This is just a sad case. First the wrong man spent 9 years in prison for the crime. Now they know who committed it, yet the statue of limitations has run out. I still do not understand why there is a statue of limitations on crimes like this. I could understand if we were talking about a he says/she says type case or someone coming forward 10 years after the crime. But, this is a concrete case of rape and robbery.

A Rochester Hills man spent 9 years in prison for a rape he didn't commit. Now, prosecutors say they have the man actually responsible for that rape.

Macomb County Prosecutor Eric Smith will hold a news conference on Thursday to announce the update to this case.

54-year-old Kenneth Wyniemko was wrongly convicted in 1994, before DNA tests exonerated him in the rape and robbery of a 28-year-old Clinton Township woman.

He served 9 years of a 40-to-60-year sentence, but he was freed in 2003 after testing was done at the urging of the Innocence Project at Thomas M. Cooley Law School.

Smith says he will be unable to bring charges against the person he believes is responsible, because of the statute of limitations, but he says there will be other charges.

The press conference is scheduled for 10 a.m. Thursday morning at the Clinton Township Police Department.

Thank God for the one good thing to come out of the OJ trial...the Innocence Project....

I thought it started before the trial but no matter when I'm just glad it was created.

It was started in 1992 but it really took off thanks to the publicity Scheck received from the OJ trial and the public interest in DNA.
