Macclesfield, N.C. — A 13-year-old boy who was tied to a tree two nights this week died Thursday, and his father and stepmother have been charged with murder, authorities said Friday.

Brice Brian McMillan, 41, and Sandra Elizabeth McMillan, 36, both of 1110 Felton Farm Road in Macclesfield, have been charged with first-degree murder and felony child abuse. They were being held Friday in the Edgecombe County Detention Center without bond.

Deputies were called to the Felton Farm Road residence Thursday afternoon to assist paramedics with an unresponsive teen. The boy's father told deputies he had tied the teen to a tree outside the home Tuesday night because he was being disobedient and other disciplinary actions had failed.

The father said he untied the boy Wednesday morning and allowed him back into the house, but he was tied to the tree a second time that night when he started acting up again. The boy remained tied up until his stepmother found him unconscious at about 4:30 p.m. Thursday, authorities said.

The teen, whose name wasn't released, was taken to Heritage Hospital, where he was pronounced dead.

A 7-year-old and a 9-year-old who live in the McMillan home have been placed in the custody of the Department of Social Services, authorities said.

Carolyn Pollard, who lives across the street from the McMillans, said the family moved to the area about three months ago. The children were homeschooled, and the family kept to themselves, she said.

"I was devastated. I did not believe that had taken place," Pollard said. "When I heard that (the boy died), I still don't believe it."

Mickie was born in Havre de Grace, Maryland, and grew up in Charlestown,

High School in Wilmington, she moved to Greenville where she received
two degrees from East Carolina University: in 1988, a BA degree in
Broadcasting Communications, and in 1994, a BS in Mathematics. She was
employed at WITN-TV for several years and had taught Math at Wellcome
Middle School for 10 years, prior to retiring due to disability in 2003.

Mickie was a member of Jarvis Memorial United Methodist Church, where
she was active in the Children's Ministry and in the contemporary
service. In addition to her work in the children's ministry, she also
was a longtime volunteer for the Children's Miracle Telethon. Mickie was
a devoted wife and mother, a loving daughter and sister.

She is survived by her husband, Brice McMillan; and sons, Tyler Gene
McMillan and Ryan Wesley McMillan, all of the home; father and
stepmother, Carl and June Sasser of Wilmington, NC; mother, Dessa S.
Forsythe of Charlestown, MD; brother, Brian Sasser; and sister, Shannon
Sasser, both of Wilmington, NC; maternal grandmother, Gertrude "Coo-Coo"
Starling of Charlestown, MD; and numerous aunts, uncles, nieces,
nephews, extended family and friends.

The family will receive friends from 6 to 8 p.m. Tuesday at Wilkerson
Funeral Home.

Memorials may be made to Jarvis Memorial United Methodist Church, 510 S.

I think you're right. But it does say that they left him tied up until 4:30 in the afternoon. We've had record breaking temps in GA lately. Might've been extremely hot in NC as well.

The teen, who was identified as Tyler Gene McMillan, was in cardiac arrest and was taken to Heritage Hospital, where he was pronounced dead, Jefferson said.

How awful.

Tie a child to a tree because he was disobediant and because other disciplinary measures didn't work!!!???!!!

For goodness sakes he was a 13 y/o, doing what teens do. As hot as it's been, where do these people have their brains.

Investigators found bruises on the boy's wrists and ankles, Knight said, declining to comment on whether other marks were found on his body.

He must have been struggling to free himself or the father really tied him up tight. I wonder what it was that put him in cardiac arrest in the first place.

I agree...much more to this story. I am anxious to hear more as to what caused his death. This story saddens me to no end.

My story doesn't matter, but I feel the need to share...my sister and a neighbor kid stripped me naked, taped my mouth shut and tied me to a tree in our front yard one summer day for about an hour. I was 5 and they were 9 and 10. I was so humiliated and ashamed. Just so it is known... my Mum didn't come to my rescue, she never did when my sister tortured me. She always said......."fight your own battles".

A 13-year-old died Thursday after he was twice tied to a tree overnight for disobeying his parents, the Edgecombe County sheriff said today.
The boy's father, Brice Brian McMillan, 41, and stepmother, Sandra Elizabeth McMillan, 36, were charged with first-degree murder and felony child abuse. They were being held without bail in the Edgecombe County Detention Center.

Rescue workers found the boy Thursday afternoon at 1110 Felton Farm Road in Macclesfield and called deputies, Sheriff James L. Knight said. Knight would not release the boy's name.

Brice McMillan, the child's father, told deputies that the boy had been disobedient on Tuesday, Knight said. McMillan said he tried to discipline his son, who still wouldn't listen, so the child was tied to a tree in the family's yard overnight, according to the sheriff.

Knight said the boy was tied with plastic ties akin to handcuffs. "There were other things on the body that led us to believe they used something different" in addition to the plastic ties, Knight said.
On Wednesday morning, the ties were cut and the boy was allowed back in the house, Knight said.

On Wednesday night, the boy continued to misbehave and was again tied to the tree, where he remained until Sandra McMillan found him unresponsive about 4:30 p.m. Thursday, Knight said.

The child was taken to Heritage Hospital where he was pronounced dead.

Knight said the child had bruises on his wrists. He said he "had some idea" of what the child was being disciplined for, but he said could not share that information. He said he did not know which parent initiated the discipline.
Two other children, ages 7 and 9, were placed in the custody of the Edgecombe Department of Social Services.

The parents are scheduled for first appearances in court Monday.

Macclesfield is east of Wilson, about 55 miles east of Raleigh.

this happened to you?? wow, i'm so sorry you had to endure that that type of treatment... and from your own sister...:( and the fact that your mum didn't help you makes it doubly harsh. it is true that children can be so cruel to one another... siblings too... but there's no excuse for a mother to not intervene. her attitude is probably a result of her own upbringing.... ? thank you for sharing that; it is obviously a difficult memory that you will carry with you forever. i hope that you did not have to suffer thru many experiences such as that. :1222423:

That is horrible, Nut. No one had a right to treat you that way. I wish someone would have been there for you. I am so sorry you had to go that.

You know Kitty, you are right, they do look very much alike. Maybe step brother and sister. Or, as Rockford pointed out, maybe second cousins. I hope this doesn't turn out to be generational incest and abuse.

I looked up heat exhaustion and dehydration, as dehydration was suggested by Roamer. It looks like (to me) like it's possible he was suffering heat exhaustion after the first day tied to the tree. When brought into the house he might have been given large amounts of water, or on his own drank large amounts of water, which could have depleted his electrolytes and this can lead to death.

The boy had languished outdoors while the area was blanketed in dense, acrid smoke from the Pocosin Lakes wildfire to the east. State officials had warned residents to stay indoors because of the smoke's health threat.

Both of the McMillans are widowed, according to past news reports.

Sandra McMillan's first husband, Dwayne "Scott" Wilburn of Rockledge, Fla., died in 2002 at age 38, according to his newspaper obituary. The couple had a daughter, Brynana Shay Wilburn.

James Pollard said Brice McMillan told him he was a construction worker.

Brice McMillan's first wife, Michelle Sasser "Mickie" McMillan of Greenville, died in 2004 at age 37, according to her newspaper obituary. The couple had two sons, Tyler Gene McMillan and Ryan Wesley McMillan.

Records show that Brice McMillan has been convicted of several driving violations, but nothing more serious.

Sandra McMillan was convicted of theft in Florida in 1991 and received probation, records show.

Their first court appearances on the murder and child abuse charges are scheduled for Monday.

TARBORO, North Carolina (AP) -- A couple accused of killing their 13-year-old son by tying him to a tree for two nights for punishment appeared in a North Carolina courtroom Monday to face charges of murder and felony child abuse.


Brice Brian McMillian, 41, reportedly said the teen was being disobedient and was forced to sleep outside.

Attorneys appeared Monday with Brice Brian McMillan, 41, and his wife Sandra Elizabeth McMillan, 36, of Macclesfield.

"It's a sad case," defense attorney Allen Powell, who rerepresents Brice McMillian, said after the hearing. He declined any further comment, and the two did not enter a plea.

The county sheriff's office has said Brice McMillan told a deputy the teen was being disobedient and was forced to sleep outside last Tuesday while tied to a tree.

The teen was released Wednesday morning, but again tied up that night for bad behavior.

Sheriff James Knight has said the boy was left tied to the tree until the following afternoon, when his stepmother found him unresponsive.

It was unclear, however, whether the 18 hours were consecutive or the total time the boy spent tied to the tree during a two-day period, and authorities could not comment on the matter.

Brice McMillan told Edgecombe County deputies he tied his son to a tree at their house, 1110 Felton Farm Road in Macclesfield, last Tuesday night because the boy was being disobedient and other disciplinary actions had failed.

Brice and Sandra McMillan are both scheduled to be back in court July 2 for a probable cause hearing.

I agree. How else would he be missing flesh from his buttocks in relation to being tied to the tree? The cuts all over his body were probably from struggling against the bark. Poor kid. Were there any close (distance) neighbors? I wonder if he would have been found & saved had he yelled. Of course, we all know how people hear things & don't even respond....

I wonder how a man could tie a teen to a tree, naked or not, without some help? If he was the type of teen to misbehave, would he have stripped and stood ready for a second time? There's got to be more to this story.

With the report of both parents retaining separate counsel, I wonder if they are going to point the finger at each other during trial.

I read a quote from an elderly neighbor that if he'd just known what was going on he'd have gone over to free the child. I was under the impression that there were no really close neighbors. Also, we don't know if Tyler was gagged.

I just hope that the other two kids are able to help LE understand what happened. I'm really surprised that we've not heard from the bio mother's family.

With the father in tears and the step-mother not appearing upset, I'm thinking lots went on while the father was at work. Probably a total nightmare for the kids.

That's true, he could have been gagged. We don't have many details yet.

the scene Thursday. Jefferson said the call was made in response to cardiac arrest. When he arrived, he said he found the father kneeled over the boy giving CPR.

Jefferson said he "didn't know how long (the boy) had been down" when he arrived, but that his ambulance driver, David Corbett, and he loaded the boy into their ambulance. Parked in the backyard, Jefferson said they hooked the 13-year-old to a monitor to check his vital signs.

"There was no pulse, no shock indicated" at that point, Jefferson said, "and that is when we continued the CPR."

Knight confirmed that the boy was found in the back yard, near a tree he believed to be "near the porch." The investigation is still ongoing.

The house at 1110 Felton Farm Road sits more than 300 feet from the road, with thick trees and vegetation at the rear and the east side of the residence, with a large, fenced-in field on the opposite side. The front and backyard are dotted by more than 40 trees, five of which had different types of rope and string attached to them.

Shrock also said that McMillan mentioned their other child, but only that "he doesn't get out much."

Tyler was born and raised in Pitt County. He began his schooling at Greenville Christian Academy and then attended Trinity Christian School. He grew up attending Jarvis Memorial United Methodist Church. Tyler was active in many hobbies. He enjoyed reading, fishing, karate, being a Boy Scout and watching Professional Wrestling. He loved playing outdoors with his cousins.
He has gone to join his mother, Michelle (Mickie), who preceded him in death.
He is survived by his father, Brice B. McMillan and stepmother; brother, Ryan Wesley McMillan; stepsister, Bryanna; paternal grandparents, Sam and Vi McMillan; maternal grandparents, Carl and June Sasser and Dessa Forsythe; and a very large and loving extended family.
The family will receive friends at Wilkerson Funeral Home Sunday from 5 to 7 p.m.
In lieu of flowers, donations for an Educational Fund for his surviving brother in the name of Ryan Wesley McMillan may be sent to P. O. Box 2483, Winterville, NC 28590.

I married Carl Sasser in 1976 and moved to Wilmington, North Carolina. Carl and I have 1 daughter (Shannon, now 28) and 1 son (Brain, now 26), plus we had his daughter, Mickie, from a previous marriage. Mickie gave us two wonderful grandsons before she died in September 2004 from breast cancer. Carl retired from duPont after 31 years, and now is a Detective doing Crime Scene Investigation with the Sheriff's office here in Wilmington. I work for an engineering firm and have been there almost 21 years. I'm a Deacon at my church, and an assistant Sundy School teacher. My parents retired to Florida years ago, and are in pretty good health for a couple in their 80's. Except for losing Mickie - life is good! (Updated: November 29, 2006)


If Tyler were really such a problem for this couple, it sounds as though other family members would've been quite happy to step in and care for Mickie's children.

Macclesfield, N.C. — Callers to 911 seeking help for a 13-year-old boy who authorities have said was tied to a tree for two nights did not answer a dispatcher when asked what the teen was doing before he stopped breathing.

That's according to a 911 call released Tuesday that begins with a woman telling the dispatcher: "Our little boy stopped breathing."

The dispatcher repeatedly asks the woman, and later a man, what the child had been doing before he stopped breathing. Neither responded. The man said the boy did not have any medical problems.




This child's maternal gdf was employed by a county in NC as a CSI Investigator. I'll bet that this LE department is making sure they have an air-tight case against these two.

GREENVILLE -- Tyler Gene McMillan, 13, passed away Thursday, June 12, 2008, at Heritage Hospital.
The funeral service will be conducted Monday at 10:30 a.m. in Jarvis Memorial United Methodist Church. Burial will be beside his mother in the family cemetery.
Tyler was born and raised in Pitt County. He began his schooling at Greenville Christian Academy and then attended Trinity Christian School. He grew up attending Jarvis Memorial United Methodist Church. Tyler was active in many hobbies. He enjoyed reading, fishing, karate, being a Boy Scout and watching Professional Wrestling. He loved playing outdoors with his cousins.
He has gone to join his mother, Michelle (Mickie), who preceded him in death.
He is survived by his father, Brice B. McMillan and stepmother; brother, Ryan Wesley McMillan; stepsister, Bryanna; paternal grandparents, Sam and Vi McMillan; maternal grandparents, Carl and June Sasser and Dessa Forsythe; and a very large and loving extended family.
The family will receive friends at Wilkerson Funeral Home Sunday from 5 to 7 p.m.
In lieu of flowers, donations for an Educational Fund for his surviving brother in the name of Ryan Wesley McMillan may be sent to P. O. Box 2483, Winterville, NC 28590.

Child Dies After Being Tied To Tree; Couple Charged

The News & Observer MACCLESFIELD, N.C. -- For disobeying his parents, a 13-year-old North Carolina boy was tied to a tree overnight two times this week.

On Thursday afternoon, he was found there unresponsive, his wrists bruised from the plastic ties that bound him. The boy was taken to a nearby hospital, where he was declared dead.

Now, his father and stepmother are charged with his murder.

The boy's father, Brice Brian McMillan, 41, and stepmother, Sandra Elizabeth McMillan, 36, were charged with first-degree murder and felony child abuse. They were being held without bail Friday in the Edgecombe County, N.C., jail.

Edgecombe County Sheriff James Knight said Friday that Brice McMillan told deputies that the boy had been disobedient on Tuesday. McMillan said he tried to discipline his son, who still wouldn't listen, so the child was tied to a tree in the family's yard overnight.

Knight said the boy was tied with plastic ties akin to handcuffs. "There were other things on the body that led us to believe they used something different" in addition to the plastic ties, he said.

On Wednesday morning, the ties were cut and the boy was allowed back in the house, Knight said.

On Wednesday night, the boy continued to misbehave and was again tied to the tree, where he remained until Sandra McMillan found him unresponsive about 4:30 p.m. on Thursday, Knight said.

The boy had languished outdoors while the area was blanketed in dense, acrid smoke from the Pocosin Lakes wildfire to the east. State officials had warned the public to stay indoors because of the smoke's health threat.

After authorities arrived, the child was taken to Heritage Hospital where he was pronounced dead.

Knight said he had some idea of what the child was being disciplined for, but he said could not share that information. He said he did not know which parent initiated the discipline.

Two other children, ages 7 and 9, were placed in the custody of the Edgecombe Department of Social Services, the sheriff said.

Macclesfield is in rural southern Edgecombe County, roughly between Wilson and Greenville and about 55 miles east of Raleigh. Open farmland predominates, with houses and stands of shade trees scattered along two-lane roads.

Neighbors James and Janice Pollard said Friday they had no idea the McMillan boy was being abused.

"If I had known he was tied to a tree, I would have gone over there and got him loose", said James Pollard, 76. "That was ridiculous."

The Pollards said the McMillans moved to the home several months ago.

James Pollard said Brice McMillan told him he was a construction worker. McMillan had worked hard building a horse fence, he said.

Janice Pollard recalled Brice McMillan asking her about the neighborhood during a visit before they moved in.

"I told him it was the most peaceful place he'd ever find", she said.

A lone dog lay tied to a tree in the flat front yard at the McMillan family's red-brick farmhouse on Friday.

Out back, to the left, a horse roamed inside a chain link fence. Near a wooden swing set in the shady rear, a pen housed two grazing goats and six chickens.

Meanwhile, the news of what happened in Macclesfield was the talk of surrounding communities.

Donna Harrelson, 45, said she heard about it at work on Friday. On Friday night, she was at Tarboro High School along with hundreds of others celebrating the graduation of the latest senior class.

"I think that's some sorry parents", Harrelson said. "I think they need to do the same things to the parents."

Chad Harper, 27, of Greenville, talked of his 2-year-old son, Noah. He said if the situation ever got so bad that he thought that was the only way to discipline his child, "I'd certainly seek help."

"That's everybody's general reaction to it, just outrageous", he said.

Both of the McMillans are widowed, according to various past news reports.

Sandra McMillan's first husband, Dwayne "Scott" Wilburn of Rockledge, Fla., died in 2002 at age 38, according to his newspaper obituary. The couple had a daughter, Brynana Shay Wilburn.

Brice McMillan's first wife, Michelle Sasser "Mickie" McMillan of Greenville, died in 2004 at age 37, according to her newspaper obituary. The couple had two sons, Tyler Gene McMillan and Ryan Wesley McMillan.

Records show that Brice McMillan has been convicted of several driving violations, but nothing more serious.

Sandra McMillan was convicted of theft in Florida in 1991 and received probation, records show.

Their first court appearances on the murder and child abuse charges are scheduled for Monday.

I am sickened after seeing the tree and the rope. OMG. You could see ants crawling all over the tree and rope. I can't imagine what that poor boy went through. I agree...much more to this story. I am anxious to hear more as to what caused his death. This story saddens me to no end.

My story doesn't matter, but I feel the need to share...my sister and a neighbor kid stripped me naked, taped my mouth shut and tied me to a tree in our front yard one summer day for about an hour. I was 5 and they were 9 and 10. I was so humiliated and ashamed. Just so it is known... my Mum didn't come to my rescue, she never did when my sister tortured me. She always said......."fight your own battles".

How terrible for that poor child! I wonder if there was something else going on, like starvation or dehydration. I don't think just being tied to the tree for a night could kill him, as awful as it is.

OMGosh!!! Look at this side-by-side shot of this couple. Notice the nose, indention between the nose and upper lip, the shape of the mouth, the chin.... they look VERY similiar...like they're blood related instead of by marriage. :shock:

I agree. How else would he be missing flesh from his buttocks in relation to being tied to the tree? The cuts all over his body were probably from struggling against the bark. Poor kid. Were there any close (distance) neighbors? I wonder if he would have been found & saved had he yelled. Of course, we all know how people hear things & don't even respond....


On the tape, showing the tree, ants can seen crawling around. I imagine he was moving around trying to scratch and get them off of him. This is just horrible!!~ :cray:

MACCLESFIELD, N.C. — A 13-year-old left tied to a tree as punishment for 18 hours in June had been badly beaten and likely died from dehydration and heat stroke, an autopsy report showed.

The report, made public Monday, also says Tyler McMillan's body was covered with insect bites and he had bruises caused by a rod-like instrument and flesh missing from his buttocks. Marks on his wrists and ankles show he may have been restrained with plastic ties.

Authorities say Tyler McMillan's parents found him unresponsive on June 12 after he had been tied to a tree overnight as punishment. His father, Brice McMillan, and stepmother, Sandra McMillan, have been charged with murder and felony child abuse.

Autopsy results were released after Raleigh television station WRAL challenged a judge's order to seal the results based on a defense motion. Attorneys for WRAL wrote Superior Court Judge Franklin R. Brown in late October to challenge his ruling. The station received a copy of the autopsy on Monday, along with an order from Senior Resident Superior Court Judge Milton Fitch Jr. The station provided a copy to The Associated Press.

The report says Tyler McMillan's body temperature was 105.6 degrees when he arrived at the hospital. Brice McMillan told a deputy the teen was tied to a tree and forced to sleep outside on June 10 because he was being disobedient. Tyler McMillan was released the next morning, but again tied up that night for bad behavior.

The boy's stepmother found him the following afternoon, authorities said.

A dispatcher handling the 911 call on the incident repeatedly asked a woman and later a man what the 13-year-old was doing before he stopped breathing, but neither responded. The man said the boy did not have any medical problems. Toward the end of the call, neither responded to repeated questions from the dispatcher as they apparently performed CPR on the teen.

Two other children, ages 7 and 9, have been placed in the custody of the Department of Social Services.

Sandra and Brice McMillan are both scheduled to appear in an Edgecombe County courtroom on Jan. 13, 2009. Messages left with both of the McMillans' attorneys were not returned Monday afternoon.

Tyler Gene McMillan: My cousin and best friend since the age of three. On June 12,2008 he was found dead, his hands tied behind his back onto to a tree. He was being punished for "misbehaving" and presumably died of heat stroke. Tyler was a good kid and would never do anything that had reason enough to be tied to a tree for 2 days. He was indeed the best friend I've ever had and I loved him like a brother.

Reading the autopsy, now, sickens me again. When I had first read the story I was sickened and outraged. This is unthinkable. I can't help but recall watching the video that shows the tree, and seeing ants crawling about the surface, KNOWING that they must also have been crawling all over this poor young boy. This was torture beyond belief. The punishment for this MUST be SEVERE!:45024:

"She'll be here for anything the court needs. We need her out of jail so she can help prepare for her trial defense," he said during the court hearing.

Her trial is scheduled for July 6.

McMillan and her husband were indicted last month. Brice McMillan waived arraignment and didn't appear at Wednesday's hearing. He has pleaded not guilty to the same charges, and his trial date wasn't immediately available.

At Wednesday's hearing, Sallenger said the couple met in 2006 through eHarmony, an online match-making service. He said both had lost spouces; Sandra McMillon's husband was killed in a car accident six years after they were married, and Brice's wife died of cancer. Both had children and worked in the construction industry. She moved to North Carolina to be with Brice in 2007.

In other developments, Judge Milton Fitch also barred Sandra McMillan from contacting her husband's son, Ryan, who lives in North Carolina, and from visiting her and her husband's home in Macclesfield, where Tyler died.

Prosecutors declined comment. Sallenger also declined to comment after the hearing, saying he was under a gag order.


They may've met through eHarmony but the physical resemblance between those two is scary. :eek:

Both were arrested a year ago after their son, Tyler McMillan, died of dehydration and heat stroke.

Sandra McMillan, 37, the boy's stepmother, is out of jail on bond. Her trial is slated to begin July 6. Brice McMillan will be sentenced after her trial.

In an Alford plea, a defendant pleads guilty, while maintaining his or her innocence, and admits it is in his or her best interest to take the plea deal because there is sufficient evidence that could find him or her guilty.

Brice McMillan told authorities that he twice tied his son to a tree as punishment for disobedience and that the boy was left outside overnight on the second occasion, authorities said.

The state on Monday did not provide further details of the crime but told a judge that Brice McMillan talked to investigators the day his son was found and then again in December, when he provided investigators with additional details about the case.

Senior Assistant District Attorney Steve Graham said Monday that Brice McMillan entered an Alford plea at a hearing in Edgecombe County Superior Court.

The Alford plea means McMillan does not admit guilt but acknowledges prosecutors may have enough evidence to convict him.

I was thinking about this case and decided to google it and see if it had gone to trial. Both parents entered Alford pleas; and they were sentenced back in June. The father received 10 to 13-1/4 years and the stepmother received 13 to 16-1/2 years. If you read through the comments there are some strong sentiments expressed about the stepmother. I really can't understand why they were let off so lightly given the horrific circumstances.

Slain boy's grandmother outraged by parents' sentences

This is so sad. This child had no value in the justice system of NC. I really feel sorry for the grandmom and the surviving brother. Maybe in 10 years when his father walks out of prison, he'll look him in the eye and tell him what a coward he is.
