Thanks for the link Land Shark..it seems that Phil pulled this stunt on lots of people..and unfortunately, Lana had no clue what she was walking into..So sad for Lana..and as to Phil..his shinanigans finally caught up with him..Sure wish Phil had had an "Intervention" to STOP this gun behavior!!!

I just saw the news here too: http://www.cnn.com/2008/CRIME/07/15/spector.witness.ap/index.html complete with a very scary photo of Phil!! :girl_haha: I hope too Judge Fidler allows her testimony. After all, Dianne can't testify this time, except by video or transcript.

I see the same potential problems with this witness that the others had.
Why in the world did she wait to become "known" this year?? The alleged incident happened years ago and she must have been aware that Phil was on trial last year.....but she kept quiet until now??
She also will have to explain her connection with being an employee and choosing to continue to work with Phil for several years afterwards.

Going to some of the same establishments as he went to on the eve of Lana's death isn't very strong evidence either. I tend to frequent the same places....if I find a place I like, I go back there.

We'll see if Fidler thinks there is enough similarity to even allow for her testimony. He might.

I wondered same thing you just mentioned...why now....is she a brand new find or was she possibly a witness that prosecution chose not to put up at the time...


sounded brand new to me...but why do they need a brand new...because I thought prosecution claimed to have many women to choose from IIRC...so maybe I missed something...or forgot something...:shrug1:

I was under the impression that many of the women who claimed something happened to them with Phil weren't allowed to testify because their stories weren't "similar" enough to what may have happened with Lana.
They had to pass a threshhold of similarity legally. In many states, none would have been allowed because of being too prejudicial.

I thought the same too, along with what time the incidents happened in relation to Lana's death. :shrug1:

To be admissable there has to be similarity and time relevance. I would expect a rather lengthy pre-trial hearing regarding these PBA witnesses...especially the introduction of a new witness who did not testify at the first trial.

the article stated there was a 7 year difference? I doubt if he'll allow it in,but I don't really think the pros needs another,he has the previous ladies and the tape of the deceased witness.:0012:

I believe you are correct...and I will agree, it is doubtful this witness testimony will be allowed. The Judge must walk a fine line, so to speak, in not allowing too many PBA witnesses, yet granting the State enough to establish the defendant's character/behavior.
