Some family members believe that if he had killed her they would have found her body.
http://www.wpde.com/news/news_story.aspx?id=138593
NewsChannel 15's Lindsay Tyner spoke with an aunt Sunday about the girl's mysterious disappearance.
"When I think about it so long, tears begin to want to bubble up," said Maggie Cabbagestalk.
Shakeima has been gone for 15 years now, but the time hasn't eased the pain or the questions.
" A fear, you know, wondering what or wondering how it would happen," said Cabbagestalk.
In 2005, 12 years after Shakeima's disappearance, police charged Sam Harmon, her mother's boyfriend with her kidnapping, rape, and murder.

Dillon man sentenced to 12 years
A jury found a Dillon man not guilty of killing his 10-year-old stepdaughter 15 years ago, but they did find Sam Harmon guilty of kidnapping the child.
Harmon was sentenced to 12 years on the kidnapping charge, but he will not serve that much time. He will be eligible for parole in 10 to 12 months.
The kidnapping occurred in 1993, and, back then, the law did not require convicts to serve 85 percent of their sentences as it does now.
Even if Harmon is not granted parole, he could still be released in three years. Prosecutors wanted the judge to sentence him to the maximum 30 years for kidnapping.
Harmon showed little emotion as the verdict came down as he sat quietly with his attorneys.
Police said Harmon has always been a suspect in Shakeima Cabbagestalk's disappearance. Jurors believed he kidnapped her in July of 1993, but they did not find him guilty of of killing the child.
Shakeima has not been seen or heard from since she left with Harmon 15 years ago.
Harmon's father said his family is pleased with how the sentencing turned out.
"I knew this day was coming. I knew what the Lord was gonna do, and he did turn it around. He did," said Jim Harmon, Jr.
Shakeima's mother sobbed during closing arguments as prosecutors talked about her daughter.
The Cabbagestalk family did not want to comment on the verdict.
The Dillon police chief said the case is closed for now because he feels their only suspect has gotten off.
Police arrested Sam Harmon on kidnapping and murder charges in 2005. That was 12 years after Shakeima Cabbagestalk disappeared. Her body has never been found.

Harmon cleared of murder, convicted of kidnapping
By Kelly Gillespie and Patricia Burkett
Published: October 9, 2008
DILLON — A Dillon County man accused of killing his 10-year-old stepdaughter 15 years ago was acquitted of murder, but convicted of kidnapping by a Dillon County jury Thursday afternoon.
Twelfth Circuit Judge Michael Nettles sentenced 40-year-old Sam Harmon to 12 years in state prison Thursday afternoon. That means he could only serve one year, however, because he’ll get credit for time served. He must serve one-third of his sentence to be eligible for parole and he’s already been jailed for three years.
Harmon was charged with murder, kidnapping and criminal sexual conduct in connection with the disappearance of his stepdaughter, Shakeima Cabbagestalk. The 4th Circuit Solicitor’s Office, however, did not pursue the criminal sexual conduct charge.
The 4th Circuit Solicitor’s Office initially pursued the case against Harmon as a capital case, but later withdrew that motion.
Prosecutors sought a sentence of life in prison if Sam Harmon was convicted of the charges they pursued against him.
Shakeima was last seen with Harmon at Turning Point Grocery on South First Avenue the afternoon of July 22, 1993.
Police said Harmon was the last person to see Shakeima alive.
Dillon police arrested him in August 2005 following an investigation.
The Dillon County Sheriff’s Office and State Law Enforcement Division also were involved in the investigation of the girl’s disappearance.
William Harmon, Sam Harmon’s brother, attended the trial and said he’s been waiting many years for a resolution of the case.
“One year seems like one day,” he said of his brother’s sentence.
Fourth Circuit Deputy Solicitor Kernard Redmond said Monday that although Shakeima’s body was never found, there are many reasons to think she was murdered.
Among those who testified during the trial were Dillon Police Chief Joe Rogers and Assistant Chief Bobby McClain, Shakeima’s uncle John Henry Cabbagestalk and her brother Kenneth Brown, who was 7 when she vanished.
“I sat here and listened to everything and took everything to heart,” William Harmon said. “I knew in my heart God is here.”
William Harmon said he doesn’t feel his brother is capable of committing the crimes with which he was charged.
“All those years I knew in my heart my brother don’t have the guts to do nothing like that,” William Harmon said.

It's confusing that they convict on kidnapping but not any of the other charges. I wonder what he said where she went after he last saw her.

I sure would love to see the transcrips from court. All of it is confusing. Even if they say he kidnapped her because he was the last person to be seen with her, wonder how they came up with the rape charge. I did not know this trial was going on. Thanks you Nut and Packy for doing such a good job.

I would like to see the transcripts too. At least to know the timeline and what the defense presented and what witnesses said if any.
there was another suspect in the beginning but with very little evidence it became a dead end, how do I know this? Im unfortunately very well aquainted with him and had never even heard of this case until he told me about it. he lived in dillon at the time and left very shortly after shakiemas disappearance. I have my reasons to believe he was involved which I wont go into here but over the years I kept an eye on this case looking for updates, I was suprised to find that her stepfather was arrested and tried for her murder, but someone else may have gotten away with it.

At least someone is having to pay for what they did to that child. I don't understand the sentencing date,July 2005 and admission date Oct, 08. Could it be he was already serving time for something else? And he can get parole in May of this year! That is ridiculous!

I was reading Sam Harmon's sentence again. He can be paroled in three months!
Sentence start date 7/24/05
Admission date 10/10/08 What does that mean?

Sadly, it's hard to prove murder without a body and good forensics. Apparently all they had to prove murder was her missing and not being found. :(
I hope the parole board denies his upcoming parole so he will have to stay the full sentencing.

So do I. I think about it so often, just thinking May will be here soon. Just have to pray God's will be done.

Nine more days until projected parole date. I hope if he is guilty he doesn't get paroled.

I hope the family turns out to keep him in. He should serve more time than this.

I want to know if this man got out on parole. I will see if Grande can find out for me. I did have the website to check but can't seem to locate it.

There is no way to tell if this is the same crime as what he was tried for.
