.

Ken Nelson is, however, charged with tampering with evidence in the case, and is due to stand trial for that later this year. Two teen-agers who witnessed the traffic stop and resulting arrest of Shawna Nelson, 15 minutes after Garraus was killed, have testified that they saw a man who could have been Ken Nelson – he was present that night for his wife’s arrest – lean into the driver’s side of the Ford 250 pick-up and remove something from the vehicle, before leaving to check on the couple’s children, who were alone at home, nearby.

Several witnesses have testified already that when Ken Nelson got the news that his wife as being sought as the Garraus murder suspect, he was on duty at the Weld County Regional Drug Task Force operations center, with several other officers.

Nelson, according to testimony, took his service weapon – the Glock 22, serial number KDN907, and handed it to his supervisor, Sgt. Kell Hulsey. They left the operations center in a task force Jeep Cherokee. And, while driving toward what would be the traffic-stop resulting in Shawna Nelson’s arrest, Ken Nelson took that Glock 22, and gave it to Hulsey, who placed it under the passenger seat as they traveled.

Based on the testimony of Hulsey and Ken Nelson – who took the stand Tuesday – it would appear virtually impossible for his service weapon, the same gun that Hammond tied to the shell casings as the scene, to have been used in the murder.

That leaves a question for the jury of seven men and seven women. Were the casings found in the credit union parking lot actually involved in the shooting, or were they dropped there as a ruse by the shooter? And if that’s what happened, then where are the casings connected to the fatal projectiles that killed Garraus.

Prosecutors believe Shawna Nelson plotted for weeks to murder Heather Garraus, after the end of a nearly three-year affair between Shawna Nelson and Garraus’s husband, then-Greeley police officer Ignacio Garraus.

That affair, which produced an infant boy born to Shawna Nelson by Ignacio Garraus, was discovered by Heather Garraus Dec. 16, 2007, and two days later Ignacio Garraus told Shawna Nelson that he would be staying with his wife, and would be cutting off all contact with her, but for communications between their lawyers.

Michelle Moore, Shawna Nelson’s former best friend who concluded her testimony early Wednesday morning, has told the jury that Shawna Nelson outlined in detail her plan to disguise herself, approach Heather Garraus in the credit union parking lot as she left work, shoot her, leave false evidence, then flee the scene.

And that, prosecutors allege, is exactly what happened.

Shawna Nelson has pleaded not guilty, and claims she was running an errand to the liquor store, from her home, at the time Heather Garraus was killed. She was returning from the liquor store, she said, when Ken Nelson and Hulsey -- on their way from the drug task force office, having heard she was at large as a suspect – intercepted her at 65th Avenue and 18th Street in Greeley. She was taken into custody there by Hulsey and other officers.

The high-profile Nelson trial was moved to Larimer County from Weld County due to concerns that heavy publicity would make picking a fair jury in Greeley impossible. The trial is expected to conclude next week.

IMO Shawna Nelson is a very disbolical person. She was totally immersed in thoughts of killing Heather.

I think all of the LE in Greeley has testified against her and she didn't really appear to have a life outside that Department. I wonder who the defense will call. I think the Pros has a strong case against her but do feel they could've gone further and include the set-up Ken angle. I just believe fully that is what she was doing. But, they'd already debunked using that angle by charging Ken, I guess. And backtracking may have hurt them.

Nelson tests positive for gunshot residue


Clothing Shawna Nelson was wearing at the time of her arrest last January ,as well as her right hand and face, tested positive for gunshot residue, said Alex Rugh, with the Colorado Bureau of Investigation.

Rugh testified this morning that Nelson’s sweat pants, tank top, sweater, baseball cap, underwear, latex glove, and right shoe tested positive for gunshot residue.

Prosecutor Clifford Riedel said Garraus' letter of "intent to sue" would unfairly taint the jury because it didn't tell the full story -- that Greeley police knew that Nelson had had an affair with another police officer and had also threatened that officer's wife.

i just found out that my brother (whom i dearly love, and feel we are close) just discovered that his wife (my SIL) of 13 years.... has been having a FIVE year affair behind his back!!!!!!!!!! FIVE years!!! i just found out that he caught her a few months back.... and she said she would break it off..... and the other nite he found a cell phone in her car that he knew NOTHING about... all calls to her lover!!!!!!! he was devastated!!!! he is heartbroken... finally told her he was filing for divorce, and to get out. she brought her mother over to his house and moved some of her stuff... and took off. this is just crazy for our family.... they have been together and she has been a part of our family for soooooo long... it is BLOWING my mind..... i am sooooo saddened and shocked by the whole thing!! all i know to do is to be there for my brother!!! how could she do this to him???? he is the most wonderful guy a woman could ask for!! she is an idiot!!! i know it will take some time for me to take all of this in.... my poor bro!!!!!

While pregnant with Ignacio Garraus' child, Shawna Nelson said in court today that she told Heather Garraus the two never had an affair.

However, Nelson testified that her affair with Garraus lasted nearly three years.

She said that she and Michelle Moore's relationship was intimate, contrary to what Moore testified to earlier this week. Nelson said that while their relationship was not exclusive to each other, they also were free to date men.

Nelson confirmed the she emailed and sent text messages to the Garrauses, including one that called Heather Garraus 'psycho.' She said she was upset that Ignacio Garraus wanted nothing to do with their son.

Nelson said when she confronted Ignacio face to face about their break up, he said that he didn't love her anymore and that their son would be better off with Ken Nelson.

"I was shocked. I was shocked. I looked at him and said, 'You are a loser,' and I got in my car and left," Nelson said.

Court records unsealed Thursday reveal that police officers, searching a computer tower at the home of Shawna Nelson's sister, found suspected child pornography.

Shawna Nelson does not appear to be suspected of owning the images. The computer was at the home of her sister, Deborah Smith, but it is not clear whether she or someone else is under investigation.

The records explain why police officers wanted to seal court records from the public's view -- specifically, an affidavit supporting a search warrant at Smith's home. The officers wanted to examine computers from which Shawna Nelson told her sister to delete some photographs.

Some of what she said was inconsistent with what she said the night of the shooting during her interview with police. During the interview, she said she just decided to take the truck and left her car there because the kids would see it and think she was still home. IIRC

What truck key did she take? Ken stated that she had a key on her keychain to it. Her keychain was beside her purse. How could she forget it, if she took time to remove the truck key from her chain?

Ken also said it wasn't norm for Christian to be in the basement. She said he had toys down there, they'd put a lot of his toys down there with the other kids games etc.

She said she locked the bedroom door so kids wouldn't bother her. Why would they bother her if they were busy watching the baby and playing with their video games. Why leave the BR door locked when she left?

I can't wait until the Pros questions her. All her little forgetfulness will shine as deliberate cold calculating actions of a murderer. IMO.

I guess an invisible friend took over the truck, drove it to the crime scene so the tire tracks could be left, shot Heather, left shell casings belonging to a gun that didn't belong to bullets left in Heather's body and at scene, put on her mask, used Shawna's voice to talk to her, ran like Shawna, and drove off only allowing her to see anything after Ken stopped her. LOL

Yep. The state has convinced me she killed Heather.

The Judge told the lawyers to be there at 8 so they could review jury instructions. I hope they go live with that too. They may discuss what exhibits etc the jury will have with them during deliberations. Unless the lawyers have made new ones for CAs and will want those to go back to jurors too.

yeah, i think this guy was new. he kept saying he was from arizona. ? he had a hard time finding his way here, kept calling me for directions, and getting all turned around! it's like he didn't know where anything was.. no landmarks at all!! someone is supposed to be calling me back any time now... we'll see!
