This is the trial of a man accused of killing two women in a hit and run. It is supposed to be on www.cnn.com/live starting on 3/26/2008. I will try to find some more links with info.

The big camera with the fuzzy mike, the sound mixing board, two men working them. A producer typing furiously on his laptop.

CNN Live has removed this case from their list.
BethK last report was it was close to lunch break and one possible juror was diabetic, so eating is important. She also stated that Def. said they have about 30 minutes of questioning. My guess is that opening statements will not begin today.

2:05 p.m. - Opening and closing statements are not evidence, juries are always told, but a preview of what the evidence will be.

It's the lawyers' first chance to talk about their perception of the evidence.

In this case, the lawyers are veterans at doing so.

Ellen Roberts has been a traffic homicide prosecutor since the unit opened in 1993. She has tried dozens and dozens of such cases.

Top-shelf defense attorney David Roth, a member of the Florida Bar since 1969, does not seem to appear in trials as frequently - having brokered plea deals instead. Roth has represented Mark Foley and other high-profile clients, including one of the Catholic priests accused of pilfering money from an area church.

Local wisdom says if you've got the money, hire Richard Lubin for a trial and David Roth for a deal.

Roth is assisted by upstart criminal defense attorney Richard Tendler. Tendler has been a member of the bar since 1999.

A story about Tendler circulates about how he won an acquittal for a man accused of armed robbery. A man caught on videotape, a man who left his wallet at the scene.

It's a true story.

2:37 p.m. - Present in the courtroom are relatives of both victims, Cynthia Andrews and Linda Taylor. Clustered toward the south side of the courtroom behind the prosecutors' table are Andrews' brother, Eddie, and her sister. And a 20-year friend Macqua "Yvette" Woodside. "I've been her since day one and I'll stay to the end," she said.

Taylor's brother, J. Jerome, and sister-in-law, are here as well as her cousin Calvin.

Eight people seem to have gravitated to the north side of the courtroom behind Gaillard at the defense table. Among them is Circuit Judge Jorge Labarga.

The jury panel - six people plus an alternate - have now been seated. Circuit Judge Sandra McSorley is advising them, repeatedly, not to view any media or consult any outside source of information.

The trial is now under way in earnest.

Why a trial? And not a plea? People may ask.

Because the plea offered by prosecutors - 15 years in prison - is the same exact maximum penalty Gaillard faces right now.

This guy had no business behind the wheel. He must have been impaired with something or asleep. When will this stop, sleepy drivers, drunk drivers, and the elderly who are mostly over cautious.

But he was a good guy!!! (Since when is "good guy" a defense??)

OK, so he does not contest the fact he was operating the vehicle that hit and killed these women; his claim is he didn't know he hit them? So how does "not knowing" you hit and killed someone make you innocent of vehicular manslaughter? Ignorance is not an excuse for breaking the law or abstain ones responsibility. He was driving, he was responsible for his vehicle action, he struck and kill two people while behind the wheel. How does that absolve him of any guilt with regard to improper vehicle operation and homicide? Inquiring minds wanna know.

Thank you for so eloquently posting exactly what I was thinking! So his defense is: "Yep it was me, no doubt that I was the one who hit them, but because I didn't know I hit them, I should walk?" Wow! Reminds me of the elderly woman in Florida years ago that hit someone and she didn't know it - thought she hit a dog - drove home and pulled her car in the garage. Police showed up and asked to see her car - they found blood, hair, and scraps of the victims clothing still attached to the front of her car - she was prosecuted and convicted. Maybe this defense attorney is trying to use his ignorance as a mitigating factor in the "hit and run" - if he didn't know he "hit" he wasn't "running?" Only thing I can think of.

Maybe in addition to "he's a nice guy" they'll use the "he's too pretty for prison" defense. This IS Florida after all.

I bet you are right. Florida is the mecca for astounding elderly accidents. I remember a sweet 80+something lady who took out an entire bus stop. Adults, kids, babies, baby carriages, etc. because she got confused and 'breaked' the gas peddle. :eyebrow1qb:

Because it's much more serious and alludes to guilt if you leave the scene. So he claims he didn't know he hit them.
