SONORA -- A search is under way for a Sonora man who vanished after a weekend fight, and two brothers are under arrest on suspicion of kidnapping and conspiracy.

A friend of Carl Stephen Knight, 23, reported him missing Sunday, said Lt. Dan Bressler with the Tuolumne County Sheriff’s Office.
“We are holding out hope he is still alive,” Bressler said. “We do not know for sure one way or the other.”
He said the friend believed Knight had been in a fight early Sunday morning and became concerned when he couldn’t be found.
Detectives believe Knight was injured in that fight, which they suspect involved Robert Earl Slawinsky, 28, and his younger brother, Paul Curtis Slawinksy, both of Jamestown. They suspect the men took Knight someplace. Both were arrested Monday evening and are each being held at the county jail in lieu of $1 million bail.
Bressler said they are searching a vehicle and home where they believe the fight occurred. They aren’t releasing whose home or vehicle they are.
Meanwhile, search and rescue crews from Tuolumne County, Sonora and the California Highway Patrol are combing the Lake Don Pedro area and the area around Jacksonville Road for any sign of Knight. Jacksonville Road includes steep terrain. As of about 11 a.m., they hadn’t found anything, Bressler said.
A myspace page that appears to belong to Knight says that he is a carpenter and displays pictures of his daughter, Lily, with her first teeth and then on her second birthday.
Paul Slawinksy is also a carpenter, originally from San Jose, according to a myspace page that appears to belong to him. He listed hobbies as fishing, dirt bike riding, hiking, swimming and shooting. He says he and plans to get a general contractor's license and become a corrections officer.
Deputies ask those with information on the case to call the sheriff's office at 209-533-5815.

Search Continues For Carl Stephen Knight

Sonora, CA -- While first degree murder charges have been filed against 28 year old Robert Earl Slawinsky and 26 year old Paul Curtis Slawinsky of Jamestown, Tuolumne County Sheriff's deputies and investigators are continuing their search for 23 year old Carl Stephen Knight of Hatler Drive in Sonora.
According to Lt. Dan Bressler, investigators believe that the Slawinsky brothers murdered Knight during a Sunday morning altercation at an undisclosed Jamestown residence.
Initially the Slawinksy brothers were charged with kidnapping and criminal conspiracy and held on $1 million bail in the Tuolumne County Jail. Wednesday those charges were upgraded to pre-meditated murder by the District Attorney's office. District Attorney Donald Segerstrom has chosen to make no comment on this case to date.
Again today investigators are combing the Lake Don Pedro area. Patrol boats outfitted with sonar gear are being utilized along with divers. Bressler adds that the south county site is the only one being searched.
In addition the California State Department of Justice, which has equipment and resources not available to the Sheriff's office, is assisting in the investigation.

Missing man's family still seeks answers

Family members of a missing Tuolumne man spent another fruitless day observing the search for him Thursday near Don Pedro Reservoir, hoping for his well being yet knowing two men are charged with his murder.
Carl Stephen Knight, 23, has not been seen since a fight early Sunday at a residence in Jamestown. Brothers Robert Earl Slawinsky, 28, and Paul Curtis Slawinsky, 26, are each charged with first-degree murder, held on $1 million bail.
"We just want him to come home," said Knight's mother, Debra Knight, standing near a line of lawn chairs in a dusty pullout by the Jacksonville Road bridge, where her family had stationed.
In addition to being out of sight, Carl Knight has not answered phone calls or text messages on his phone, said Debra Knight, who lives in Tuolumne and works at Black Oak Casino as a card dealer.
Carl Knight is an employee with Utterback Construction and lives in Tuolumne with Debra Knight. A native of San Jose and a Cassina High School graduate, he has two sisters, Angela, 30, and Charissa, 29, and three brothers, Bennet, 21, Matthew, 14, and Emery, 9.
Debra Knight said she is grateful for the support from friends, family, Utterback Construction, Black Oak Casino and investigators since the search began. It has allowed her to keep vigil at the bridge, where she can't help but stay, she said.
Samantha Bunch, Knight's ex-wife and mother of his 3-year-old daughter, Lily Knight, was among those waiting for word Thursday.
"I loved Carl — I did," Bunch said. "And I hope that I can be here until we find him."
The couple's anniversary would have been next month, and they have regular contact, she said.
Barbara Murray, a neighbor of the house where the fight allegedly occurred, has a son who has been friends with Carl Knight for about 10 years.
She saw Knight the night before he disappeared.
"Carl was one of my boys, and I loved him," she said.
He was a hard worker, and dedicated to Bunch and his daughter, she said.
"It's just not like Carl to go up there and start a big to-do," she said.
The charges against the Slawinsky brothers also seem unbelievable, said Elizabeth Cassin, Paul Slawinsky's employer.
Cassin, a Calaveras County resident, owns numerous properties in Northern California, including the duplex in Jamestown where Murray resides.
Paul Slawinsky manages her properties, and does regular upkeep and construction, such as replacing windows and hanging doors. Robert often assists.
Paul Slawinsky's work helps to support his family, including younger siblings and a disabled father, she said.
Both brothers led a group that renovated the Jamestown property.
Cassin has been impressed with the quality of their work, calling them "committed craftsmen," she said.
"He and Robert have always behaved with the utmost integrity and sincerity in their dealings with us," she said.
The allegations against them don't match the men she has dealt with, she said.
"I don't know what could have led to this unfortunate tragedy because it's just so out of character," she said.
Whatever happened, the outcome has been hard on the Slawinsky brothers' family, she said.
Cassin doesn't know Carl Knight, but sympathizes with his family as well.
"My heart goes out to both families," she said. "They're suffering during this terrible tragedy."

I wonder if LE has been able to trace his cell pings. That should give them a clue as to where he was taken. Also, who witnessed this fight, when did it end, and how long were these brothers out of contact? In fact, their cell pings would be another place to look.

The charges lead me to believe that enough dna was found to have LE believe he is no longer alive. I hope he is found and his family doesn't have to wonder. It would be nice if the brothers would tell what they did with him, but considering they've alledgedly killed him, they aren't exactly the type to do the right thing.

Don Pedro is not all that close to Sonora. It is not like the town is on the lake. If the police are searching Don Pedro then someone told them where to search. Logic tells me that anyway. And seeing as murder charges have been filed, I say that the brothers are talking, imho.

Brothers plead not guilty to charges

Two brothers charged with murder following the disappearance of a Tuolumne man pleaded not guilty Wednesday.
Jamestown residents Robert Earl Slawinsky, 28, and Paul Curtis Slawinsky, 26, appeared in Tuolumne County Superior Court in red jail jumpsuits.
They are suspected of killing Carl Stephen Knight, 23, of Sonora, April 6 during a fight at a Jamestown residence.
Judge Eric DuTemple appointed Sonora defense attorney Don Martell to represent Robert Slawinsky after public defender Carolyn Woodall, who was previously appointed, discovered a conflict.
Sonora defense attorney Doug Gee will represent Paul Slawinsky.
Deputy District Attorney John Hansen is prosecuting the case.
Gee, whose office was appointed at the first hearing last week, received the complaint at Wednesday's hearing. Martell wasn't present as he was only just appointed.
DuTemple set a preliminary hearing for 1:15 p.m. May 9 in Department 3 to give the attorneys time to review the case.
Several law enforcement officers from the Tuolumne County Sheriff's Office, Sonora Police Department and county jail provided extra security at the hearing.
Sheriff's spokesman Lt. Dan Bressler said the additional manpower was there due to some threats made against the Slawinsky family, though he declined to cite specifics.
"We were in the courtroom to make sure that nothing took place that shouldn't," he said.
Knight remains missing. A search on Don Pedro Reservoir has paused while the Sheriff's Office waits for response from the state Office of Emergency Services, Bressler said.
The state office will be sending out state-of-the-art sonar equipment to assist in the search. It is expected to arrive sometime this week, he said.

I would like to know what the figth? can someone give me an update on what is going on? I know these boys and know they wouldn't beat up someone for no reason. I would appricate it if anyone could enlighten me on this. but I would like facts not hear say. Thanks

2 Brothers Plead Guilty To Manslaughter

SONORA, Calif. -- Two brothers accused of kidnapping and killing a man pleaded guilty Tuesday to voluntary manslaughter.
Robert Earl Slawinsky and Paul Curtis Slawinsky were originally booked into the Tuolumne County Jail on charges of kidnapping, criminal conspiracy and murder.
Carl Knight, 23, disappeared in early April, but his body was never found.
In a plea deal, the district attorney dropped the murder charge for each brother in exchange for a voluntary manslaughter charge.
The brothers admitted to county investigators that they had dumped Knight's body over a guard railing into the lake.
Detectives think Knight was hurt in a fight on April 6, which may have stemmed from slashed tires, the Tuolumne County Sheriff's Department said.
Investigators from the department searched for Knight near Jacksonville and Lake Don Pedro.
Knight's family then hired a search team from Idaho to look for the body at a cost of more than $30,000.
"Dispose of the body, and there will be no evidence to prove a second-degree murder. I don't believe this was the heat of passion, I don't believe it was a fair fight," the victim's mother, Debra Knight, said outside of court.
The Slawinsky brothers will be sentenced on Aug. 11. They face a maximum of 11 years in prison.

Body find delays brothers' sentencing

A Tuolumne County Superior Court judge Monday postponed sentencing for a pair of brothers, convicted of killing a Tuolumne man, after a body was found floating in Don Pedro Reservoir.
Judge Eric DuTemple made the announcement to a packed courtroom filled by the families of Paul C. and Robert E. Slawinsky — who pleaded guilty to manslaughter last month — and the victim Carl Knight.
"I know you are all here for the sentencing," DuTemple said. "But before we begin, there are a few matters that need to be put on the record."
"A body was located in Don Pedro late Friday," Du Temple continued. "There is no possible way to identify the body at this time. Without knowing for sure the identity of that body, this court is not in a position to proceed with the sentencing."
Law enforcement authorities believe the body, found Friday near School House Cove in Don Pedro Reservoir, is that of Edgar Delacruz, 20, who disappeared May 25 during a party on a houseboat. He could have fallen off or tried to swim to another nearby boat, authorities believe.
School House Cove is on the opposite side of the reservoir, nearly 20 miles by water, from the Jacksonville Bridge, where the Slawinskys admitted to dumping Carl Knight's body.
An autopsy, which could confirm the body's identity, is being arranged, the judge said. He postponed the sentencing until Aug. 21.
No one moved as Du Temple got up from his chair and exited the door from which he came, and deputies began tearing tape off the armrests of chairs along the aisles, which had served as a temporary barrier.
The Knight family gathered with Victim-Witness coordinators across the street, while the Slawinsky families dispersed.
"One family is going to have closure by Thursday, by the discovery of their loved one. That is what matters," said Carl Knight's mother, Debra Knight.
Knight and her brother, Erwin "Duke" Knight, have been searching Don Pedro on foot, by their own boats, and with the help of a private company and Tuolumne County Sheriff's boat patrols. So far, nothing has turned up.
The Knights have been vocal in their criticism of how the District Attorney's Office offered a plea bargain instead of pressing murder charges against the Slawinskys, and failing to charge other people they believe were involved in the assault on Knight at the Slawinskys' home.
By all accounts, Knight's death was linked to a fight. But who started it, how, and why it ended the way it did, differs by who tells the story.
"The D.A. looks at the case like: without a body, for all we know Carl is still alive," Debra Knight said. "It's heartless. But right now, the only indication or proof he's dead is that he hasn't answered his cell phone and hasn't come home to his wife and child."
Deputy District Attorney John Hanson was not available Monday evening for comment.
DuTemple and the Tuolumne County District Attorney's office had previously indicated that additional evidence — specifically, the recovery of Carl Knight's body — would affect the plea agreement reached July 1, which charges the Slawinsky brothers with manslaughter instead of murder.
According to the law, manslaughter is killing without the "malice aforethought" necessary for murder, and carries penalties of 3 to 11 years.

Sonora, Ca -- Sgt. Jim Oliver with the Tuolumne County Sheriff's Office confirms that an autopsy has found that the body located last Friday in Lake Don Pedro is that of Edgar Delacruz of the Modesto area.
The 20-year-old Delacruz went missing from a houseboat party back on Sunday, May 25. Officials were able to identify the body through dental records. Oliver says the cause has not been determined, but there were no signs of trauma.
Because there was a possibility that the body was that of Carl Stephen Knight, the voluntary manslaughter sentencing for Paul and Robert Slawinsky was postponed on Monday.
The District Attorney's Office confirms that the Slawinsky brothers are now scheduled to be sentenced this afternoon at 3:30pm. If the body would have been that of Knight, they could have possibly faced more serious charges.

Court documents reveal details of slaying

Bloody towels, brass knuckles, and burned shoes are among pieces of evidence prosecutors had at their disposal in pressing criminal charges against a pair of Jamestown brothers who admitted to killing a man last spring.
The items were collected from a Jamestown home where a fight occurred April 6 that resulted in the death of Tuolumne resident Carl Knight, according to search-warrant papers contained in a court file.
The evidence was not enough to convict Robert and Paul Slawinsky of first- or second-degree murder without Knight's body, the District Attorney's Office ultimately decided. Instead, the brothers pleaded guilty to voluntary manslaughter in a plea deal the defense and prosecution struck during a hearing July 1.
They will be sentenced Aug. 11, unless Knight's body is somehow recovered.
A body could give the prosecution a cause of death, which is what they need to prosecute a higher charge, Deputy District Attorney John Hansen said.
"We don't know what killed Carl Knight," he said. "Without that knowledge, we can only go on what the evidence would indicate."
The District Attorney's Office's actions are "evidence driven."
"It's not an emotional thing," he said. "It's cold hard fact: We have killing in the heat of passion."
The evidence as it stands won't allow them to prove beyond a reasonable doubt that the Slawinsky brothers killed with "malice aforethought," which is what murder would require. The difference between first- and second-degree is that first is deliberate and premeditated.
Voluntary manslaughter is a killing in the heat of passion with provocation, often as a result of a fight.
Law enforcement has statements from the defendant, but those stories have evolved with each questioning, Hansen said.
A probable cause statement investigators filed in court gives some of the initial information they uncovered through interviews.
The Slawinskys' residence told investigators that she heard a fight between Knight and Robert and Paul Slawinsky about 3 a.m., and heard "something get beat," according to the court document.
A female voice said, "Stop, you're going to kill him," the neighbor said.
She looked out the window and saw an unconscious person being loaded into a white truck. Then, the two brothers drove away at a high speed, the neighbor said.
In an initial interview with authorities, Paul Slawinsky denied anything happened to Knight and said Knight left on his own.
Stacy Halstead, who was at the residence at the time, said the same thing, but later told about the fight.
She said they were at the residence on April 5 drinking vodka. Knight arrived and challenged Paul Slawinsky to a fight after Paul went out to address him, Halstead said.
The fight began, and Carl Knight had Paul Slawinksy on the ground, hitting him, she said. Robert Slawinsky started kicking Knight, when Melissa Slawinsky came out and said, "That's enough."
Knight was on the ground moaning, and still had a pulse when they loaded him into the truck.
Robert Slawinsky told of a fight between Paul Slawinsky and Carl Knight during an interview, the document says. Afterwards, he said he helped Paul Slawinsky put Knight into the truck.
They took him to a turnout on Highway 120, he told investigators. When they left, he was still alive, he said.
That story later changed with further interviews, Hansen said.
"They gradually got to where they said, ‘We killed the guy and dropped him off the bridge,' " he said. "They were trying to cover up what had happened. They didn't want to get caught."
Debra Knight, Knight's mother, doesn't believe the latest version of the story — that they dropped him off the Jacksonville Bridge into Don Pedro Reservoir.
A private Idaho nonprofit organization the family hired to scan the area was unable to find Knight's body even with state-of-the-art sonar and digitizing equipment.
"The team photographed every inch of that water," she said. "He is not there."
It is returning next week to search areas of New Melones Reservoir, Debra Knight said.
Carl Knight's uncle, Duke Knight, who is frustrated with District Attorney and Sheriff's office officials, is putting together money to offer a reward to anyone who leads the family to his body.
The family hasn't given up the search themselves — both in the hope that finding Knight's body would spur revision of the charge the Slawinskys face, as well as give the families closure.
"He's got to be somewhere," Debra Knight said.

Brothers sentenced to 11 years

Judge Eric DuTemple sentenced Robert and Paul Slawinsky to 11 years in state prison Thursday for the April 6 killing of Carl Knight.
The sentencing was postponed from Monday upon discovery of a body in Don Pedro Reservoir last Friday. The body was identified as that of Edgar Delacruz, a 20-year-old Ceres man who disappeared from a house boat over the Memorial Day holiday. An autopsy was conducted Wednesday, and dental records were used to make the identification, according to Sheriff' Office Sgt. Jim Oliver.
The Slawinsky brothers were convicted of aggravated manslaughter, a step up from the plea bargain of manslaughter without malice reached July 1. The "aggravated" sentence, recommended by the probation department and prosecution, ensured that the brothers would get the maximum penalty for manslaughter, 11 years.
"The defendants indicate now that they are remorseful, but at the time of the initial interviews, they set up a story, which they convinced other people to tell that Carl left their home on his own accord and without injury," said Deputy District Attorney John Hanson. "That particular callousness and planning is particularly disturbing."
The brothers are not eligible for probation, and must serve 85 percent of their sentence — about nine years, before being eligible for parole. DuTemple ordered them to pay $2,200 restitution, and imposed another fine of $2,200 that will take effect if they do not successfully complete parole.
DuTemple allowed two of Carl Knight's family members to speak. His mother, Debra Knight, addressed the court first.
Knight read from a prepared statement about the impact Carl's death has had on her and the family. The Slawinsky brothers hung their heads, sometimes shaking them as if in disagreement when Knight described what she believes happened that night. When she talked about the choices they could have made, neither brother looked up. One wiped his eyes on the sleeve of his red jail uniform.
"By the Slawinsky brothers' own statements, they took Carl's pulse and he was breathing. At that point... he could have been saved by being taken to a hospital. Somebody at the house could have called 911," Knight read.
Erwin "Duke" Knight, Carl's uncle, made a similar statement, calling the brothers "sociopaths," and "heathens," and emphasizing that their "heinous" act came down to that same moment of choice.
"If they took him to a hospital and he didn't survive, that's manslaughter," he said. "But they chose to turn left and head out into the hills..."
Before pronouncing the sentence, DuTemple explained all the factors he took into consideration in a case he described as "very difficult" due to unreliable witnesses and attempts to cover up evidence.
Among the "mitigating factors" that appeared in various reports and versions of the story were that Carl Knight might have been under the influence of methamphetamine and/or alcohol when he went to the Slawinsky brothers' house, he might have been the instigator of the fight, and he might have been armed with metal weapons, DuTemple said.
"Unfortunately, the picture of what really happened that night is cloudy at best," he said. "The incident reported by the Slawinskys was so filtered to put them in the best light and changed so often ... unfortunately, we'll never know what really happened."
Despite any mitigating claims, DuTemple said the initial fight was one-on-one between Carl Knight and Paul Slawinsky, and did not involve any weapons. When Knight began to get the upper hand, Robert Slawinsky jumped into the fray with a bat and both brothers started beating him.
"When Carl Knight became incapacitated and unable to defend himself, the brutal beating continued," DuTemple said.
Robert hit Knight more than 15 times with the bat, while Paul used his elbows "to inflict even more damage, leaving the victim at an absolute inability to react or to help himself. ... Clearly, this is not a case of self-defense," the judge said.
The Slawinskys' efforts to eliminate the evidence would not be rewarded with leniency, DuTemple added, as he read the details of the sentence.
Outside the courtroom, the mood was somber, with emotions running high on both sides.
Samantha Bunch, Carl Knight's ex-wife and mother of his daughter, Lily, 3, appeared overwhelmed. She said she had just begun writing down her feelings about the situation.
"Lily's having a really hard time," Bunch said. "She always asks for her daddy. The other day, she said: ‘Mommy, I'm going to fly like a bird to heaven and rescue daddy.' "
Bunch paused, wiping away tears.
"I thought, as a mother, I could make it all better for her. But I realized I can't because I can't make it better for myself. Carl and I were divorced, but he was still very involved with Lily."
Bunch said she and Knight did not divorce over drugs or alcohol. When they first got together, Carl was using drugs, she said. But when Bunch found out she was pregnant with Lily, Knight went through a six-month Salvation Army rehab program and was clean for the next several years.
"When he came back, he was such a sweetheart. It all got better after we moved out of Jamestown," Bunch said.
In 2007, when Carl got laid off and the couple divorced, he moved back to Jamestown.
"I never understood why he hung out with them," she said, referring to the Slawinskys and Carl's other Jamestown friends.
Linda and Dylan Tilley, friends of the Slawinskys,' said Robert and Paul weren't bad people, but they had done a bad thing.
"It's just sad that all of us are sitting here broken-hearted. No matter what side you're on, it's a shame that it happened," Linda said.
Duke Knight is hoping the brothers will tell prosecutors where they hid Carl's body so the family can bury him. If not, he said, he is prepared to search abandoned mine shafts across the county. Soon after the killing, the brothers allegedly told others they had dumped Carl's body in an old mine.
"We need to get him back. I'm going to keep looking," Duke Knight said.
Debra Knight said she was pleased with DuTemple's decision. He was attentive and patient with the Knight family, she said, and saw through the brothers' stories.
"He didn't go for first-degree murder and the electric chair, like I would have wanted. But he did acknowledge that the fight that night was not fair," she said.

This is a LONG SHOT, I know...but once I looked at his myspace and saw that his hometown was San Jose and I had a BINGO! moment. I know he was not near San Jose when he vanished, but we all know how far people can and often go to dump a body!

Human head, remains found in hills; dead man may be a homicide victim

SCOTTS VALLEY - A hiker found a decomposed human head on a trail in the hills above Scotts Valley High School and Sheriff's Office detectives think it may be the remains of an unidentified homicide victim.
The grisly discovery was made around 2:45 p.m. Tuesday on a trail leading to the Redwood Glen Camp between Glenwood Drive and Bean Creek Road, according to the Sheriff's Office.
Detectives and search dogs found a man's decomposed body hundreds of feet from the trail Wednesday morning, the Sheriff's Office reported.
The Sheriff's Office is considering the case a homicide, though neither the victim nor the manner in which he died has been identified.
"I really want to treat this as a homicide because possibilities do exist that it will remain one," Lt. Phil Wowak, head of the Sheriff's Office Investigations Unit, said. "It just doesn't seem like a lost hiker and it doesn't seem like a natural event."
The man appeared to be in his late teens to mid-20s and had dark hair. His body was fully clothed and a "distinctive" ring was found with him, according to the Sheriff's Office.
Details about the man's clothing and a photograph of the ring may be released later this week in hopes that someone can help identify the man, Wowak said.
The man's body was found in a remote, heavily wooded area by a Santa Clara County Sheriff's Office police dog trained to recover human remains.
Wowak said it appeared the body was badly decomposed and that the man had died several months ago.
Wowak wasn't sure how the man's head became separated from his body.
"It was hundreds of yards away from where we found the body," Wowak said. "It's likely it was brought down there by animals, but we haven't ruled out the fact someone stumbled across it and put it there so it would be found."
The well-traveled trail where the man's head was found is near Redwood Glen Camp and Conference Center on Bean Creek Road, north of Scotts Valley. Wowak said he thinks the man was killed where his body was found.
"In my opinion based on the visit there, the person likely died at that location but we can't rule out that they died someplace else and were brought it," Wowak said. He added that no evidence of how the man died, such as a gun or a knife, was found in the area.
There were no other belongings - including ID - found with the man, according to the Sheriff's Office. Detectives are reviewing 150-200 missing persons report from Santa Cruz and Santa Clara counties to narrow down the number of people to compare against this case. Also, an autopsy will be performed this week to determine the cause of death.
Sheriff's detectives ask that anyone with information about the dead man contact the Investigations Unit during business hours at 454-2311, the nonemergency dispatch number after hours at 417-1121 or the anonymous tip line at 454-2847.

"The man was 14 to 22 years old, of either white or Latino descent and had been dead for two months to a year, according to the Sheriff's Office. He was wearing an intricate joker shirt and diamond-and-gold ring. The gold band has a solitaire diamond in the middle with four, smaller diamonds on either side set in pairs, one diamond stacked on top of the other. The smaller diamonds are bordered by copper strips."
