Search planned for missing teen

Investigators have exhausted all means in the search for a missing teenager, and a full-scale ground and aerial search is planned for Thursday.
Jeffrey Blake Stone, 15, was last seen March 24 near his home on Littleton Cutoff Road.
“His family has been working hard and our investigators have been working hard, and there has been no sign of him,” Etowah County Sheriff Todd Entrekin said. “We have run every lead, and we just haven’t gotten anywhere.”
There have been several calls of sightings of the 6 foot 3 inch, 155-pound teenager, a student at Sardis High School.
“We have had a lot of leads, but we haven’t been able to verify that any of the sightings are him,” Entrekin said.
There have been calls that he was seen at several businesses, said Michael Jones, chief investigator with the sheriff’s department.
Several of those businesses have surveillance cameras, and investigators have looked at the footage, Jones said.
“We have checked out all the surveillance video, and it doesn’t appear to be him,” Jones said.
It has not been determined whether a boy fitting the description and seen with a man at Dollar General near Noccalula Falls is Stone.
Someone saw a teenager that fit Stone’s description at the store. The boy got in an 1980s model yellow Cadillac, driven by an older white man using a cane. The man had a tattoo on his forearm.
The plastic housing around the taillights of the Cadillac were missing. The car could have had a handicapped tag. Authorities were notified, and several law enforcement officers from the sheriff’s department and Gadsden Police Department searched for the car, but it has not been seen.
“We’ve followed every lead, every call, every sighting,” Jones said. “He just seems to have vanished.”
Entrekin said he and the investigators decided a full-scale search of the area was needed.
“It’s not normal for a 15-year-old to missing this long without some type of contact with family or friends,” Entrekin said. “We’re not ruling out anything. We’re looking at every angle.”
Stone was last seen walking near his home with his dogs following him.
“We’re going to start the search in the area where he was last seen,” Entrekin said.
He was wearing a light T-shirt under a plaid long-sleeved shirt. He had on a light-brown Carhartt jacket, black shoes with red trim around the soles and a baseball cap.
Local volunteer fire departments, the Etowah County Rescue Squad and the sheriff’s department mounted unit will conduct a search on the ground, while the sheriff’s department helicopter is expected to be used to search from the air, Jones said.
The search headquarters is expected to be set up at Anchor Baptist Church on U.S. Highway 278 West near Littleton Cutoff Road.

Ground and aerial searches resumed today in Etowah County for a 15-year-old boy who disappeared on March 24th. Etowah County Sheriff Todd Entrekin said Jeffrey Blake Stone is 6 feet 2, weighs 155 pounds with blonde hair and blue eyes.
Entrekin said in a statement today, sheriff's deputies, volunteer firefighters and dozens of volunteers concentrated the search around a three-mile radius near Stone's residence in Attalla. The boy's stepmother told authorities that Jeffrey, a student at Sardis High School, left home by foot at about 12:30 p.m. and has not been heard from or seen since that time.
Authorities set up a command post at Anchor Baptist Church in Attalla.

Etowah County sheriff’s personnel will be searching for a missing Sardis student this morning.
Jeffrey Blake Stone, 15, left his home in the Littleton area on March 24 and has not been or heard from since.
The sheriff’s office has received some tips, but they have not led to him being found. As a result, Sheriff Todd Entrekin has planned a search by air and land.
The teenager is 6 feet 3 inches tall. He weighs 155 pounds and has blond hair and blue eyes.
He was wearing a light-colored T-shirt over a long-sleeved plaid shirt. He was also wearing a light brown Carhartt jacket and a baseball cap.
The search will begin at 8 a.m. The command post will be the Anchor Baptist Church at the corner of U.S. 278 West and Causey Lane.

-The Etowah County Sheriff's Department will begin searching for missing 15 year old, Jeffrey Blake Stone, today at 8 a.m. Anchor Baptist Church located at 14199 Hwy 278 West Attalla. The search will be conducted by land and air using any resource available to the Sheriff's office-Officers with the Sheriff's Office, the Etowah County Sheriff's Office mounted unit, the Etowah County rescue squad, the local volunteer fire departments, and any family and friends. Stone left his residence on March 24, 2008 around 12:30 p.m. walking and has not been seen or heard from since. The contact person for the Sheriff's Office is Jeff Hopper (256) 549-2182.
-Governor Riley will be speaking at the Alabama Pre-K Conference today at 10 a.m. The conference brings together teachers, administrators, parents and pre-K advocates. About 500 people are expected to attend.

LITTLETON — Jeff Stone struggled to hold back tears as he pleaded for his son to come home.
Jeffrey Blake Stone, 15, has been missing since March 24. At least 100 people searched about a 3-mile radius near the Stone’s home on Littleton Cutoff Road, where he was last seen.
“All we want is Jeffrey back,” Jeff Stone said as he spoke to reporters at a command post set up in the fellowship hall at Anchor Baptist Church on U.S. 278 West, where it intersects with Littleton Cutoff Road.
“After 10 days of a severe emotional roller-coaster, our family just wants Jeffrey back,” Stone said. “All we ask is that anyone who knows where he is or has seen him to contact police.”
There has been no sign of Jeffrey Stone since he left his home at 909 Littleton Cutoff Road about 12:30 p.m. March 24.
He was reported missing by his stepmother, Lynn Stone. His father was at work when he left.
Lynn Stone told authorities that he left walking about 12:30 p.m. when he became upset after she asked him to clean his room. His dogs were following him but since have returned home.
She told authorities he has left home before, but normally returns a short time later.
Etowah County Sheriff’s Department investigators have been searching for Jeffrey Stone since he was reported missing, following up on possible sightings.
There have been several calls of sightings of the blue-eyed, blond, 6-foot-2-inch, 155-pound teenager, a student at Sardis High School. However, those sightings so far have proved false.
Investigators decided to do a ground search today, starting in the area where the teenager was last seen, Sheriff Todd Entrekin said.
“This has been a very tough area to search,” Entrekin said. “It’s a very rural area, with thick brush, briars and undergrowth. People have come back with their clothes torn and scratches on them.”
He said the terrain has steep hills, caves and ravines. “The terrain is just about every type you can imagine,” he said. “If he has run away and didn’t want to be found, it would be a good area to hide.”
About 80 percent of the 100 or so who searched were volunteers on horseback, four-wheelers and on foot, Entrekin said.
“Nobody has found anything that ties back to this boy,” Entrekin said.
Entrekin said the investigators decided to do the search today because rain and storms possibly are moving into the area this weekend.
It is not believed that Jeffrey Stone took any money or food with him when he left.
“It’s not normal for a 15-year-old to go missing this long without some type of contact with family or friends,” Entrekin said. “We’re not ruling out anything. We’re looking at every angle.”
Horseback riders with Sheriff’s Department mounted units came from Mobile and DeKalb counties to assist in the search, along with volunteers from the Etowah County Rescue Squad and the communities’ fire departments — Ivalee, Sand Valley and Gallant.
The search got under way just after 8 a.m. and searchers returned to the church fellowship hall about noon for a meal provided by Gadsden Christian Fellowship. Rural Metro Ambulance was on standby, and assistance also was provided by Gadsden-Etowah County Emergency Management Agency, Etowah 911 and the FBI.
“Everybody has done a great job today,” Entrekin said. “A search of this magnitude wouldn’t be possible without everyone’s help. It’s a great show of cooperation from many agencies and individuals who have one goal in mind — bringing this young man home.”
Entrekin asks that if anyone is helping Jeffrey Stone hide and keeping his whereabouts secret, to please contact the Sheriff’s Department.

Ground Search Over With No Sign of Missing Teen
The ground search has ended with no sign of a missing Etowah County teen. 15-year-old Jeffrey Stone disappeared the day after Easter. Yesterday, more than a hundred deputies and volunteers searched by horseback and four-wheelers near his home. That ground search ended in mid afternoon with no sign of Stone. Family members say they found Stone's dog alone on a nearby road.

I have been following this case with great hope for finding this boy. This area seems very rural. Not the type for an abduction (of course if there is such a place now days). I wonder if he may be hiding out somewhere. Its amazing what type of loyalty kids have to each other. Then again, it would be hard without other kid's parents not spotting him. Maybe he was hurt somewhere in the woods. Cases like this get to me. I hope he is found soon.

Missing teen featured on Web sites

Jeffrey Blake Stone now is featured on national Web sites for missing children as the search continues for the 15-year-old last seen March 24.
The Etowah County Sheriff's Department helicopter was flying Monday afternoon, with the pilot searching the area where at least 100 people searched on the ground on Thursday, Sheriff Todd Entrekin said.
Deputies and investigators also are in the area on foot and on four-wheelers, Entrekin said, searching in some areas not covered in last week's massive search, he said.
There has been no sign of Stone since he left his home at 909 Littleton Cutoff Road about 12:30 p.m. March 24.
He was reported missing by his stepmother, Lynn Stone. His father was at work when he left.

to call and let his family know he is OK."
However, Entrekin said, investigators have not ruled out other possibilities.
Stone is featured on several Web sites for missing children, including America's Most Wanted at www.amw.com; the National Center for Missing and Exploited Children at www.ncmec. org; and www.helpfindthemissing.org.

I have a Ph.D. in clinical psychology and serve as an Etowah County Mental Health Officer. His dad, Jeff, is an RN at the infirmary in the state prison in St. Clair county. I may not have given birth to his boys but I chose these two boys as my children. We've certainly had our ups and downs, as does any family attempting to blend. We call him Blake b/c his dad is Jeff and my son is Jeffrey. Blake's brother is Andy and my daughter is Randee. I spend more time with Blake than any other adult in his life. His grandparents here are very caring toward both boys and helped Jeff rear them in their early years. They are warm people who have made me welcome in their family from the start. Jeff and I love Blake and Andy dearly and are quite devastated by Blake's being gone. It's been the worst emotional roller coaster b/c there is no human form of love greater than that of a parent toward their child. Yes, he has given us problems, esp over the past year, as do many adolescents reaching for independence. He has told his friends that he wanted to live on his own and, being 15, believes he can support himself. His reasons expressed to his friends are that we are mean to him and he "doesn't want to live in a house with rules." Let me reassure all of you, we do not use corporal punishment but logical and natural consequences. The only chore he is assigned is to fold his clothes and put them away, which is what he was told to do by his father the day he left. He awoke around 11:30, got dressed to leave the house b/c he was due to see his girlfriend at the Pizza Hut in E. Gadsden at 2:30. He became angry that I wouldn't take him there at noon, 2 and 1/2 hours early, and not before he did as his father told him. There was no arguing from my side, just "no, I'm not taking you right now." He left the house about 12:20 without saying anything. I was in my room upstairs and didn't see him leave. But it is his habit to do that. He usually walks down the front of the property and goes to an 18y.o. neighbor's house. When he didn't return by 1:30 to have me take him to see his g.f., I called the neighbor w/no response. I called his g'mother to see if he had walked over there to get him to take her. I continued to call the neighbor every 10 to 20 minutes and drove over there. I knew he was home b/c his truck was there but he never responded. Jeff arrived home from work about 3:45 and I told him what had transpired w/Blake. He was upset that Blake had disobeyed and we went to the neighbor's house looking for him. Tho he was home, he did not respond to our knocking. We drove around the neighborhood and asked if anyone had seen him. It is not uncommon behavior for Blake to walk around the whole area visiting w/neighbors, so we were not alarmed at the time. When we came back toward the house around 4:30, his dog who follows him everywhere, was at the foot of the drive, returning home, so I said "oh, he's back." However, when we reached the house, which is set quite far back from the road, Blake was not there. B/c we know his dog would never leave him, we then started calling all his friends and driving around in an ever-widening pattern. Blake knows he's supposed to be home before dark, so when he hadn't returned by 8:30 and had not called, I called the Sheriff's Dept. A deputy arrived shortly thereafter and I completed a Missing Person report while Jeff was still out looking for him. We've had many leads over the past 16 days but the trail goes cold. I spend 14 to 16 hours a day driving around looking for him or sitting in front of a store where he has been sighted, awaiting his possible return. Jeff goes to work to ensure we have enough gas money to continue the search, as we've spent his entire paycheck on flyers and ads in the Times. The Etowah County Rescue Squad, of which Jeff and I are both members, has spent days, using their own cars/gas monies to aid us in following leads. They sat for hours watching different areas where he was reported to be seen, esp near the g.f.'s house. The Sheriff's Investigation Unit has been diligent in working with us and the Sheriff himself came to our house on the 4th day to reassure us of their efforts. These investigators have all given many hours to help us and I'm compelled to express my immense gratitude to Investigator Jeff Hopper, who serves as our liaison. We're all 99% sure Blake has run away and is hiding out with a friend b/c of all the things his peers have told us. We can only assume that he convinced whoever is hiding him that we are mean to him. All I asked was a little sensitivity from enog (aka "gone" backwards - see how astute I am? ) for a while, as the whole family is very tense and hypersensitive about the situation. It's still too raw. What I would appreciate more than anything is having everyone keep their eyes on the areas in which they live for a sign of Blake. We're running out of leads and feeling quite despondent. When enog stated "boys and girls run away...for a reason," he was somewhat less than profound, tho tritely correct, and certainly not subtle. So, if you'll indulge me for a few minutes of writing too much on a blog, maybe I can offer enog some education on the matter. Yes, Blake ran away for a reason - his reason...he didn't get his way. Unfortunately, this has been his mode of functioning as long as I've known him - likely due to physiology as well as environment during his earlier years. That is, by happenstance, I first met his birth mother a little over 2 years ago. By her choice and difficult life circumstances, she has not contacted either of the boys in almost 10 years. I talked to her openly, reassured her the boys were well, et al. She willingly was able to give me insight into some of Blake's behavior. To cut to the chase, he basically functions as a 2 y.o. w/a 15 y.o.'s savvy and attitude b/c he likely missed a phase of neurological development when he was 2, a time when she had primary custody. Since Blake has been missing, we've talked daily, discussing ways in which we might be able to track him down together. She knows, as do all who know me, that I am not the "wicked stepmother." And I know she still has the boys in her heart. What we don't know is where Blake is. Even tho his peers insist he is hiding out, it's been almost 3 weeks and we're quite frightened that he may have come to harm b/c he doesn't have the intuition or awareness of danger from an adult. Just remember how a 2y.o. faces the world. And now I offer my apologies for taking up so much space and thank you all for the love you've shown.

As to sightings, yes. There have been sightings which often seem to be unconfirmed b/c his peers won't talk openly to law enforcement. Everyone of his peers from every area he's ever been in has stated he is "hiding out with an older friend" and thinks this is a great adventure. Some have talked to him on their cell phones but don't want to "rat him out to the law," precisely the reason we excluded the sheriff's dept number from our ad offering a reward which, btw, has grown significantly thru donations from family, friends, and co-workers who know us well and know what we've done to try to aid Blake in becoming a successful and functioning member of society. But we still fear he's going to make a serious error in judgment that will endanger himself while he's enjoying his "independence."

For you: Blake has been seen at chicken fights in the valley this past week and at Wal-Mart in Boaz yesterday. He seems to be staying w/different friends in the Sardis/Boaz/Rockledge area but stays one step ahead of everyone who has a badge, as they're warning him. Maybe a civilian can get closer. Thanks.

I get so angry with kids that run away. I had friends who went through this a couple of years ago. Their child was only missing 3 days but it was the worst 3 days of their lives. My advice to them was a visit to a morgue and a visit with a family whose teen ran away only to return in a casket. Some of these kids need the carp scared out of them.

The 15-year-old has been missing more than three weeks.
Stone is featured on national Web sites for missing children. A special investigative unit from the National Center for Missing and Exploited Children has been in contact with the Etowah County Sheriff’s Department about assisting with a special investigative team, said Jeff Hopper, one of the investigators at the Etowah County Sheriff’s Department working on the case.
Investigators have checked possible sightings and none have panned out.
In the stores where he was reported to have been spotted, investigators have looked at surveillance video and investigators do not believe the sightings are of Stone.
About 100 people helped with an intensive ground search on April 3 but nothing was found to lead to Stone’s whereabouts.
His home is in a rural area, with thick brush, briars and undergrowth, and the terrain has steep hills, caves and ravines. The search was in an area of about a 3-mile radius around Stone’s home.
It is believed Stone took no money or food with him when he left.
There has been no sign of Stone since he left his home on Littleton Cutoff Road about 12:30 p.m. March 24. He was reported missing by his stepmother, Lynn Stone.
Lynn Stone told authorities that he left walking about 12:30 p.m. when he became upset after she asked him to clean his room. His dogs were following him but they since have returned home.
She told authorities he has left home before but usually returned a short time later.
“We have no proof of anything other than he just walked away,” Hopper said.
Stone’s parents have offered a reward for information.

Just wanted to add a note that I spoke to Blake's mom on the phone this morning. This is a very hard day for their family, with Blake still missing.
They have hired private investigators, and there was another search done yesterday, with no clues or results.
They send their thanks to anyone and everyone who cares about Blake, and to all on this site who have helped in any way.
My heart breaks for them, and I pray this child will be found safely.

Community Searches For Missing Ala. Teen

Police say on March 24, 2008, 15-year-old Jeffrey Stone left his home on foot and vanished.
He was last seen leaving his home located at 909 Littleton Cutoff Road in Attalla, Ala. wearing a light colored t-shirt under a plaid long sleeve shirt with a light brown Carhartt jacket, black shoes with red rim around the soles and a baseball cap.
Police have received many tips about possible sightings, but none of them have panned out. They have searched local surveillance cameras, but have not come across any clues to further the search.
On April 3, 2008, volunteers and search teams met at the Anchor Baptist Church on U.S. Highway 278 and planned to search all day for the missing teen.
Police say they need the public's help. Anyone that has information on Jeffrey's whereabouts needs to contact them immediately. Police are not ruling anything out at this time.

Missing teen’s parents still have no idea where their son is

Lynn and Jeff Stone hold a reward flier for their son, Jeffrey Blake Stone, Friday in Gadsden. The 15-year-old has been missing since March 24.
Not knowing is the hardest part for Jeff and Lynn Stone and other family members of Jeffrey Blake Stone, missing for two months.
The 15-year-old left his home on Littleton Cutoff Road on March 24 and has not been seen or heard from since.
“All we really want to do is hear his voice,” his father said this week.
“If somebody knows something, we need to know that. If something else has happened, we need to know that, too.”
Time seems to have stopped for the Stone family. They have driven many miles, looking for any sign of Blake, as his family calls him.
They have put up posters, hoping someone has seen the tall, blue-eyed blond.
He is 6 feet 2 inches tall and weighs 155 pounds.
“Our lives have stopped,” Jeff Stone said. “Even to this day, we’re looking for those same clothes he left in. Somebody has to be taking care of him. All we really want is for anybody who has any information to call and report it.”
Dozens of sightings have been reported but there is nothing that confirms that any are of Blake. He is known at Sardis High School as Jeff.
Several callers have reported seeing someone fitting his description and it turned out to be Blake’s younger brother, Andy. He resembles Blake but is shorter.
“To this day, we know as much as we did the day he left,” his father said.
One large search was conducted in a 3-mile area around the Stone’s home — in a rural area, with thick brush, briars and undergrowth, and the terrain has steep hills, caves and ravines — 10 days after he was last seen. Nothing was found. Another search on a smaller scale was conducted about a month later.
He left his home about 12:30 p.m. with no food, money or clothes.
It was the day after Easter and he was out of school that day, his stepmother, Lynn Stone, said.
He wanted Lynn to take him to East Gadsden to meet his girlfriend but she told him she was not going to take him right then.
She thought he was in his room and discovered a little while later he wasn’t there.
It wasn’t unusual for him to walk off, to visit neighbors, she said.
“He usually comes back in 45 minutes,” she said. “We just thought he walked off and didn’t tell us where he went.”
By 3:45 p.m., however, she was very worried, she said. Blake’s father had gotten home from work and they were searching in the neighborhood, calling his friends, to try to find him.
His dogs apparently left with him but returned home later that day.
The Stones called the Sheriff’s Department at 8:30 p.m.
Jeff and Lynn have no idea if he walked off and caught a ride with someone or if he somehow was injured. But his friendly nature concerns them.
“He’s never met a stranger,” his father said. “He talks to everybody.”
And he doesn’t have the awareness that somebody would hurt him, Lynn Stone said.
The Stones have been told he was hiding out with friends, but nobody has come forward with any information that confirms that.
“We just don’t know, and that’s the hardest part,” Jeff Stone said.
Countless people have helped look for Blake and for that, the Stones are thankful.
“There just aren’t words to express how the people of this community have stepped up,” Lynn Stone said.

Donations can be made at any branch of Community Credit Union or mailed to 110 S. 26th St., Gadsden, AL 35904.

thought the very same thing when I first read about Blake however, I also got the impression that bio mom even though she didn't seem to be much in the picture was in pretty close contact with his Dad and Stepmom since he went missing. Coverup?

The bio mom cut off contact with Lynn and Jeff shortly after Blake went missing. She had also gone around and put notes on many of his Missing posters saying who she was and gave her phone number.
They have visited her home and she won't let them in. LE can't get a search warrant because there's no real evidence that he's there.

The way I understand it, is that Blake has to be seen entering or leaving before they can do that. A lot of people are trying, but she lives in a small trailer park and it's hard for strangers to get close enough.

Etowah County Sheriff's investigators were on the scene at 1176 Littleton Cutoff Road, Tuesday near Attalla where they served a search warrant. Investigators apparently found the body of Jeffrey Blake Stone, 15, who has been missing since March 24. At least one person is in custody in connection with Stone's death. Remains believed to be those of 15-year-old Jeffrey Blake Stone were found today in a freezer at a neighbor’s house in the Littleton community, Etowah County Sheriff Todd Entrekin said.
Two neighbors, ages 19 and 22, are in custody, expected to be charged today with murder.
Sheriff’s Department investigators were led to a shallow grave on a logging road just off Rocky Hollow Road near Gallant about 3 p.m. today, Entrekin said.
Evidence there led to a search warrant at 1176 Littleton Cutoff Road, just down the road from where Stone lived with his father and stepmother, Jeff and Lynn Stone.
That location is about 10 miles from Stone’s home on Littleton Cutoff Road, where Stone was last seen.
The 15-year-old, who was a student at Sardis School, was reported missing after he was last seen on March 24.
Sheriff’s Department investigators received a new lead Tuesday morning that led to the grisly discovery, District Attorney Jimmie Harp said.
“Investigators have worked tirelessly since the missing person’s report was filed and from the public’s point of view it might have seemed slow,” Harp said. “But they have worked diligently and never stopped following leads.”
Harp said tonight that the investigation would continue into the night and charges are expected Wednesday.
It is believed that the boy was killed and initially buried at the area on Rocky Hollow Road, Entrekin said. Entrekin said an autopsy will determine how Stone died.
The body was apparently moved within the last week and placed in a chest-type freezer at a neighbor’s house. The body apparently was wrapped in a tarpaulin.
Entrekin said investigators are still trying to determine why the body was moved from the grave to the freezer.
The report of the missing boy led to several searches from law enforcement and others in the community.
“There was real cooperation from the Littleton community and that community is grieving tonight,” Entrekin said.
Experts with the Alabama Department of Forensic Sciences were at the house and will have to confirm the identity of the body, Entrekin said.

I'm simply heartsick over this, but I had to wait until a published report came out.
I've become very close with Blake's stepmom, and we had suspicions about these neighbors from the beginning, but LE couldn't or wouldn't search their entire property or homes.
Then we got tips that he was being hidden by his birth mom, and were hoping that was true, because at least he was alive.
Now this.

Maybe because he looks so much like my son did at that age or the I wanna be on my own attitude. With all the reports of sightings I was so hopeful that he would realize theres no place like home, and now this.

My thoughts and prayers are with the Stone family. My son knew Jeffrey and is a friend of his younger brother. I am so sorry this ended this way and I hope and pray those responsible get the maximum sentence of death. My prayers also go out to the students and teachers at Sardis. Sheriff Todd Entrekin said Tuesday that two suspects were being questioned in connection with the disappearance of Jeffrey Blake Stone, according to The Associated Press. District Attorney Jimmie Harp said charges were expected today.
Stone, a student at Sardis School, was reported missing after he was last seen March 24.
Investigators received a lead Tuesday morning that pointed them to a shallow grave on a logging road, Entrekin said. He said evidence at that site prompted investigators to obtain a search warrant for a home not far from where Stone lived with his father and stepmother.
Entrekin said it appears the boy was killed and buried in the shallow grave and was moved within the past week to a chest-type freezer in the home.

This INFURIATES me! Mr. Smiley is not an upstanding citizen folks! Here's his rap sheet: He was arrested on 9/8/07 in Lee County Alabama for Possession/Receipt of a controlled substance and since our legal system is so jammed up, he wasn't even indicted until 5/13/08 (AFTER he had his fun with poor little Blake). NOW, get this! He will not be serving any time. He's simply on probation and they lessened the charge to a misdemeanor! It's wrong wrong wrong!!!

The only interesting thing on the REAL Nathaniel Wayne Lee-administrator-can you remove my INCORRECT info from earlier? is that he was sued 12/19/07 by Donald Raymond Lee, Sr. for the probate of the will of Richard W. Lee. He answered the complaint (hired an atty named Gregory Cusimano) on 1/17/08 and it looks like there was a hearing ordered in the case 3/12/08-I wonder what came of this? Did he lose the house and go mad? Hmmmm....

AND the news also said the DA says if convicted (no problem, they confessed) they face 99 years, so it doesn't sound like they're going for the DP. I'd like to see Lynn and Jeff push for it, but right now Alabama and Texas are under fire for carrying out the DP too often. Our AG is ticked!!!

I hope they do go for the DP and who really gives a rip that we're being criticized for killing murderers, ya know? GADSDEN – Two men have been charged with the murder of Sardis High School student Jeffrey Blake Stone.
Nathaniel Wayne Lee, 19, of 1176 Littleton Cut-Off Road, Attalla, and Troy Andrew Smiley, 22, of 1084 Anna Drive, Attalla, have both been charged with the first-degree murder of Stone.
“It appears this senseless murder of this 15-year-old had been planned for weeks,” Sheriff Todd Entrekin said.
“And once they got him over there, they executed their plan for no other reason than to get the rush from killing somebody.”
Entrekin said it is believed Stone, who had been reported missing on March 24, was killed the day he went missing.
Entrekin and District Attorney Jimmie Harp both expressed their desire to see that Lee and Smiley receive the most severe penalty possible
“It scares me to death to think that people are out there killing people around this state just for the thrill of it,” Harp said.
Entrekin said information suggested a body was in Lee’s home, about a quarter of a mile from Stone’s parents home where he lived.
Information leading them to the site of an empty shallow grave on a logging road in Gallant near Rocky Hollow Road at about 3 p.m. Tuesday led investigators to obtain a search warrant for Lee’s house.
It was there investigators found a body – believed to be Jeffery – wrapped in a tarpaulin inside a Tupperware container inside a chest-type freezer.
Entrekin said it appeared the boy was killed at Lee’s house by more than one gunshot to the head and buried in the shallow grave.
Within the last week it was, for a yet unknown reason, moved to the freezer.
Entrekin and Harp credited the diligence of Jeffery’s parents with helping to solve the case by providing information suggesting Lee and Smiley had something to do with Jeffery’s disappearance.
Entrekin said a statement reported to have been made by one of the suspects concerning the killing allowed the investigation to focus on the pair and eventually obtain a confession.
Harp said a bond hearing would be held within 72 hours, with the case being given to a grand jury in September.
Although the pair is only charged with the one count of first-degree murder, Harp said, the investigation is continuing, and other charges are possible in the future.
“Unfortunately at this time a kill for the thrill is not a capital offense,” Harp added. “If convicted the pair could face 99 years to life.”

They've had a lot of unfounded tips, and followed up on every single one of them. Lynn, Jeff and Philip have been everywhere, staked out places he could have been, literally walked the streets in other communities and even in another state where they thought he could be, all the while praying one of the tips would turn out to be Blake, alive.
She's such a wonderful person, and I enjoy our emails, although sometimes they're very sad. Just recently we decided to meet for lunch soon. I can't imagine their grief today, and wouldn't dream of intruding on it. She has my email and phone number and knows a friend is here if she needs me.

Two Charged in Teen's Murder
Two men are being charged with murder in what prosecutors call the "thrill killing" of a teenager.
Etowah County District Attorney Jimmie Harp says 22-year-old Troy A. Smith and 19-year-old Nathanial Wayne Lee are both being charged with murder in the killing of 15-year-old Jeffrey Blake Stone.
Remains that prosecutors think belong to the teen who'd been missing since March 24th were found Tuesday in a freezer in the Littleton community.
Prosecutors found the remains after confronting one of the suspects about a shallow grave they'd found, where its believed Stone's body was initially buried.
Both suspects are being held without bond.

Nathaniel Wayne Lee, 19, 1176 Littleton Cutoff Road, and Troy Andrew Smiley, 22, 1084 Anna Drive, both near Attalla, were charged with murder Wednesday.
Stone, 15, a student at Sardis High School, often visited at Lee’s home about a quarter-mile from his own.
Stone’s remains were found in a freezer at Lee’s house about 6 p.m. Tuesday, Entrekin said.
Stone had been missing since March 24, a day he was out of school for the Easter holiday. He left his home walking about 12:30 p.m. When he did not return within a couple of hours, his father and stepmother began searching for him.
Within a day, they were passing out fliers and searching all through Etowah County, following any lead they could. They asked Lee to pass out fliers at Gadsden State Community College, where he was enrolled.
Most of those fliers were found in Lee’s house, Entrekin said.
“This is a very sad time for the family of Jeffrey Stone, as well as the community in which he lived,” Entrekin said. “Our prayers go out to them. This murder was a cowardly act of two individuals who took the life of a 15-year-old simply for thrills.”
Investigators now believe when Stone left home, he went to Lee’s house — a large brick home on more than 100 acres that Lee inherited after his father’s death a few years ago.
Lee lived there alone, but Smiley often stayed over.
Entrekin said Lee and Smiley were close friends.
“They hung out together and smoked dope together,” Entrekin said.
Lee and Smiley were there shooting for target practice — something Lee did often, Entrekin said.
“Once they got him over there, they shot him,” Entrekin said.
Entrekin said the investigation shows that Stone did not realize he was about to be shot.
“They had planned this senseless murder for weeks,” he said.
Entrekin said they apparently chose Stone because he was over there often.
Investigators got a tip Tuesday morning that led to a shallow grave on a logging road just off Rocky Hollow Road near Gallant.
There was evidence at the shallow grave that led to a search warrant at Lee’s house.
Entrekin said Stone was killed in the woods behind the house and then initially buried at the area on Rocky Hollow Road, about 12 miles away.
Entrekin said Lee and Smiley apparently went to the grave a couple of weeks ago and moved the remains to the chest-type freezer. The body apparently was wrapped in a tarpaulin and placed in a plastic Rubbermaid box.
“Apparently they thought the body was exposed and they were afraid someone would find the body,” Entrekin said.
District Attorney Jimmie Harp said for now Lee and Smiley are being held without bond on murder charges. The penalty for a murder conviction is 99 years to life, Harp said. A judge could set bond, he said.
Harp said he knows of no reason at this point in the investigation that charges will be upgraded to capital murder — the only charge in which the death penalty is applicable.
“Unfortunately, a kill for the thrill is not applicable to capital murder,” he said.

Harp said Lee and Smiley had been people of interest early on and were questioned.
“But we had to have enough evidence and probable cause to execute a search warrant,” Harp said. “We have to make a case we can win. It wasn’t until yesterday that we had probable cause to go forward.”
Harp said Stone’s father and stepmother, Jeff and Lynn Stone, have worked diligently searching for their son and hoped to find him alive.
“But they suspected foul play and passed on every tip they could to investigators,” he said. “It’s a very sad day for them. It’s the worst news ever a parent could hear.”
Harp said the details of the case also have been disturbing to investigators.
“I don’t understand it,” he said. “It scares me to death. It’s hard to digest that somebody would actually take someone’s life for the thrill of it. It’s very disturbing.”

MONTGOMERY — A state senator seeks to raise the age limit of murder victims for capital murder charges following the arrests of two men in the alleged thrill killing of a 15-year-old.
Sen. Larry Means, D-Attalla, said today the law does not allow two adults who allegedly shot and killed 15-year-old Jeffrey Blake Stone in Etowah County to be charged with capital murder that includes the death penalty as punishment.
State law says the murder of a child young than 14 can be a capital crime but killing a 14-year-old or 15-year-old without any aggravating circumstance is not.
“I just can’t believe it,” Means said. “I can’t believe there’s a difference between 13 and 14.”
Conviction of capital murder can result in the death penalty or life in prison without the possibility of parole.
Means said he’s not been contacted by anyone — including the victim’s family, whom he does not know — about the age change. He said he may seek to increase the age limit to 18.
Etowah County District Attorney Jimmie Harp said he welcomes Means’ attempt to enhance the law.
“Any time I get a legislator who wants to strengthen the criminal law to hike the death penalty age, I’ll support him,” Harp said.
State Attorney General Troy King also supports Means’ efforts, spokesman Chris Bence said.
Harp and Etowah County Sheriff Todd Entrekin said Wednesday that Nathaniel Wayne Lee, 19, and Troy Andrew Smiley, 22, who live near Attalla, were charged with murder in Stone’s death.
Stone had been missing since March 24. His body was discovered in a freezer at Lee’s house on Tuesday, Entrekin said.
Harp and Entrekin said the shooting was a thrill killing.
Investigators believe Stone went to Lee’s house, where Lee and Smiley were taking target practice. The boy was then shot and buried off Rocky Hollow Road about 12 miles from Lee’s house. Recently his body was dug up and moved to a chest-type freezer at the home of Lee, who lived alone.
Harp said one of the two led authorities to the shallow grave and the body and “obviously he’s made a statement to police officers,” but Harp wouldn’t say which suspect allegedly talked.
Harp said the case could go to an Etowah County grand jury in September if any forensic evidence including results from an autopsy are ready. He said he’s studying ways to enhance the murder charges to capital murder.
The two suspects are being held without bond.

Why can't they add on the charge of kidnapping? Even if he went there on his own surely he wanted to leave once he realized they were going to kill him.

Thank you, Roamer. I should have said no matter what age the victim was. The fact is, these two planned and carried out a cold blooded murder. They should get the death penalty. IMO. I am angry because of Blake's age at time of death, that it doesn't constitute death sentence for his killers.
You are right about it being grandfathered back. They would have to make special circumstance included in order for a new law to cover crimes committed before the law was signed. But it could be done!!

OH, okay either way it BS. Why would a 15 y/o's life be any different from 14years old and down? At any age, a victim is a victim and should be eligible for the DP if it's warranted.
Besides the fact, to me, this was premeditated, it was planned from the beginning.

2 fyi's-1. The boys' 1st hearing will be 7/8/08 and on 7/3/08 Jeff's father filed a civil lawsuit against both boys for wrongful death. I'm wondering if they knew all along yet were tied by the "system" to do anything about it-that's just really quick for a civil suit dontcha' think?

I don't think it is really. If they wait, then a legal time filed might hinder them being able to follow through. In some states you only have so many months after the fact, usually (if I remember correctly) a year. With this case and the obstacles they already face in prosecution for death penalty, I'd have done so within a week of arrest.

Yes, and what I found the most disturbing out of all those comments was livefreetas (who is evidentley Andrew Smiley's fiance) comments. The reason I believe this is his fiance is because someone on the board that knew Nathan said it was and also Smiley's aunt called her Brittany which according to some other friends of the killers is in fact, Smiley's fiance's name. You would just have to go and read the comments this girl has wrote. They are disturbing to say the least. She proclaims her love on one of the boards to him. I think it is this one

There is some very interesting things on them...It just makes me utterly sick that anyone besides the young men's/killers family would stand up for them. I can't believe anyone would think what they have done is not a big deal. The threads on the GT website got so heated that they had to close them all down. My heart goes out to the Stone family. I can not imagine what you have went through and are still going through. We (my whole family) are praying for you. Well I don't know if the Smiley boy has any money, but I can tell you that it appears Nathan Lee does have a lot of land and a big nice house that could probably end up going to the Stone family. Although, I don't know if they'd want to keep the house considering what happened there. I am pretty sure I heard that the lawsuit over the house and land, where someone was fighting/suing Nathan for control over it, is over and Nathan now owns all of it free and clear. However, I am not 100 percent sure that is true. I don't know if it is really quick or not, but what they may of been thinking is that Nathan may try to sign all of it out of his name and put it in another family member's name to keep the Stone's from taking it if they filed a suit. So, that may be why they hurried up and filed the suit. I don't know! However, he (Nathan) may have to sale the land/house to pay his lawyer. I don't know that either because I don't know him.

Yes and the current sheriff of Etowah county is trying to make sure he will win the election. Those that are not from this area, may not know, but he was not voted in as sheriff by the public. Our other sheriff died (which was a democrat) and I think it was the republican party that had to vote someone in as sheriff for the remainder of the term, which was 2 years I think, but don't quote me on that. Anyway, the current sheriff, Todd, was the chief deputy under the one that had died, Todd was also a democrat. However, so that he could be voted in as sheriff by the republican party, after the other one died, Todd had to change from democrat to republican. A lot of people didn't like him changing parties. A lot of people also think he will go back to being a democrat for the up coming election. I don't know, but I do know that the election is going to be a tough one and so he is going to do everything he can to try to make sure he stays sheriff. There are a lot of people that do not like him, so it may be a hard task. Anyway, I'm not trying to put him down, just letting you all know the situation. So, I was thinking maybe he (Todd) will do everything he can to try to make an example out of the killers so that it will look better on him when election time comes up. I think all the people that are up for re-election and have anything to do with the case are going to try to make an example because of the election coming up soon. Maybe it is a good thing that the election is coming up soon.

When I was a teen I babysit for a little boy. My mom was friends with his mom. I lived in a small town, everyone knew everyone. The boy grew to be a nice young man. That young man got on drugs in his upper teens and killed an old lady. If I were ever asked what I thought of him before he killed her I would say the same as many are saying over there, he is a good kid. So, I understand why some are saying he was a good kid.
I don't know if it's true N. was on drugs or if that is speculation. Either way, he committed a brutal crime and he should pay according to the law.

My mother and sister live in St. Clair County so Blake's case was of particular interest to me. I am so sorry for his family.

I live right at the edge of Etowah and Marshall county....Not quite in Sardis, but right on the line. Do you live close to Smith's Institute? I went to school at Sardis, so when I heard that he had went missing I followed the news on it. I didn't know there were these forums until after they had found his body...When I got on the Gadsden Times forum, I couldn't believe how all those people were accusing Lynn. I don't know her, but I think her getting out and searching like she did proves that she cared for Blake and is a good person. The first time I heard about Lynn was from my cousin that goes to Sardis who is a little older than Blake and she was telling me how a lot of the kids at school thought it was the step mother and I asked why. She said there were all these stories going around about a taser gun ect. I said that is rediculous! I know that in a lot of cases of missing children it is someone close to them that did something to them, but you could just tell from Lynn's posts that she wasn't like that. Also the stories were so far fetched that you knew they weren't true. I just hope that everyone will back off of her (Lynn) now and stop talking about her and saying she was mean to him. You can tell she loved that child. I kind of knew the birth mother. Well, let me re-phrase that. My father used to be on meth and he has been clean for 5 years now. However, years ago when he was on it, he was dating this girl and she was friends with the birth mother. I don't think I ever spoke to the birth mother, but I did know her in passing. From what I knew of her, which has already been posted, so I'm not trying to put her down or anything or air her dirty laundry, but from what I knew of her she used to be on drugs and had a bad life. Someone else said she was in and out of jail, I didn't know that. What I do remember is someone saying she had a chemical imbalance. I know some have put her down and abandoning her children was horrible, but I just wonder if that is the reason for some of her bad behavior? I'm not trying to defend her, just wondering. I hadn't saw anyone else mention the chemical imbalance. She may not even have one, but that is just what I was told by my father's ex girlfriend. Anyway, whatever the situation I just want to say that Lynn was a wonderful person for stepping up and taking over as the mom. I'm also glad they filed a wrongful death suit. As for the forum, it was hard reading some of those people's comments defending the killers. I do want to add that not all of their friends are defending them, but there are a handful, and most of them are defending Andrew Smiley. They seem to be putting all the blame on Nathan Lee, but personally I believe they are both equally quilty. Even if what the fiance says is somewhat true and Nathan is the one that shot the boy. Andrew should of went directly to the police, but he didn't he helped hide the body and cover the crime and said nothing for months. That made him an accessory. Now, that is just going by what she said and I'm being hypothetical. For all I know they could of both shot him? It is one of the worst crimes I have seen in this area, if not the worst in along time. A few years ago, there was a guy, that was going around to different churches in the area and befriending families that had young sons and was then taking those boys on camping trips ect. and molesting them. He (child molester) was from St. Clair Co. and he was on disablility and pretty much spent all his time molesting boys from all the surrounding counties (Etowah, Marshall, Dekalb, St. Clair). He would even go out of state and find boys. When it all came out there were a lot and I mean a lot of boys that he had molested. What he had done to them was just horrible. It wasn't all over the news or alteast I don't remember it being, but it was one of the most horrific crimes that I remember in this area until this. The thing is that everyone was saying how they were shocked that the guy was a child molester. He was clean cut, decent looking, in his thirties, and seemed nice. He wasn't the child molester you see in movies that is over weight and older. What people were saying about him is the same thing they are saying about these killers. Which is, he/they didn't seem like that type of person. My point in bringing up this case is , sometimes the people you would least expect are the worst. People that were friends of the two killers are having a hard time when realizing they were hanging out with murderers. I don't mind the friends that are in shock, but the friends that keep proclaiming their innocense are the ones that I have a problem with. Sorry, I kept babbling about this, but it just upsets me so badly. Also, to whoever asked I do believe that Nathan is an only son.

Do you know how long Nathan's father has been dead and who took care of Nathan after he passed? As I understand it his mother is in a home care facility.
Thank you, from what I have read it seems Nathan's father died around 3 years ago from liver cancer. He was the company doctor at Good Year before he died. Someone said that after Nathan's dad died that Nathan's mother came and got him, and blocked any contact with Nathan's friends and family. For some reason or another, Nathan and his mom went to court, and the judge said that Nathan was of legal age, and his mom could not keep him, and that he was old enough to attain responsibility of the property. His mom thought that if she had Nathan, the property would go to her.
The other person also said that Dr. Lee worshiped the ground that Nathan walked on and would be so heart broken to know that Nathan did this. Here are some more things about Nathan that people have posted on the other forum: he had a party at his house the weekend before the body was found. He wrecked his truck (supposedly a couple of days after the murder) , flipped it end over end and only ended up with a few scratches. He was in the ER for less than 24 hours. Went out partying during the 3 months after he killed Blake. Has a real quick temper.(according to a blogger) Friday night, a couple of days before the body was found, had a bachelor party at his house. A friend said that everytime they asked Lee about Blake he would lie and say " I bet he ran away from his stepmom".(all of this is just thing that friends of his have posted on other forums)...
Also the lady that everyone had originally thought was found in Lee's pond a few years ago, was actually found at the end of littleton rd close to 431 on another person's property and they caught the people that did it.

I've known both of these guys for years and years. Right now I'm so hurt and angry with Nathan, but I still have sympathy for him. Nathan has suffered a great deal of his life. As I said before, you are a product of your environment. You can't be treated as nothing and then expect to think any higher of anyone else. And that is exactly how he was treated by most people in his life. Etowah High School is notorious for ridicule and harassment. Nathan was always so jolly despite anything that might be going on. He was picked on for being kind of a doof and awkward.
As far as Andrew, I remember there being a much bigger drug problem than smoking pot even when he was in 9th grade. I first hand had to deal with attitude from him bc he was trying to get a friend to sell a couple of her RX pain medications to him in Chorus. He called her, and I quote, a " fat ***** ". Andrew and Nathan were friends in high school also. Something that VERY little people know. Why? Bc Nathan wasn't popular, Nathan didn't get along easily with the girls, and frankly Nathan was a nerd. Andrew strived to be on the more popular side of things.
So that alone gives me reasonable cause to believe that this isn't something that Nathan just said " Ok " to. Nathan, was goofy, a little strange and awkward, but sweet and a VERY loyal friend. I'm aware that I haven't talked to him in a couple of years and his life could have drastically changed, as most of our's have. I just know that the person they're making him out to be in the news is not the person I know first hand. As many other's who do know him have said on this post.
I'm also not trying to speak badly about Andrew Smiley. I'm simply stating truth..--------------------------------------------------------------------------------
I put up the dotted lines so that you would know where the post of the other person began and ended. It is not my post, it is one of the two murderers friends post, I am just reposting it for you all to read.
As for Andrew, these are some things people posted about him on the other forum: Some say he was raised by a great family, some say he wasn't. Some say his mother had at one time been on crystal meth and lost her contract with Nascar, would let Andrew have parties and buy alcohol for Andrew in his friends when they were underaged, and was rumored to of slept with some of Andrew's friends. (Please don't attack me for posting this, I am just passing along what other people have posted...) His mother and father's names are Sandra and Troy and they are in the process of trying to sell their home..He has a brother named Jason, a grandfather named Ted who is a retired law man. He has a fiance named Britany who is sticking by his side through this. She keeps posting comments proclaiming his innocence and how much she loves him on the GT forums. Her name on there is livefreeats (ats=andrew troy smiley) and when someone called her out on being his fiance, therefor making her bias, she lied and said she wasn't his fiance. However, then Andrew's aunt posted and was thanking her for her support and called her Brittany which is Andrew's fiance's name according to another board member. Although, he seems to have a fiance now, a girl posted that 4 months ago he came to her sister's house and tried to get her to leave with him and go get drunk. She said he begged her for twenty mins. to get in the car with him. She said she didn't even really know him at the time and he was already trying to get her to leave with him. Someone said he did crystal occasionally, someone else that lived down the road from him said he was addicted to it, and others said that he didn't do anything but smoke a little pot. Another friend of his said he was the type of person that would cry if someone got hurt or was being made fun of. Also, went out partying during the 3 months after Blake was killed, someone said they saw him partying during the Memorial Day weekend. Has a real quick temper.(according to blogger)...At some point he lived in Arkansas.

People change, and whatever they were as children, or whatever kind of childhood they had... I'm sorry, but that doesn't excuse what they did to this 15 year old child.
Lynn and I have been emailing for quite some time, since he first went missing, and I know the devastation this family has felt under a silly cloud of suspicion.
Someone here mentioned knowing Blake's bio mom, Jeanine, and the Stone's were really hoping that Blake was with her. Had several sightings, but of course, none panned out. Their PI even checked out her family in GA.
I do hope the election this year prompts this sheriff to do all he can to help Senator Means get the victim age raised to 15 , and that they can somehow grandfather it back so that Nathan and Andrew are both eligible for a capital murder charge. If any case ever cried out for it, it's this one.

6. Cannabis is a plant that should be legal to own and produce. Crime rates will lower dramatically across the U.S, people will benefit from the advantages of it's medicinal properties, hemp (a product made from Cannabis) would be used in hundreds of different applications such as the making of clothes, and thousands of new jobs will be formed due to increased production.
7. Abortion is a medical procedure that should be used for just that, an EMERGENCY medical procedure. The fact that an entire population of people can condone the death of millions of unborn humans is beyond my comprehension, especially in the 21st century.

12. I'm a lover not a fighter. Though, I will do anything neccessary to defend myself or my loved ones. That includes maceing or shooting you (depending on what I have on my person at the time) so please, do not try to invoke physical conflict with me, I will simply respond with either of the defense methods above.

I agree, I also wanted to let everyone know that I hope these two killers get the death penalty. I am in no way defending them, I just reposted what their friends had posted on the GT forums because someone asked about Nathan's mother. It took me hours to go through every page on the Gadsden times forums and sift through all the info that had been posted and find what their friends had to say about them.

I just know that the person they're making him out to be in the news is not the person I know first hand. As many other's who do know him have said on this post.
I'm also not trying to speak badly about Andrew Smiley. I'm simply stating truth..--------------------------------------------------------------------------------
I put up the dotted lines so that you would know where the post of the other person began and ended. It is not my post, it is one of the two murderers friends post, I am just reposting it for you all to read.
As for Andrew, these are some things people posted about him on the other forum: Some say he was raised by a great family, some say he wasn't. Some say his mother had at one time been on crystal meth and lost her contract with Nascar, would let Andrew have parties and buy alcohol for Andrew in his friends when they were underaged, and was rumored to of slept with some of Andrew's friends. (Please don't attack me for posting this, I am just passing along what other people have posted...) His mother and father's names are Sandra and Troy and they are in the process of trying to sell their home..He has a brother named Jason, a grandfather named Ted who is a retired law man. He has a fiance named Britany who is sticking by his side through this. She keeps posting comments proclaiming his innocence and how much she loves him on the GT forums. Her name on there is livefreeats (ats=andrew troy smiley) and when someone called her out on being his fiance, therefor making her bias, she lied and said she wasn't his fiance. However, then Andrew's aunt posted and was thanking her for her support and called her Brittany which is Andrew's fiance's name according to another board member. Although, he seems to have a fiance now, a girl posted that 4 months ago he came to her sister's house and tried to get her to leave with him and go get drunk. She said he begged her for twenty mins. to get in the car with him. She said she didn't even really know him at the time and he was already trying to get her to leave with him. Someone said he did crystal occasionally, someone else that lived down the road from him said he was addicted to it, and others said that he didn't do anything but smoke a little pot. Another friend of his said he was the type of person that would cry if someone got hurt or was being made fun of. Also, went out partying during the 3 months after Blake was killed, someone said they saw him partying during the Memorial Day weekend. Has a real quick temper.(according to blogger)...At some point he lived in Arkansas.

I finished reading that whole thing this afternoon. It amazes me how many people just don't see that AS did anything wrong. Those that did excused his actions by saying he was threatend by N with the gun. No matter how you slice it, they took the life of a young man who hadn't even started living his life. They themselves are considered men and should be held accountable for their actions. If AS had of went immediately to the police instead of waiting 3 months then maybe things for him should be different but that he waited, he's as guilty as if he pulled the trigger himself.
A good Prosecutor should find a way around this and make sure the get the death penalty.

If he was sooooooo scared then why didn't he go directly to the police when he got away from Nathan and tell them what happened? They'd of put Nathan in jail and he wouldn't of had to be scared anymore. I think the more logical explanation is that he (Smiley) knew they were closing in on them and he thought if he turned himself in and told what happened that he'd get a better deal. THAT FACT THAT HIS FIANCE CONSIDERS RIDING BY BLAKE'S SHALLOW GRAVE EVERYDAY SHOWING RESPECT FOR BLAKE SCARES ME. IT'S LIKE SHE THINKS LIKE HE DOES, SHE ACT LIKE WHAT HE DID IS NO BIG DEAL. She likens him to murderers, child rapist ect that have got off easy, and says why shouldn't he (Smiley) get off just as easy as they did..Just because they got off easy doesn't mean he will or should. GADSDEN, Ala. --- The family of a 15 year old murdered Attalla teen has filed a wrongful death lawsuit against the two suspects in the case.
Jeffrey Blake Stone was killed on March 24th in the Littleton community.
Investigators say they found his body in a freezer in July 1st.
19 year old Nathan Lee and 22 year old Andrew Smiley are charged with Stone’s death.
Now Stone’s father has filed a wrongful death lawsuit against the two suspects.
In the lawsuit, Stone claims the two suspects shot his son numerous times resulting in his death.
The father is citing “mental anguish and emotional distress” because of his son’s murder.
Stone is asking a judge to award him more than $10,000 in monetary and punitive damages.

Stone's father files wrongful death suit

The father of 15-year-old Jeffrey Blake Stone has filed a wrongful death suit against two men charged with murder in the Sardis student's death.
The suit was filed July 3 and signed by the teen's father, Jeff Stone.
The suit asks for a judgment against Nathaniel Lee and Troy Andrew Smiley, charged July 2 with the death of Jeffrey Blake Stone, whose body was discovered July 1 in a freezer at Lee's house on Littleton Cutoff Road.
The Alabama Department of Forensic Sciences has positively identified the remains as the teen, missing since March 24.
Stone was shot numerous times, according to the suit.
The suit asks for a monetary judgment, in excess of $10,000, for the loss of companionship and the mental anguish and emotional distress suffered because of the death of Jeffrey Blake Stone.
Nathaniel Wayne Lee, 19, 1176 Littleton Cutoff Road, and Troy Andrew Smiley, 22, 1084 Anna Drive, both near Attalla, were charged with murder.
Stone, 15, a student at Sardis High School, often visited at Lee's home about a quarter-mile from his own.
Investigators now believe Stone left his home and went to Lee's house - a large brick home on more than 100 acres that Lee inherited after his father's death a few years ago.
Lee lived there alone, but Smiley often stayed over.
Sheriff Todd Entrekin said Lee and Smiley were close friends.
Entrekin said the two planned the murder for weeks and killed Stone "for the thrill of it."
Investigators got a tip July 1 that led to a shallow grave on a logging road just off Rocky Hollow Road near Gallant.
There was evidence at the shallow grave that led to a search warrant at Lee's house and the discovery of Stone's remains.
Entrekin said Stone was killed in the woods behind the house and then initially buried at the area on Rocky Hollow Road, about 12 miles away.
Entrekin said Stone's remains were moved from the grave a couple of weeks ago and placed in the chest-type freezer.
Lee and Smiley remain in the Etowah County jail without bond.

I found her ramblings a bit much. Riding by the gravesite to "pay respect" BS plain and simple. IMO he was just looking to make sure everyting was still as he left it. He's just a guilty imo as Nathan. They both deserve No bail and the death penalty. The controvery over capital punishment is ridiculious. The only problem I have grappled with over the years is the death penalty is final which is fine. LWP leaves them to sit and comtemplate their actions and hopefully compound their guilt but not all people have/show remorse so in actuality they sit for life fed, clothed and housed on the taxpayers expense. Too bad we couln't torture people. (did I say that?).

The reason they're doing the civil suit is Jeff would like to own Nathan's place and destroy it all because of what happened to his son there. Lynn, on the other hand, would like to see it rebuilt as a ranch for autistic children in honor of Blake.

This is Lynn Stone. I've been following this whole thread from the beginning and appreciate all the words of comfort and support more than words can express. Roamer and Faith have been wonderful in aiding me in research and serving as a sounding board for theories, suspicions, and, most importantly, walking me through the roller coaster of emotions of the past 4 months. I believe God put them here for me. They were my backbone when I was ready to cave. Roamer endured my middle-of-the-night emails and never faltered in a loving response.
There are so many things that have been said and done since Blake left the house but I will reserve that story for a future date. It's just too exhausting to re-live as we try to recover.
Right now, though, we are moving into the legal issues of the murder of our son. It was brutal to the senses when the s.o took us to the so-called 'shallow grave' and then, later, read me the description of the autopsy pictures and reviewed with me the step-by-step movements through the killing. Those images will never leave my mind. But for Blake's sake, we will push forward to see that no one is so endangered again. Therefore, I am posting a request. The DA told us that we should use a 'phone tree' to notify family and friends about any scheduled hearings for either of these two men. I was notified that Andrew Smiley's family has retained an out-of-town attorney, foregoing the court-appointed one, and this attorney has requested a bond hearing for Smiley to be held on Tuesday, 22 July, at 4pm in Judge Owen's courtroom in the Etowah County Judicial Building on Forrest Av in Gadsden. The attorney, John Barry of Cullman, is requesting a bond of 'between $15,000 and $75,000.' I am asking that any local members who are concerned about the possibility of letting Smiley out of jail - especially for such a low bond amount - be in the courtroom to support us as we protest his freedom to walk our neighborhood. And, to be fair, I think he needs protection from all the vigilante-types who have threatened him. After all, I would like to see him stand trial. Little would be resolved otherwise, as he knows what happened the day Blake left home to hang out with his 'friends.' Thank you to all of you on this site. Lynn.

Bond set for one of suspects in teenager's slaying

Etowah County District Attorney Jimmie Harp said a $142,500 bond set late this afternoon by District Judge Wayne Owen for one of the men accused of killing a 15-year-old Sardis student was “way too low.”
Owen set the bond for Andrew Smiley, 22, of Ivalee, one of two men charged with the murder of Jeffrey Blake Stone, whose body was found July 2 in the freezer of Nathaniel Lee, 19, of Littleton Cutoff Road.
Lee also has been charged with murder, but Lee’s attorney has not requested a bond hearing.
Smiley was not at the bond hearing.
The bond set by Owen could be met either with property pledged or cash. As part of the bond, Owen said, Smiley is to report to a community corrections program and to report back weekly and is not to travel out of state without court permission and not to change his living address without notification.
Smiley’s attorney, Johnny Berry of Cullman, declined to comment after the hearing concerning Smiley’s possible release.
At the hearing Smiley’s father, Troy Smiley, testified he would assure the court that his son would show up for any court appearances and would abide by any conditions of the bond. He said he would put up his property to meet bond requirements and that other members of the community have said they would also.
He said his son did not appear suicidal but has been treated for depression since high school. He said his son had never been charged with a violent crime before. He said his son would not be a threat to himself or the public at large.
Troy Smiley said someone with the family would be with his son at the family residence at all times.
Harp pointed out in his cross examination that was where Smiley was living when Stone was killed.
During the hearing, Harp told Owen that the case was not a capital murder case and the court had to set a bond, but that Smiley was a “significant threat” to the community.
In the hearing, Harp questioned Etowah County Sheriff’s Department investigator Jeff Hopper, who testified he had interviewed Andrew Smiley.
Hopper said Smiley had not shown any remorse for his actions.
Hopper said that during the interview Smiley said suicidal thoughts had crossed his mind. Hopper said at one time Smiley said “to go ahead and shoot” him. He said during the interview that Smiley said he and Lee had planned the slaying for about a month.
Hopper said he felt Smiley was a danger to the community.
“I think the bond is not a sufficient amount,” Harp said after the hearing. “I think a $142,500 property bond is way too low. We were hoping for a very significant cash bond and I think this is a case that warranted such.”
Harp said there are drug cases or robbery cases have cash bond set and he didn’t think the bond was “a reasonable one on behalf of the community.”
Harp said when the case comes out of grand jury that a circuit judge could set bond if there is an indictment.
The case could go to the grand jury in September, Harp said.
Harp said the bond should be higher, not because of the community outcry over the slaying, but because of the threat to the community.
“You’re talking about a guy that planned a homicide for 30 days,” Harp said.

It was a surprise decision today as Judge Wayne Owen set a property bond at $142,500. According to the thirty or so family friends of the late Jeffrey Stone, that's much too low. The group sat in the courtroom as the father of Andrew Smiley appeared on the stand. He agreed to house his son until trial. It's the same house where Smiley lived on March 24th - the day he's accused of killing Stone.
During the bond hearing new facts about Stone's death were revealed. He was allegedly shot several times by Nathanial Lee. It happened in Lee's back yard as Smiely watched. It was also revealed that Smiely is the person who told detectives where the body was buried and that it was moved in to a freezer.
Stone's stepmother spoke exclusively with ABC 33/40 after bond was set. She's outraged he'll return to her own neighborhood. She says "$142,000 dollar bond to let my son's killer out on the property? Out on the land, out in our community when my thirteen year old son is anxious for his own safety? When other people are saying they are wanting to hide their children... 142 thousand dollars?"
So far Nathanial Lee, the other man facing murder charges, has not requested bond.
According to District Attorney Jimmie Harp this case will go before the Alabama Grand Jury in September. It will probably go to trial in the Spring.

Smiley, 22, of Ivalee, is one of two men charged with murder in the slaying of Jeffrey Blake Stone, 15, whose body was found July 2 in the freezer of Nathaniel Lee, 19, of Littleton Cutoff Road.
Lee also has been charged with murder, but Lee’s attorney has not requested a bond hearing.
Smiley’s property bond of $142,500 for the murder charge was signed by one property owner, according to jail records.
District Judge Wayne Owen set the bond in a hearing Tuesday afternoon. As part of the bond, Smiley is to report to a community corrections program, report back weekly and is not to travel out of state without court permission or change his living address without notification. It is unclear if the warrant from Lee County will impact the conditions of Smiley’s bond.
Etowah County jail officials received the Lee County warrant with no bond available.
The warrant is for a probation violation on a charge of unlawful possession of drug paraphernalia, a misdemeanor. He was originally arrested by Opelika police on the drug charge and was apparently released on probation. Details of the probation violation and arrest were not available.
During Tuesday’s hearing, District Attorney Jimmie Harp told Owen that the case was not a capital murder case and the court had to set a bond, but that Smiley was a “significant threat” to the community.
Stone was reported missing March 24. His body was discovered July 1 in a freezer at Lee’s house on Littleton Cutoff Road.
Stone often visited at Lee’s home about a quarter-mile from his own.
Investigators said they believe Stone left his home and went to Lee’s home, a large brick house on more than 100 acres that Lee inherited after his father’s death a few years ago.
Lee lived there alone, but Smiley often stayed over.
Investigators got a tip July 1 that led to a shallow grave on a logging road just off Rocky Hollow Road near Gallant.
There was evidence at the shallow grave that led to a search warrant at Lee’s house and the discovery of Stone’s remains, authorities said.
It is believed Stone was killed in the woods behind the house and then initially buried at the area on Rocky Hollow Road, about 12 miles away. Stone’s remains were moved from the grave a couple of weeks before the remains were discovered in the chest-type freezer, authorities said.

I wasn't sure about Pauli's question, but in this article, the DA said since it wasn't a capital murder case (it should be) they had to set bond, but even he thinks Smiley is a threat to the community.

Let me repeat, MY NAME IS JEFFREY T.STONE, FATHER OF SLAIN SON JEFFERY BLAKE STONE. Let me say thanks to all the people who have offered sympathy and prayers, and to people with voices of reason (Powell, Hatch, IM4CNS, and the like). As you know we have chosen not to be in the media much, and have only responded a few times to the forums. Most of our time, since Blake was “discovered,” had been spent with private investigators, LE, funeral homes, and lawyers. Before that, we spent 24/7 on the “search.” But, we have been very much monitoring all forums here and elsewhere through family and friends since the day Blake disappeared. I enter this letter to this forum as a first in many to come. One, to discuss my thoughts, feelings and to address some issues that we have noted and, two, to set the record straight. By the way, I’m speaking now. First, there once was a statement in the original Sardis forum by Brazen, if I recall, that asked the question, Why doesn’t the father speak up? Why is the stepmother in control? As well as others like Gentle Reader and SWP who had the statements about my wife. Like SWP who said she would run and hide too. The only people who ever have to hide from my wife are those who don’t “do the right thing” in life. Or to the “gut feeling” guy who was sure she had something to do with all this. First, let me inform you of my wife! She is a very educated and competent woman 2) a very caring individual 3) an ethical and professional woman who on countless times and all hours of the day and night as a community mental health officer (working for free as this is not a paid position ) has gone out to help people and families in need and to insure the moral, legal, ethical, and emotional needs are met for people. A person who has dedicated her life to help those in need, even people like you who have accused her .And by the way, gut guy , I have a gut feeling too. but it’s the Mexican food I ate last night. but that will come out in a little while!! She has been a very dedicated mother to my children, enforcing love, ethics, and moral character so they would become productive members of society. She did this without any corporal punishment of any kind - ever! I know she had a hard road on this as they are and were becoming teenagers. She has been my support through all this. She is my life partner and I do and will always love her.
I have seen statements about Smiley to the effect that “he drove by to pay his respects to Jeffrey Blake,” and “what he did was not as bad as Nathan, he shouldn’t have to pay for Nathan’s action”. Now let me point out a statement from the paper: Blake was buried in a “shallow grave.” Now let’s look at those two words, shallow and grave. First , Shallow: “not deep, having little depth,” and now Grave: “a hole in the ground which to bury a dead body; a burial mound or monument” [Webster‘s New 20th Century Dictionary Unabridged]. I have been to that site more than 300 times within two weeks after July 1st , my count now I have no idea any more . But my question to (you Smiley supporters) is have you or any others been to Blake’s first “GRAVE’ site? And you say that he was not driving by to check on the body , only to pay his respects. Let me say - get out of Smiley’s dope. Let me first explain. This (GRAVE) is about 5 feet long ,10 inches deep and possibly 18 to 20 inches wide at the widest point. HEAR THIS LOUD AND CLEAR!!!!!!!!!!!!!!THIS IS AFTER HE HAD BEEN MOVED AND AFTER WHAT LOOKED LIKE THE CRIME LAB DIGGING UP THE AREA, AS SEEN BY THE FRESH SHOVEL MARKS!! REPEAT: AFTER!!!!!! Now, as to what he was covered with. lets see, the only objects around the site were a couple of rocks, old thrown out tires and some sticks. So the way it looks he was just thrown on the ground and covered with trash - with @#$%^&* TRASH….. So what on God’s green earth constitutes a (SHALLOW)(GRAVE)????????? So yes , Livefreeats, I do see your point that he was paying his “Respects” to our son!!!!!!! Now, let me ask a question to all of Smiley’s supporters. In a community this small , with emotions this high and hatred this deep, “Do you think there will be peace in the valley?” I do think that’s a fair and valid question . I think certain people should have thought this through more thoroughly.
As to the bond hearing , liberty and INJUSTICE for all…. 142,500.00 property bond? Liberty for Smiley, injustice for Jeffrey Blake. But let me think through this 1) HE gets his pay check from the tax payers so what does HE care, 2) HE does not live in this community, 3) It was not HIS child murdered in cold blood . My personal opinion is that HE is in contempt of justice, moral fortitude, and sound thinking.
Let me see, about Smiley, what I heard at the bond hearing was they planned to commit a murder a month in advance then narrowed the target down to our son. is this 30 days of only planning or coming up with the idea? Or if only planning the crime, how long on coming up with the idea ? how long on just talking before you start to set the plan in motion? Also, his father said he will be at home and watched. Let me get this right. The same people set to watch him now that were around him on feb 2008, in march 2008, oh and back around him in Sept 2007, you know - when the felony charge was pled down. So the son will have the same people calling him, his same friends coming over. you know, the ones he would get high with and drink with . The same room in which he had ideas of killing our child, driving the same vehicle which he did all the time after he KILLED our child. .I also heard that he used to be treated for depression. Let me add 2 + 2. The same people supposed to watch him now are the ones who said he used to have depression but didn’t notice that he was taking depressants (morphine weed and alcohol ).
Lets see, his lawyer had said he had never had violent crime before. Is not the prison system filled with people that started out with petty crimes and moved up to bigger crimes? You know MURDER ,rape and so on . I have also heard from Livefreeats that what he did was not as bad as what Nathan did!!!!!!!!!! So if he and Nathan had committed rape but he only held a girl down and nothing else, would that be just as bad?????????????????
Lets look at the facts, 1) he has a record 2) he helped plan a MURDER 3) he helped COMMIT MURDER 4) he helped COVER UP A MURDER 5) he OBSTRUCTED JUSTICE by not telling of THE MURDER 6) he helped move JEFFERY BLAKE’S BODY because it might be found. 7) HE CONFESSED.
This does not even come close to what I want and plan to write as I said this is number 1. more elaboration and thoughts to come. My opinion of what should happen to both of them REPEAT BOTH: I think they need to end up like Hoffa in cans of dog food.

update: Etowah County grand jury hearing for both lee and smiley on Sept 3. smiley's atty has put in a motion to appear before the judge in Lee County to protest smiley's bond revocation. Hearing scheduled for Sept 4.
We currently are distributing and collecting two affidavits: the first is for Etowah County residents requesting that, as these two people pose a danger to self and the county at large if released, they be denied any amount of property bond that might potentiate their release before trial. The second is for residents of AL in support of Sen. Means intentions, requesting that the State Legislature amend and/or expand the requirements for capital murder to include premeditation, laying in wait, and raising the age limits for murder victims. It also includes a request that Blake's case be 'grandfathered' in, as this case should set precedence for the rights of victims and need for expansion of the law. If any of this forum's readers meet the qualification as residents, please consider signing these affidavits and mailing them to us as well as any you might be able to collect from family or friends. I can send a copy to your email address if you will request this from me at: lynnala@intergate.com.
We are not asking that people view this statewide appeal as a request for the death penalty but, at least, for life without parole. That is, without this amendment, Blake's murderers could be eligible for parole in as little as 10 years. To me, this is an egregious travesty of justice, as these two men will be in their early 30's, able to carry on with their "life and liberty" while Blake was denied that same by them - on purpose, to 'get a rush.'
As AL law stands, if a child is murdered at 12:01am on the morning of their 14th birthday, the accused can be charged only with murder one, not capital murder, even if the killer planned - for whatever reason - to kill that child for weeks, months, or years, and then just waited for that child to cross their property. While I question why there has to be an age limit at all [what if it had been the 88yo woman across the road?], the D.A. says 'we have to start somewhere.'

Smiley was arrested in September 2007 after a traffic stop by Auburn police and was charged with possession of morphine.
He pleaded guilty June 13 to a lesser drug charge and was give a year’s probation, ordered to pay a $500 fine and to attend a court referral drug program.
At the hearing, evidence was presented to Circuit Judge John Denson by Etowah County Sheriff Department’s Investigator Jeff Hopper concerning the slaying in Etowah County, Abbett said.
Smiley remains in jail in Lee County and Denson took the case under advisement. Denson gave Smiley’s attorney and Abbett seven days to file briefs before issuing a ruling, Abbett said.
Abbett said he will argue in his brief that Smiley’s probation should be revoked or either reconsidered and denied.
A $142,000 property bond had been signed July 23 on Smiley in Etowah County that would have allowed Smiley to be released, but Lee County filed a probation violation notification. Smiley, rather than being released, was transferred to Lee County for the hearing.
Etowah County District Attorney Jimmie Harp said last month when Smiley was transferred to Lee County for the hearing he hoped Smiley would be kept in jail in Lee County until the slaying case can go before the grand jury here.

At a hearing Thursday, Lee County Circuit Judge John Denson allowed seven days for motions to be filed before ruling on the probation revocation.

Attorneys for Lee did not seek bond initially, but a $142,500 property bond was set for Smiley. As he was about to be released from jail in Etowah County on bond, Lee County officials filed a probation violation notification against Smiley in connection with a conviction in June for possession of drug paraphernalia.
Smiley was arrested Sept. 8, 2007, after a traffic stop by the Auburn Police Department and morphine pills were found on him. Smiley was charged with possession of morphine, but he was allowed to plead guilty to the misdemeanor drug paraphernalia charge in June — before he was charged in Etowah County with murder. He was given a year’s probation, ordered to pay a $500 fine and ordered to attend a court referral drug program.
When Lee County officials found out about the murder charge, bond was revoked.
Smiley was serving his sentence and was about to get out of jail in Lee County on an appeal bond when he was re-arrested on indictment Thursday.
Harp said trials for Smiley and Lee could be sometime next year.
Sen. Larry Means, D-Attalla, has said he will seek to raise the age limit of murder victims for capital murder to 18 years old. State law says that murder of a child younger than 14 can be a capital crime, which could include the death penalty as punishment.

A concert is planned to celebrate the life of Jeffrey Blake Stone, a 15-year-old Sardis High student who was slain early this year.
Stone was reported missing March 24 and his family and others searched for him for 14 weeks, in which time their lives were put on hold.
On July 1, the search ended when Stone’s remains were discovered in a neighbor’s freezer.
The idea for the concert came from a Guntersville-based band, Wasted Mason, of whom Stone was a fan.
The band contacted the family to encourage them to lean on their community for support.
“(The) family has been victims of an unbelievable crime, and we have faith that they will persevere in time and with the help of the good in the community ... it will take some time and effort from everyone to put this together, but it will be a labor of love for all of us,” said a representative of Wasted Mason.
The concert is from 1 p.m. to 9 p.m. Sunday at Convention Hall, 344 S. First St., Gadsden.
The headliner is Jeff Cook and the Allstar Goodtime Band
Cook was a member of the country music super group Alabama of Fort Payne.
Other performances will be a group from Sardis High School, Wasted Mason and the Wayne Mills Band.
There will be displays from local businesses, merchandise from each band and an auction before the final performance.
The concert is an opportunity for the community to come together for something positive in the spirit of fun.
“This event is not meant to dwell on hardships, but to allow everyone to move forward and restore balance,” one of the coordinators said.
Lynn Stone, Blake Stone’s stepmother, said the family is thankful for those who want to do something to support their family.
“The unending searching broke us in more ways than one,” she said. “It’s been people such as these musicians who have begun to restore my faith in the depths of goodness that I always believed was inherent.”

There's a hearing tomorrow morning, 12 Dec 08, for reducing the bond of Smiley so that he can be released to his parents who allowed him to keep marijuana in their refrigerator. There's also a hearing for Nathan on Monday, 15 Dec 008, to grant him 'youthful offender' status. From neighbors, I have heard that Smiley's mother plans on taking him 'somewhere else' so that her 'baby boy' will not have to go back to jail. There's a hearing tomorrow morning, 12 Dec 08, for reducing the bond of Smiley so that he can be released to his parents who allowed him to keep marijuana in their refrigerator. There's also a hearing for Nathan on Monday, 15 Dec 008, to grant him 'youthful offender' status. From neighbors, I have heard that Smiley's mother plans on taking him 'somewhere else' so that her 'baby boy' will not have to go back to jail. at smiley's hearing yesterday, his attys presented an obscure law that has never had cases (precedent) for using it (AL rules of criminal procedure, rule 7.6).
basically, the bond set down at his initial appearance (with judge owen) - the $142,500 property bond - is to be transferred to the same charge prosecuted by indictment...'unless, for good cause, the judge shall order revocation or modification of the conditions of release....' this means, of course, that smiley would have no further bond applied to him, negating the $250,000 cash bond set down after the indictment. owen really messed us up.
judge kimberly granted the d.a. 5 days to file a brief in respoonse.
jeff had taken 3 vacation days from work this week to attend the hearings but the y.o. hearing for nathan was changed to monday, the 15th, and he cannot attend. we need to have a presence, even if only by writing to judge hall, to underscore the need to deny y.o. status to nathan. we're working on presenting the relevant issues in hopes that the judge will consider them and deny such status.
andy doesn't want to stay in our home if either of them is out. and, as neighbors have pointed out, since blake's murder no children are out on the streets in our area anymore. so sad.
thank you all so much for your support. it means so much to us as we have pretty much isolated ourselves from the public community. the profound impact of these two men's actions has decimated our lives as we knew it, no matter how 'normally' we try to live them. your site is the only one in which i feel comfortable sharing. i thank you all, not just for 'being there,' but just for being. jeff and i are strongly committed to 'having each other's backs' and dealing with all the emotional issues that arise in a family wherein one feels 'victimized'...a helpless position...so we do all we can to respond with action that moves us out of that place. that's why it's so important to us to know we're not 'going it alone.'
i quit my new job b/c i just felt unable to focus and could not bear the negative energies coming in from that environment, so felt i was doing a disservice to the role. with the help of a wonderful therapist in b'ham, i've been 'processing,' which helps in the 'cure.' the past nine months have felt much like being in a movie theater, watching a really bad movie - and the exit doors are locked!
i know,too, i've been negligent in keeping up my communication with Roamer, and i feel vey badly about that. i can only beg forgiveness of the woman who has been so strong for me throughout this trauma. and i do promise that i will do all i can to give back to her when my energies are restored.
the strongest, most poignant lesson i personally have learned is this: 'a real friend walks in when the rest of the world walks out.' you all have been real friends. that counts more than words here can express. thank you.

the hearing is at 1pm in judge hall's courtroom on the second floor of the judicial building. since it's for y.o. status, we don't know if they'll allow the public into the hearing, because, if y.o. status is granted, the case would then be sealed as a juvie case. however, imho, until, and if, that status is granted, it should still be open to the public. but, alas, i don't run the courthouse so i don't know what they'll do. from what i understand, it also may be possible to submit written letters to the judge before the hearing for his consideration as to the concerns from the community surrounding such a grant.
we can't argue that the charge of murder is sufficient. but - the alleged circumstances surrounding the murder and their heinous nature can be argued, i.e., it was premeditated, cold-blooded, done for a 'rush,' he 'laid in wait' for blake's next visit, lured blake to the murder site on his property under false pretenses, etc. for pete's sake, he kept blake's body in his freezer and then had parties in the house afterward!
the purpose of the y.o. law is the consideration that the perp can be 'rehabilitated.' the circumstances of the murder would seem to argue against any possible rehabilitation.
also, nathan was 19 at the time, had already entered into a lawsuit against his trustees as a 'responsible adult' - by his own argument - six months prior to the murder. i'm assuming his psych eval must have already indicated he is competent and sane, knows right from wrong, for the d.a. to proceed as he is.
if you've ever read his blog on myspace (natetherizzle), his superior attitude and arrogance show thru...he's a danger to the community.

hi all,
just arrived home from court. judge hall would not allow anyone other than family and deputies in the room on the state side and defense attys and nathan on the other side. glad you didn't waste a trip, Nicky, and i'll PM you later about andy. thank you so much for caring. and i hope you're feeling better soon.
judge hall denied youthful offender status to nathan lee! thank goodness! he was immediately arraigned and his atty then pled him 'not guilty' to the murder, to abuse of a corpse, and to an indictment by the grand jury just last week (against both nathan and smiley) for possession of marijuana. the next event scheduled for nathan is a status conference on 3 april 09 at 11a.m. wherein the d.a. and nathan's attys will discuss their readiness for trial. both sides stated they are still gathering evidence and are awaiting reports on such. on nathan's side, an expert witness (probably a psychiatrist hired by the defense) still needs to report.
now we're awaiting the decision at the end of the week to determine if smiley will be able to get out on the $142,500 property bond rendered during the appearance hearing by owen for the murder charge, with the addition of the added charge of abuse of a corpse. bond guidelines for this charge range from $2500 to $15,000. but these are guidelines and bond is solely at the discretion of the judge. i discussed the lee county case with the d.a. today and will likely go to lee county d.a. on wednesday to get a summary report to compare to previous testimony in lee county. smiley's atty is trying to impugn smiley's signed statement, saying it was written by the investigators who said they did so b/c smiley's handwriting was so bad and there was no audio or videotape of the interrogation. smiley signed it, tho. again, his attys entered NGRI pleas at his arraignment a few weeks ago. he may not come to trial until next september! aaarrrgghh.
so we're satisfied with today's decision but dread any decision to let smiley out at the end of the week. after all, how can we ever live in peace - and without fear - knowing our son's murderer is right down the road from us? this is a man who has admittedly killed neighborhood dogs and cats with a bow and arrow for the 'thrill.' thank goodness we have our 5 dogs as an early warning system.
i sincerely thank all of you for having our backs. you've given me the spirit to continue the fight. i just don't settle easily into a victim's role and action is what keeps me going. without all of you, well, i just don't know how i'd keep motivated. from the bottom of my heart, i'm so thankful for all of you.

If these were neighborhood pets, you need to get the prosecution to call them as witnesses. And make him get an expert on murderers and animal killers. From all the true crime, books and yes even TV most serial killers, etc started out killing animals. It would be good for the jury and court to hear that! Please keep fighting to keep these monsters in prison where they belong. I know it's difficult, long, and takes up so much time, but if you keep fighting, there WILL be a reward in the end.
I did it for a year and some months in trying to keep a convicted killer behind bars. I KNOW what you are going through, but in my situation, and in the end, this woman was not....NOT allowed early release!! :happy0158::happy0158:
It was worth everything and I'd do it again in a heartbeat!!

No problem Clay. Jeffrey went to school with my son. When all this happened, I became the overprotective mother that called every 30 minutes to make sure my son was ok. Then when the details came out it was a major shock! We live in a small community where everyone knows each other, or knows of each other. Heck our High School goes from 7th-12th grade, no middle school. I don't want these monsters ever out of jail.

Today, Christmas Eve, it is 9 months since Blake left our house, never to be seen again. While we aren't doing much celebrating, I do want to take time to wish all of you a wonderful holiday and the best of everything for 2009.

Thanks so much to all of you for your supportive efforts re smiley's attempt to get out on the original appearance bond. Fortunately, all of your efforts in writing/calling Judge Kimberley seemed to have an effect as he maintained the $250,000 cash bond from the murder indictment and added a $15,000 cash bond for the 'abuse of a corpse' indictment. Hopefully, he can't get hold of that kind of monies, altho I'm sure his atty will appeal. But without all of you and your time, emotions, and efforts, this may not have happened this way. You've save us from having to live with one of our son's murderers living right around the corner from us. From your mouths to God's ear...and He must have passed it on to the judge!:kissyface4:
