A hearing date for Darren Mack's motion to withdraw his guilty plea has been set by the judge overseeing Mack's murder and attempted murder case, a prosecutor said Thursday.

Judge Douglas Herndon, a Clark County district judge assigned to the case, told Mack's lawyer William Routsis and Special Prosecutor Christopher Lalli they will argue the point in Las Vegas on Jan. 16, the day before Mack's two-day sentencing hearing, Lalli said.

Herndon gave Lalli until Jan. 7 to respond to the motion filed late Wednesday by Routsis. And he gave Routsis until Jan. 14 to reply to Lalli's response. The sentencing hearing is Jan. 17-18.

Lalli declined to comment on Mack's motion and said he has started working on his brief.

Mack, 46, is accused of fatally stabbing his 39-year-old estranged wife, Charla, on June 12, 2006, and then shooting their divorce judge, Chuck Weller, in his third-floor chambers.

Mack had pleaded not guilty and not guilty by reason of insanity. His trial, moved to Las Vegas to secure an impartial jury, began Oct. 24.

But it ended abruptly Nov. 5, just before his defense team was set to begin their case, when Mack agreed to plead guilty to first-degree murder and agreed to a conditional plea on the charge of attempted murder with a deadly weapon.

As part of the plea, Mack would face life in prison with the possibility of parole in 20 years. If Herndon diverged from that sentence, Mack could reverse his plea, under the agreement with prosecutors.

But in another surprise move, Mack last week dismissed his lawyers and hired a new attorney to help him file a request to drop his guilty pleas. In his motion, Routsis said that Mack was confused about what he was admitting.

"Further, when asked whether he had the occasion to discuss the issues in the plea agreement with his attorneys, Mack's answer was, 'the issues?'" Routsis said in the motion.

"Remarkably, Mack was never canvassed as to the enumerated constitutional rights which he was giving up by entering his pleas," Routsis added. "The court merely asked whether he discussed with his attorneys 'the rights that you're giving up by pleading guilty.'"

Routsis also said that Mack had been treated poorly in the Clark County Detention Center, and on the morning he entered his pleas, he had been deprived of sleep, food and water and had been unable to consult with his family about his change in plans.

A hearing was set for Monday in Washoe District Court to confirm the scheduling plans.

Since he will be withdrawing the plea he may be more articulate than he was when he was accepting it. Between his signature on the agreement (being different than his normal writing) and his seeming inability to comprehend what he was pleading to it is not a surprise that he has withdrawn it. He may be withdrawing his praise for Judge Herndon also when this is over.

Looks like you've been here awhile! I didn't know about this board 'til I just saw animallady's post on the CTV board.

Not sure what I'd do in mid-January without a place to come and discuss the latest and greatest WRT DMack. Sure hope LasVegasOne is planning to stream the video again.

Just since last week! There's a Sports forum in the Open Discussion section which I have been at also.

Freshwater is also starting another board to replace Crime Library on Jan. 1.

I am also hopeful that there will be cameras in the courtroom for Mack's hearing and sentencing.

Nope! I have a rather extensive collection of silly pet pics that I've received as attachments to emails over the years. That little guy is one of my favorites. :D

I do have an in-real-life golden retriever, though. And 3 kitties. :girl_haha:

Looks like I missed GollyGee. I had to make a store run, and have been pretty much in & out all weekend. Also very grateful to Harlett!:happy0158: She has taken a big job on herself.

The latest Mack antics caused me increased concern re the CTV Board & trial coverage. Selfishly, I didn't want to be left out in the cold. Also, didn't want to lose touch with DM, Spector and Animal Planet posters. Always enjoy your posts, by the way. :yes2:

Hard to say what is going to happen with the board over there...it may still be around when Mack has his court appearances in January. What really is in question is whether or not there will be any televised trial coverage.

Broadcast of the hearings is big concern. I'm still hoping that TruTV will continue to carry live coverage & live stream; at least thru Jan. Didn't one of the local affiliates in LV carry live coverage? Maybe I'm thinking of another case. We are lucky to have locals posting with us.

It is my understanding that live feed was purchased by local stations from CTV.

I don't care for the changes taking place with the network either.

The plea negotiations that abruptly ended Darren Mack’s murder trial last month were “fatally flawed” and he is eager to take the stand to proclaim his innocence as he has done for the last 16 months, his new lawyer said after a hearing on Monday.

Judge Douglas Herndon set up a schedule for both sides to file briefs on the motion, and ordered that an evidentiary hearing be held in Reno on Jan. 15-16, followed by oral arguments on Jan. 17.

If Mack’s motion to withdraw his plea is denied, Herndon said his sentencing hearing should also be held in Reno. He denied a request from the defense to postpone the sentencing, and held firm to the Jan. 18-19 dates. coercion, extortion and unethical behavior.

Darren Mack's lawyer said Tuesday that he plans to file a motion asking the judge to postpone Mack's sentencing hearing to ensure that his defense team has enough time to focus on Mack's request to withdraw his guilty plea.

William Routsis had asked Judge Douglas Herndon to drop the sentencing dates during Monday's hearing and was denied. But on Tuesday, he said he was working on a formal motion to postpone the sentencing.

Routsis also said that he and co-counsel Bruce Lindsay still are reviewing Mack's declaration with him, and it is not expected to be released until today at the soonest.

"We just received voluminous discovery -- we're talking in the area of 9,000 pages -- that we need to go through," Routsis said. "We need time to go through that discovery."

The hearing for the plea motion is scheduled for Jan. 15-16, and the sentencing hearing is set for Jan. 17-18.

Reasons for the request were because the plea motion and the sentencing will require a lot of attention, and Mack's new lawyers, who took on the job Nov. 26, need to be familiar with the details of the case, they said.

"He's entitled to effective and prepared counsel," Routsis said.

Special Prosecutor Christopher Lalli objected to this suggestion during Monday's hearing, saying that it was only Dec. 10, and they had more than a month to prepare.

"There are people's lives that are floating in the wind," Lalli told Herndon. "There are victims who have emotionally suffered greatly."

At Monday's hearing, Herndon denied Routsis' request, saying they should have enough time because they will only need to focus on the sentence for the attempted murder with a deadly weapon charge and whether he'll run the two sentences concurrently or consecutively.

In a new motion filed late Friday, Darren Mack said that he told his previous lawyers where he put the gun that Charla Mack allegedly pointed at him before he stabbed her in what he said was self defense.

The motion also said he told the attorneys the whereabouts of the knife and bloody clothes, but they refused to tell the prosecution or go look for the weapons.

“(Mack) stated that he told (Scott) Freeman that he wanted someone to go to the local landfill to find these items, which would support his claim of self defense,” Gina Crown, an investigator for Mack’s new lawyer, said in a statement filed with the motion. “Mr. Freeman told (Mack) that the weapons would not be looked for.”

For this and a list of other reasons, Mack should be allowed to withdraw his guilty pleas and be granted a new trial, the motions said.

“We are mindful of the tragedy of Charla’s death — a death is horrible no matter how it happened,” said Mack’s new lawyer William Routsis. “But I’m trying to avoid another tragedy by having the truth come out.”

Freeman said late Friday that he had not seen the motion and declined to comment on Mack’s claims.

Darren Mack said in a statement filed in court Monday that he was “psychologically raped” by his two lawyers, who assured him they would get him acquitted of murder and attempted murder charges, but changed their minds after they received the last payment in their $1.25 million in fees.

Mack also said that someone forged his signature on the guilty plea agreement, said his lawyers filed the motion claiming insanity without his consent and said one of his lawyers, David Chesnoff, lied during his opening statement to the court.

Chesnoff did not return a phone message Monday, and Scott Freeman declined to comment on Mack’s claims.

Mack also said he did not want to use the insanity defense, but Chesnoff pressured him into it. When they were trying to get him to change his plea, Mack said that Chesnoff said the insanity defense is rarely successful.

Mack said he was forced during the trial to stay in a sweltering jail cell isolated from his family, dehydrated and sleepless on a hard bed. The conditions led to a deterioration of his mental state, and left him vulnerable to pressure from his lawyers, he said.

Judge Chuck Weller, the family court judge who was shot in his court chambers in 2006, today denied claims by Darren Mack and others that he demanded $5 million from Mack in exchange for supporting Mack’s guilty plea agreement.

“I never said that to anyone and I never authorized anyone to say it on my behalf,” Weller said. “I am an honest and an ethical judge.”

In a declaration released Monday, Mack said that Weller and his lawyer, Cal Dunlap, called Mack’s former lawyer David Chesnoff and said they would go along with the plea deal if Mack paid him the money.

“I went back to the bench after being shot by Darren Mack because I believe the judiciary has an obligation to stand up against attacks against it,” Weller said.

When asked whether he planned to file a civil suit against Mack, Weller said he did not know.

“I still don’t know what I’m going to do,” Weller said.

This sociopath just can't quit; can he??? I just knew his pleas were bogus, and didn't understand why the Judge did not stop the Hearing. It seemed to me that he was playing with the Court. And that signature on the agreement!!! Part & parcel of the "Big Deceit". :mad:

Don't know his reason (s). Of course, his attorneys (because they are good attorneys) would have told him that the State's case(s) was devastating and that he did not have a case (s). So, he decided to present a bogus plea which he would later withdraw. That would give him time to organize his devotees & tweak his lies. :mad:

His weapons would prove absolutely nothing. Unless his fingerprints are still on them.

Has a writer announced yet that he/she is doing a book on the case?

Judge Douglas Herndon has canceled next week’s sentencing for Darren Mack, and has instead opened those two days to allow for a longer hearing on Mack’s request to withdraw his guilty pleas, a court spokesman said today.

The plea hearing is set for Tuesday and Wednesday in Washoe District Court, and if he failed, the sentencing was to occur Thursday and Friday. But Herndon said that because the witness list and motions for the plea hearing is so long, he wanted to allow enough time to complete the process, said court spokesman Michael Sommermeyer.

“He said that sentencing would be continued so they could spend the time completing the motion to withdraw plea,” Sommermeyer said.

“I am resetting the sentencing, should it need to occur, for Feb. 7 and 8,” Herndon told Sommermeyer in an e-mail.

Agree....he is manipulating the system as much as possible.

As for the weapons in the landfill: Mack fled to Mexico and did not surrender until approximately 10 days after the murder/attempted murder. If he was so concerned with the forensic evidence being found on the weapons, WHY did he dispose of them in a dumpster, which would be emptied at a landfill, and covered with tons of trash? Even in the summer of 2006 they would be nearly impossible to find. This is just more smoke and mirrors from him to try to postpone the inevitable, in my opinion.

Darren Mack's family and new lawyer said today that he is ready to withdraw his guilty pleas and defend himself against charges that he murdered his wife and shot their divorce judge.

"He's excited," Landon Mack said of his brother during a news conference at the family's pawn shop Palace Jewelry & Loan. "He has been muzzled. He's been trying for a very long time to tell his story."

Mack's former lawyers, David Chesnoff and Scott Freeman, again declined to discuss Mack's allegations that they failed to adequately defend him, forged his signature on the plea agreement and bullied him into a guilty plea.

"I will comment in court -- that's what professionals do," said Chesnoff, who is expected to be called to the stand during the three- to four-day hearing that begins this afternoon in Washoe District Court.

Mack's new lawyer, William Routsis, said he plans to present a case in which Chesnoff allegedly forced a Utah client to plead guilty -- a decision later reversed by the court.

"Mr. Chesnoff requested the defendant to lie, and he set up a plea agreement that the defendant was not aware of," Routsis said. The Michael Nikols case was "eerily similar" to the Mack case, Routsis said.

Mack is charged with fatally stabbing his estranged wife, Charla, and then firing a sniper shot at their divorce judge, Chuck Weller, on June 12, 2006. He went to trial and pleaded not guilty and not guilty by reason of insanity, but he changed his plea on Nov. 5, just before his defense team was to begin.

He soon dismissed Chesnoff and Freeman, hired Routsis and filed motions to withdraw his guilty pleas.

Routsis said Mack always has maintained his innocence. He also said his previous lawyers flubbed the case and were not prepared to defend him.

For example, Routsis said, after Freeman presented his self-defense argument in his opening statement, Chesnoff stood up and made "horrific" statements about Mack in support of the insanity plea to shooting Weller, including that Mack's brain was fried from the drug "Ecstasy."

Darren Mack's former lawyer David Chesnoff testified Wednesday that Mack suffered from "a form of insanity" and believed that the Second Amendment to the U.S. Constitution gave him the right to shoot a judge.

Although Mack objected to his former lawyers pursuing an insanity defense, Mack's position about his rights made it their only option, Chesnoff said.

"It's delusional to shoot family court judges who you don't like," Chesnoff said.

And when his lawyers held a mock cross examination with Mack before the defense was to begin its case, Dayvid Figler, a lawyer who helped Chesnoff on the case, said he told Mack that it would not go well if he testified.

His poor performance bolstered the argument that he should take a plea deal, Figler said.

"What was striking and graphic was Darren Mack's knee on his dying wife's head while the blood was spurting out," Figler said. "That testimony was something that didn't fit within self-defense as I understood it, and it would not be well received by a jury."

Tempers flared in Washoe District Court as Mack's new lawyer, William Routsis, questioned, argued with and pressed Chesnoff about the decisions he and Scott Freeman made since taking the case more than a year ago.

It became so hostile that at one point, Judge Douglas Herndon jumped in and told Routsis, "We're not kids," after Routsis responded to one of Chesnoff's answers with, "Oh really, Mr. Chesnoff?"

The hearing on his motion to withdraw his guilty pleas to killing his wife and shooting a judge continues today with testimony from Freeman, and possibly Mack himself, and may run through Friday.

A judge on Friday denied former Reno pawn shop owner Darren Mack's motion to withdraw his pleas to killing his wife and shooting the judge who handled their divorce.

District Judge Douglas Herndon ruled that Mack accepted the plea deal voluntarily and knew the legal ramifications when he pleaded guilty to murdering his wife and the equivalent of no contest to attempted murder in the shooting of the judge.

"The defendant admitted he killed his wife. He admitted he shot the judge," Herndon said in issuing his decision that Mack was not entitled to a "do-over."

"There was no indication whatsoever that there was any issue with him understanding what we were going through in terms of the plea," he said, adding that Mack acted "intelligently" throughout the case.

"He stopped me on multiple occasions to ask for clarifications on matters or raise issues he wanted assurances on," Herndon said.

William Routsis, Mack's current lawyer, said they would appeal.

Valley judge, prosecutor and detective described as targets

A Clark County inmate tried to take out a hit on a judge, a prosecutor and a cop who put him behind bars, authorities said.

The inmate, 42-year-old Daimon Hoyt, offered to pay a fellow inmate $30,000 to kill District Judge Michelle Leavitt, Deputy District Attorney Sandra DiGiacomo and Detective Bradley Nickell, authorities said.

Leavitt said Wednesday that Hoyt appeared in her court at least once on a burglary charge.

He acted "like a total gentleman," she said.

Hoyt was detained at the county jail, where he faces three counts of soliciting murder and more than three dozen unrelated charges including burglary, possession of stolen property and lewdness with a minor under the age of 14.

Hoyt, who authorities say is an eight-time convicted felon also known as Daimon Monroe, was arrested last fall on charges he was involved in a Las Vegas theft ring responsible for stealing about $2 million worth of goods. Police raided several locations in Las Vegas and recovered sports memorabilia, appliances and musical instruments that Hoyt and several others had stolen, authorities said.

Police said that on Aug. 8 they began receiving information from a Clark County Detention Center inmate that Hoyt was actively soliciting the murders of the prosecutor and police detective.

On Sept. 18, a jail inmate cooperating with authorities wore a wire and spoke to Hoyt during a recreation period. During the conversation, Hoyt called Leavitt a "bitch" and said he was scared she would sentence him to life in prison, according to a police arrest warrant.

During the conversation, Hoyt confirmed to the inmate that he wanted to kill the judge, DiGiacomo and Nickell, and discussed arranging payment for the killings, the warrant states.

Hoyt wanted DiGiacomo and Nickell dead because he blamed them for his arrest, the warrant states. DiGiacomo and Nickell both work on prosecuting repeat offenders and were working the burglary ring case.

He also accused both of violating his civil rights by carrying out an illegal search and seizure of his property, according to a handwritten February 2007 civil rights complaint filed in federal court.

From Oct. 1 to about mid-November, the jail informant told authorities -- including an agent from the local FBI -- about meetings with Hoyt. The informant passed along letters and notes to authorities written by Hoyt that mentioned the murder-for-hire plot and even stated that the price was $10,000 per killing, the warrant states.

DiGiacomo declined to comment on Wednesday. But District Attorney David Roger said his office takes such threats seriously.

"We're going to make sure he pays for his criminal actions," he said.

Leavitt, who learned about the plot on Tuesday night, said she wasn't intimidated by the threats.

"I think it's outrageous to make a threat like this on a judge. I think it's the breakdown in our society," she said. "If this becomes a practice, it's totally outrageous."

Leavitt said she never had any confrontations with Hoyt and was surprised when she learned he allegedly wanted to have her killed. She recalled that he appeared before her at least once while facing charges for involvement in a burglary ring. But he "was quiet. He doesn't talk back," she said.

Court officials said authorities have increased security around Leavitt, a single mother of three. They wouldn't go into detail about the security measures.

Hoyt's criminal history dates to 1992, when he was charged with burglary and grand larceny. More recently, in August 2007, authorities charged him with several counts of lewdness in connection with a sexual attack on his daughter and stepdaughter.

Authorities said murder-for-hire plots against judges and other court officials are rare. Edward Friedland, assistant court administrator, said there hasn't been a similar case here in at least five years. He did say, however, that authorities investigate about five threats of violence against judges each month.

In a high-profile 2006 case, Reno pawnshop owner Darren Mack was convicted of shooting Family Court Judge Chuck Weller in the chest, sniper-style from a parking garage near the judge's office.

Mack unsuccessfully tried to withdraw his plea in the case.

Leavitt said she wouldn't allow fear to rule her life. She recalled that her father, former Nevada Supreme Court Justice Myron Leavitt, also faced threats while serving on the bench.

"I guess I'm just sort of used to it. It's part of the job," she said.

I just read that that hearing with Charla was just 3 weeks before the murder/shooting.

Well you can, as far as my kids are concerned they tell me I am everybodys mom and grand mom. One of the niceses things my kids have said and they have said many.And I thank God every day for blessing me with 6 of them.
