Search Continues In Marshall County For A Missing Man

A developing story out of Marshall County. Friday morning, crews were searching along Alberta Creek for a man who was reported missing Thursday evening. KTEN's Whitney Allen was on sight and has the story.
The search for a missing Duncan man began Thursday night, and now the investigation broadens with new information. Search and rescue crews are looking for 58 year old Charles Lynn Barnes. Barnes own's a trailer on land owned by the Alberta Creek Resort. He and his wife were in town for the weekend.
Friday morning, Marshall County search and rescue teams combed miles of shoreline along the creek. According to the Sheriff's Office, search dogs have picked up Barnes scent in a private neighborhood. David Barnes, a Marshall County Deputy says, "We have been searching for Charles Lynnn Barnes since last night. He was out on bond by an arrest made by the OSBI.
KTEN has learned that Barnes had recently bonded out of jail and now the Oklahoma State Bureau of Investigation and the F.B.I. are involved.

Duncan attorney charged with embezzlement

DUNCAN — A lawyer accused of embezzling money from the trust fund of a client's death aunt may have more "potential victims," a prosecutor has warned.
Charles Lynn Barnes of Duncan was charged with single counts of embezzlement and forgery for allegedly taking $150,000 from the probate estate trust fund of the late Faye Glenn.
"We're getting phone calls from attorneys saying they have clients who may have had $50,000 taken here or $15,000 there," District Attorney Bret Burns said. "We're afraid this may be the tip of the iceberg, and we're directing all calls to the OSBI (Oklahoma State Bureau of Investigation)."
A court affidavit alleges Barnes instructed Glenn's executrix — her niece Jennifer Norton — to deposit $148,000 into a trust account under the attorney's name in February 2007. According to the affidavit, he told Norton the money would be used to pay the estate's bills, which would take no more than three months to close.
After the probate remained unsettled 18 months later, Norton demanded the money, the affidavit read.
Barnes allegedly wrote a $142,751.04 check to Norton from the trust account, but only after depositing three personal checks from his private account in Columbus, Ohio. One of the checks, for $165,000, bears the signature of his wife, Cindi.
Burns said Norton quickly exchanged the check for a cashier's check, and deposited the money in a personal account, but it bounced a few days later, investigators said.
That left the trust fund account a deficit of more than $145,000.
It was alleged in the affidavit that Charles Barnes confessed to forging the check because he "panicked." He also allegedly told investigators he spent the money given to him by Norton because he had slipped into a "financial hole."
If convicted, Barnes could face up to 17 years in prison. He has posted $148,000 in bail.
"Mr. Barnes will be treated like anyone else," Burns said. "He won't be treated any differently because he is an attorney."

Barnes found dead near Lake Texoma

Lake Texoma — LAKE TEXOMA — A Duncan attorney who had been sought by the Oklahoma Bureau of Investigation (OSBI) since Sept. 18 has been found dead in the Lake Texoma area.
Marshall County Sheriff Bob Wilder said that OSBI agents found Charles Lynn Barnes, 57, in a wooded area adjacent to the lake after bringing special equipment to the lake to search for him.
OSBI Public Information Director Jessica Brown said that searchers found the body at 11:30 a.m. Wednesday about two miles from his home at the lake.
“We believe he’s been dead since Thursday,” Brown said. “That’s when he was last seen or heard from.”
Wilder said that Barnes’ body has been taken by the medical examiner to Watts Funeral Home in Madill. An official cause of death has yet to be determined.
According to OSBI’s Web site, Durant Police officers and National Guardsmen also assisted in the search for Barnes.
According to the Web site, OSBI has been looking for Barnes since Thursday when OSBI served search warrants at Barnes’ home in Duncan and at the lake. He had been charged with embezzlement earlier in the month.
Additional embezzlement allegations were brought to OSBI’s attention since the initial charge was filed, Brown said. OSBI wanted to interview Barnes about these new allegations.

LAKE TEXOMA, Okla. (AP) - A missing Duncan attorney who disappeared after being charged with embezzlement has been found
dead.
Oklahoma State Bureau of Investigation spokeswoman Jessica Brown says OSBI investigators found the body of Charles Barnes Wednesday morning near Washita Point at Lake Texoma.
Brown says Barnes had a single gunshot wound to the head and appears to have committed suicide.
The 57-year-old Barnes was charged Sept. 8 with embezzling $148,000 from the trust fund of a client's dead aunt.
He disappeared 10 days later from a home near Lake Texoma where he had been staying.
